Abstract

Penelitian ini bertujuan untuk mengidentifikasi kegunaan pembuktian dari pertanyaan kepada saksi secara jarak jauh melalui teknologi telekonferensi selama sesi pengadilan, serta untuk menegaskan apakah tindakan tersebut sah dilakukan. Penelitian ini menggunakan pendekatan penelitian hukum normatif sebagai metodologi penelitiannya. Temuan dari penelitian ini menjelaskan bahwa, sesuai dengan Kitab Undang-undang Hukum Acara Pidana, penggunaan media elektronik sebagai kekuatan pembuktian dalam telekonferensi merupakan tindakan yang sah atau diperbolehkan asalkan didukung oleh bukti legalitas. This study aims to identify the probative utility of remotely questioning witnesses through teleconference technology during court sessions, as well as to ascertain whether such action is legally permissible. The research adopts a normative legal research approach as its methodology. The findings of this study elucidate that, in accordance with the Criminal Procedure Code, the use of electronic media as evidentiary support in teleconferencing is a legitimate or permissible action, provided it is supported by proof of legality
