Abstrac Liberalization of the air transport sector, is an effort to improve the connectivity and interactions between ASEAN Communities. For Indonesia, the Liberalization of the air transport policy through the ASEAN Open Sky mechanism means that the air traffic routes of the Republic of Indonesia is open to foreign airlines with the ASEAN member states flag. Through the Bali Concord II Declaration, the Liberalization of the air transport sector is formulating with the ultimate goal to forming ASEAN Single Aviation market. One of the agreement that was born due to the Liberalization of the air transport sector is ASEAN Multilateral Agreement on the Full Liberalisation of Passanger Air Service (ASEAN MAFLPAS). This agreement concerning to full Liberalization of Passanger air transport service through the freedom of the air. The government of Indonesia has ratified ASEAN Multilateral Agreement on the Full Liberalisation of Passanger Air Service through Presidential regulation No.12 of 2016. Based on the discussion of research data that has been carried out, that with the ratification one of the ASEAN Open Sky Agreement viz ASEAN Multilateral agreement on the Full Liberalization of Passanger Air Service (ASEAN MAFLPAS) by the government of Indonesia, does not mean the airspace Republic of Indonesia is open as a whole. Recall the regulation of law number 1 of 2009 on Aviation there is provision about the cabotage principle. Therefore, the freedom of the air is open until the fifth freedom of the air. On the one hand, liberalization of the air transport brings some benefit and on the other hand, brings disadvantage if the government of Indonesia does not monitor foreign airlines who carried the ASEAN member states flag passing through Indonesian airspace. The presence of liberalization enabled the implementation of the sixth freedom of the air is not limited. Certainly, this can be threaten the existence of domestic air transport company. Keywords : Liberalization, Freedom of the air, ASEAN MAFLPAS Abstrak Liberalisasi sektor jasa angkutan udara merupakan suatu usaha untuk meningkatkan konektivitas serta interaksi antar masyarakat di kawasan Asia Tenggara (ASEAN). Bagi Indonesia, kebijakan liberalisasi sektor jasa angkutan udara melalui mekanisme ASEAN Open Sky, memiliki makna semakin terbukanya wilayah lalu lintas udara Negara Republik Indonesia bagi maskapai asing berbendera ASEAN. Melalui deklarasi Bali Concord II, liberalisasi sektor jasa angkutan udara dirumuskan dengan tujuan akhir membentuk pasar tunggal transportasi udara ASEAN (ASEAN Single Aviation Market). Satu di antara perjanjian yang lahir akibat adanya liberalisasi sektor jasa angkutan udara adalah ASEAN Multilateral Agreement on the Full Liberalisation of Passanger air Service (ASEAN MAFLPAS). Perjanjian ini bertujuan untuk meliberalisasi penuh jasa angkutan udara penumpang melalui kebebasan di udara (freedom of the air). Indonesia telah meratifikasi ASEAN Multilateral Agreement on the Full Liberalisation of Passanger air Service (ASEAN MAFLPAS) melalui Peraturan Presiden No.12 tahun 2016. Berdasarkan pembahasan terhadap data penelitian yang telah dilakukan, bahwa dengan diratifikasinya satu diantara perjanjian ASEAN Open Sky yaitu ASEAN Multilateral Agreement on the Full Liberalisation of Passanger air Service (ASEAN MAFLPAS) oleh pemerintah Indonesia, hal ini tidak berarti wilayah udara Negara Republik Indonesia dibuka secara keseluruhan. Mengingat dalam Undang-Undang No.1 tahun 2009 tentang penerbangan, terdapat ketentuan mengenai Asas Cabotage. Oleh karena itu, kebebasan di udara yang dibuka hanya sampai dengan kebebasan di udara kelima (5th Freedom of the air). Liberalisasi disatu sisi membawa keuntungan dan disisi lain membawa kerugian apabila pemerintah tidak melakukan pengawasan secara ketat terhadap maskapai asing berbendera ASEAN yang lalu lalang di wilayah udara Indonesia. Hadirnya liberalisasi memungkinkan adanya pelaksanaan kebebasan di udara keenam (6th Freedom of the air) yang tidak terbatas. Tentunya hal ini bisa mengancam eksistensi perusahaan angkutan udara dalam negeri. Kata Kunci : Liberalisasi, Kebebasan di udara, ASEAN MAFLPAS
