Abstract

In terms of granting the status of Indonesian Citizenship by the state to Foreign Citizens, the state has several considerations. The raised issue is “The Requirement of Exceptional Achievement in Terms of Granting Citizenship to Foreigners According to the Law No. 12 for the Year 2006 Concerning the Citizenship of the Republic of Indonesia”. The research method used in this journal is normative juridical, which is through the legal and literature approach. When look at the explaination of Article 20 of Law No. 12 for the Year 2006, foreign citizens who will acquire the status of Indonesian Citizenship must fulfill the four essential elements, which are; the element of foreigner, the element of contribution to the state, the element of exceptional2achievement and the element of state’s interests. The meaning of exceptional achievement is the real work that is accomplished by the foreigner who will be granted the status of Indonesian Citizenship and the work receives its recognition from the Indonesian Government.

Abstract

The purpose of this dedication was to provide understanding to students who are prospective workers at Vocational High Schools in the field of tourism-related to work relations, disputes, and dispute resolution mechanisms within the scope of Indonesian labor law. This dedication was taken at the Dalung Tourism Vocational High School which targets students as prospective workers. With the onset of the Covid-19 pandemic, companies took strategic policies to deal with the pandemic which had direct implications for the rights of workers in an employment relationship. The lack of knowledge of Dalung Tourism Vocational High School students regarding legal basics related to employment makes it necessary to provide socialization and understanding of work relations, types of disputes, and settlement mechanisms. This dedication has come to the conclusion that the implementation of socialization and counseling provided has provided knowledge for students regarding work relations, disputes, and dispute resolution mechanisms in order to prepare themselves for the world of work. Abstract

This research is about the role of the Prosecutor as an executor in executing the assets of the convicts of corruption, to recover the State financial losses from corruption. Besides that, this research aims to know about the returning of State financial losses through the payment of replacement money. Corruption is an extraordinary crime, veiled and endanger national stability and security and inhibiting Indonesian economic development. This research is a normative legal research with primary, secondary and tertiary legal material supported by data. This research is using statutory, case, and comparative approaches. The legal basis used in this research are Law No. 31 of 1999 in conjunction with Law No. 20 of 2001, Law No. 16 of 2004 and Law No. 8 of 1981 (Indonesian Criminal Procedural Code). The corruption has become systematic and the scope enters into all aspect of life, start with the lower level with State Officers and law enforcers becomes the dominant actors. In imposing the sanction, The Judges are not only charge imprisonment but also charge additional fines and/or penalties to returning the State financial losses and ask the convicts of corruption to pay the replacement money to the State. The problem arises in this research related to the execution of the verdict about returning State financial losses which are the assets of the convicted person is already in the third party hands or have been depleted, dual population administration, the length of the judicial process, the convicted person prefers to take the subsidiary criminal charge and the hollow of norm regarding technical execution for the Prosecutors so that the execution cannot be carried out.

Abstract

This study aims to determine the role of law enforcement officer in integrated criminal justice system and to find the concept of surveillance patterns that need to be established for law enforcement officer for the future integrated criminal justice system (ius constituendum). This is normative legal research using a statutory approach and a conceptual approach. Analysis using qualitative methods and the results are presented in descriptive analysis report. The results show that the integrated criminal justice system did not have an integrated surveillance system in a special form that was implemented by the law enforcement officers and its society yet. It still applying an internal and conventional surveillance pattern. Hence, empowering the existing surveillance pattern and creating an integrated surveillance pattern could be a solution to overcome the weakness of the surveillance system in the Integrated Criminal Justice System nowadays which caused by the fragmented surveillance system without any external-cross institutional surveillance.

