Abstract

Penelitian dalam penulisan ini bertujuan untuk melakukan analisis dan deskripsi terkait dengan tindak pidana perkosaan yang ditinjau dari aspek hukum pidana di Indonesia. Pasal 285 KUHP merupakan dasar yang menjadi pengaturan tentang tindak pidana perkosaan yang memiliki unsur-unsur yang harus dipenuhi. Tidak hanya dalam KUHP, Undang-Undang Perlindungan Anak juga mengatur terkait dengan tindak pidana perkosaan yang dimana jika korban atau pelaku adalah seorang anak. Korban pemerkosaan harus mendapatkan perhatian lebih dikarenakan dapat menimbulkan banyak dampak negatif akibat peristiwa yang dialaminya itu. Hukuman dan juga akibat-akibat yang menimpanya, seperti kehamilan akibat pemerkosaan merupakan hal yang harus dilindungi terhadap korban khussnya wanita. ABSTRACT The purpose of this research is to conduct an analysis and description of the crime of rape in terms of aspects of criminal law in Indonesia. Article 285 of the Criminal Code is the basis for the regulation of the crime of rape, which has elements that must be fulfilled. Not only in the Criminal Code, the regulation of the crime of rape is also regulated in the Act of Child if the victim or perpetrator is a child. Victims of rape should get more attention because it can cause many negative impacts due to the events they have experienced. Punishment, as well as the consequences that result from it, such as pregnancy as a result of rape, must be protected against victims, particularly women.
