Abstract

Penelitian ini bertujuan untuk mengetahui dan menganalisis tentang peran Komisi Pemberantasan Korupsi atau yang selanjutnya disebut KPK sebagai salah satu institusi penegak hukum dalam mendukung kelancaran pembangunan ekonomi di wilayah Indonesia dan unsur-unsur SWOT (strength, weakness, opportunities, threat) yang dimiliki oleh KPK ketika menangani kasus korupsi yang dilakukan oleh mantan Menteri Sosial Republik Indonesia periode 2019-2020 yang bernama Juliari Batubara. Penelitian ini berjenis penelitian yuridis normatif dan menggunakan metode pendekatan konseptual. Data didapatkan dari penelitian bahan pustaka atau disebut juga data sekunder. Data sekunder terdiri dari bahan-bahan hukum primer, sekunder, dan tersier. Hasil penelitian ini menunjukkan bahwa terdapat sebuah peran yang dimiliki oleh KPK sebagai salah satu institusi penegak hukum dalam mendukung kelancaran pembangunan ekonomi di Indonesia, yaitu menurunkan angka kemiskinan. Selain itu, hasil penelitian ini juga menilai secara seksama dan komprehensif unsur-unsur SWOT yang dimiliki oleh KPK ketika menangani kasus korupsi yang dilakukan oleh mantan Menteri Sosial republik Indonesia Juliari Batubara. This study aims to find out and analyse about the role of the Corruption Eradication Commission or hereinafter called KPK as a law enforcement institution in supporting the smooth running of economic development in Indonesia and the elements of SWOT (strengths, weaknesses, opportunities, threats) that KPK has when handling corruption cases by former Minister of Social Affairs of the Republic of Indonesia for the 2019-2020 period namely Juliari Batubara. This study is normative and uses a conceptual approach. Data obtained from library research or also called secondary data. Secondary data is data obtained from primary, secondary, and tertiary legal materials. The results of this study show that there is one role for the KPK as a law enforcement institution in supporting the smooth running of economic development in Indonesia, specifically reducing poverty rates. In addition, the study results also carefully and comprehensively assessed the SWOT elements possessed by KPK when handling corruption cases committed by former Minister of Social Affairs of the Republic of Indonesia Juliari Batubara.

Abstract

Flight cancellations lead to passenger inconvenience and financial loss, as pre-purchased plane tickets are rendered null and void. The primary objective of this research is to examine whether flight cancellations by airlines, impacting passengers as consumers, constitute a  breach of contract or not. This research also identified the legal responsibilities of airlines as business entities in such scenarios. Several research questions were proposed.  The first issue is whether flight cancellations by airlines for passengers as consumers represent a breach of contract?;  Second, we examined the legal responsibilities of airlines towards passengers as consumers when flights are canceled.  Finally, we approached the legal responsibility of airlines for cancelled flights from a prophetic law perspective. In this normative research, a statutory approach was used to analyze the legal framework on the issue. This research regarded secondary data collected through library research, including primary, secondary, and tertiary legal materials. This research concludes that airline flight cancellations constitute a breach of contract from the perspective of passengers as consumers under Indonesian law. Besides that, two primary forms of legal responsibilities for airlines in cases of flight cancellations were identified. Airlines can either rebook affected passengers on the next available flight or refund the full ticket price previously paid by the passenger in cash and non-cash compensation. Moreover, those legal responsibilities imposed on the airlines are known in Islamic law with the ‘daman’ concept and in line with prophetic law pillars.