Abstract

This research is legal research that discusses the nature of the trial of criminal cases electronically during the COVID-19 pandemic and the existence of the value of justice as the legal ideal of the Indonesian nation in the trial of criminal cases during the COVID-19 pandemic. The writing uses a normative research method using a statutory approach and a conceptual approach. The study results show that the first is essentially the implementation of electronic criminal case trials during the COVID-19 pandemic, which is an embodiment of protection and fulfillment of human rights regarding the right to obtain justice through judicial institutions during the COVID-19 pandemic. Second, regarding the existence of the value of justice, in the trial of criminal cases electronically during the COVID-19 pandemic, the value of justice still exists or is realized by the legal ideals of the Indonesian nation. PERMA No. 4 of 2020 has procedurally guaranteed the realization of a judiciary that can accommodate the interests of justice seekers in fulfilling their human rights in the form of obtaining justice through judicial institutions. Penelitian ini merupakan penelitian hukum yang membahas mengenai bagaimana hakikat persidangan perkara pidana secara elektronik pada masa pandemi COVID-19 dan bagaimana eksistensi nilai keadilan sebagai cita hukum bangsa Indonesia dalam persidangan perkara pidana secara elektronik pada masa pandemi COVID-19. Penulisannya menggunakan metode penelitian normatif dengan menggunakan pendekatan peraturan perundang-undangan (statute approach) dan pendekatan konseptual (conceptual appoarch). Hasil penelitian menunjukkan, yang pertama secara hakikat persidangan perkara pidana secara elektronik pada masa pandemi COVID-19 adalah sebuah perwujudan perlindungan dan pemenuhan hak asasi manusia mengenai hak untuk memperoleh keadilan melalui lembaga peradilan pada masa pandemi COVID-19. Kedua, mengenai eksistensi nilai keadilan, pada persidangan perkara pidana secara elektronik pada masa pandemi COVID-19, bahwa persidangan perkara pidana secara elektronik adalah untuk menjaga agar nilai keadilannya tetap eksis atau terwujud sesuai dengan cita hukum bangsa Indonesia. PERMA RI No. 4 Tahun 2020 secara prosedural telah menjamin terwujudkna peradilan yang mampu untuk mengakomodir kepentingan para pencari keadilan dalam memenuhi hak asasinya berupa memperoleh keadilan melalui lembaga peradilan.

Abstract

The field of health is one that is given authority by the government in carrying out the service by dentists and oral therapists. The purpose of this paper is to analyse the legal protection of patients in dental and oral therapy, as well as the legal authority and responsibility of oral and dental therapists in providing care in accordance with their competence. This study utilizes normative law. Using a Legal and Conceptual Approach to Primary Legal Materials, Secondary Law Materials, and Tertiary Legislative Materials. The Consumer Protection Act does not fully implement the legal protection for consumer patients against dental and oral therapy practices. The authority of dental and oral therapists has been regulated in Permenkes 20 of 2016, but in practice, it is not implemented in accordance with the competence and provisions in force. The dental and oral therapist's responsibility to the patient is to give only painkillers, refer to the dentist, and provide compensation according to the rules in force.

Abstract

Fields of law in Indonesia are a system that is interrelated and affects each other. That there are similarities and differences between each law, including in terms of its enforcement. For example, between the Criminal Procedure Law and the Procedural Law of Military Justice. These two areas of law have some similarities in terms of the stages of trials, but there are differences, one of which is the unfamiliarity of the pre-prosecution stage in the military courts. This study aims to find out the existence of the Commander in resolving cases and to find out the reasons for the unfamiliarity pre-prosecution stage in the Military Court. This research is a normative research with a statutory approach. In addition, this study also uses qualitative analysis techniques. English translation. The existence of the commander in the settlement of cases is part of his authority to punish. The commander in charge of the command unit and his subordinates actively participates in all stages of the examination in the military courts, both as a Superior who has the right to punish in the investigation and as a case-handling officer in the prosecution stage. The existence of the pre-prosecution stage in the Military Court will intersect with the principle of unity of command and the principle of the commander being accountable. These two principles are two important principles in addition to the principle of military interest in the Military Judiciary which is also the basis of the authority and existence of the commander in the military courts.

Abstract

Penelitian ini bertujuan untuk mengkaji pentingnya peran Lembaga Bantuan Hukum (LBH) dalam mewujudkan keadilan bagi masyarakat kurang mampu, khususnya korban kekerasan dan/atau pelecehan seksual. Para korban kekerasan seksual seringkali sering kali sulit untuk mengakui bahwa mereka adalah korban, terutama jika mereka berasal dari berasal dari latar belakang yang kurang beruntung atau miskin. Situasi ini membuat mereka merasa lebih semakin tertindas dan tidak memiliki akses terhadap keadilan. Hak untuk mendapatkan keadilan dan perlakuan yang sama di hadapan hukum adalah hak asasi setiap individu, tanpa memandang ras, suku, agama, atau status sosial. Oleh karena itu, kehadiran Oleh karena itu, kehadiran LBH sangat penting dalam membantu korban untuk mendapatkan perlindungan hukum dan mendapatkan kembali hak-haknya yang dilanggar. Penelitian ini menggunakan metode penelitian hukum empiris hukum empiris dengan pendekatan kualitatif, di mana penulis mengumpulkan data dari studi kasus, wawancara dengan pihak-pihak terkait, dan analisis terhadap peraturan yang berlaku. Fokus dari penelitian ini adalah untuk mengevaluasi efektivitas LBH dalam memberikan bantuan hukum kepada korban-apakah benar-benar melayani masyarakat atau hanya berfungsi sebagai lembaga formal. Temuan-temuan menunjukkan bahwa meskipun LBH memainkan peran penting dalam memberikan akses terhadap keadilan bagi korban, namun masih ada beberapa tantangan dalam pelaksanaannya, seperti keterbatasan sumber daya yang terbatas, kesadaran hukum masyarakat yang rendah, dan hambatan birokrasi. Oleh karena itu, Oleh karena itu, penguatan kapasitas LBH dan penerapan kebijakan yang lebih efektif yang lebih efektif diperlukan untuk memastikan bahwa lembaga ini dapat menjalankan perannya secara optimal.

Abstract

Law Number 17 of 2023 controls how medical services are given in Indonesia. It also explains how to solve medical disputes. These disputes often happen because of mistakes either on purpose or by accident by healthcare workers. Articles 305, 308, and 310 explain how to handle these cases. However, they are not clear and are hard to apply. There are no clear rules about panel decisions, case deadlines, or how to judge if a doctor was negligent. This study uses a legal research method based on laws and legal ideas. It uses primary, secondary, and supporting legal sources through library research and logical analysis. The study finds that the system for solving medical disputes in Indonesia is unclear. This is because of weak law enforcement, poor legal rules, and different ways of reading the law. This creates unfairness for patients, doctors, and health institutions. To solve this, Indonesia needs to build a special medical court. This is important and urgent. By learning from other countries and adjusting it to the local legal system, such a court can bring more fairness, clarity, and faster decisions. It can also improve public trust and make health services better and safer.

Abstract

Patient safety is an important thing in the handling of patients by medical personnel in carrying out treatment, it has a very important element so that the government has established various laws and regulations relating to health in Indonesia, one of which is regarding Patient Safety Targets (SKP) which are divided into points. -points regarding targets that must be carried out by medical personnel in carrying out actions in treating patients. The aim of this study is to find out and analyze the effectiveness of implementing Patient Safety Targets (SKP) regarding the accuracy of patient identification at the Klungkung Regional General Hospital as well as knowing and analyzing related facts -Inhibiting factors in implementing Patient Safety Targets (SKP) regarding accurate patient identification at the Klungkung Regional General Hospital. The research method used in this research is an empirical legal research method with data collection techniques, namely document study techniques and interview techniques. The results of the study show that the effectiveness of implementing Patient Safety Targets (SKP) regarding the accuracy of patient identification at the Klungkung Regional General Hospital has not been achieved optimally. This is due to several inhibiting factors, namely the first is that the room conditions are not conducive, the room situation is sometimes too busy, this causes medical officers to have to serve patients quickly, with the number of patients not being comparable to the number of officers, secondly there is an assumption regarding the accuracy of the patient's identity,  what is meant in this case is that medical officers are said to feel that they already know the patient's identity, because they have been treated or met. patient for a certain period of time or repeatedly in the same room so that this assumption arises. The third monitoring factor explained in its implementation is the absence of assessment/supervision of procedures for implementing accurate patient identification, so that officers are often negligent or do not get used to identifying patients correctly.
