Abstract

AbstractThe digital bank constitutes a banking revolution providing banking services accessible through electronic devices. It serves as a strategy to realize a cashless society and financial inclusivity in Indonesia. Over the course of several years in operation, numerous cases involving digital banks have emerged, particularly concerning malfunction of digital bank applications that result in financial losses for digital bank customers. The resolution of cases involving material losses for digital bank customers is complex, considering digital banks implement a limited physical office system. Therefore, it is imperative to examine the legal protection that safeguards digital bank customers and identify the inhibiting factors in realizing legal protection for digital bank customers. This research is normative research with a statute approach, concepts approach, and cases approach, focusing on examining secondary data consisting of primary, secondary, and tertiary legal materials. The data collection method involves document analysis and interviews, utilizing descriptive and qualitative legal analysis to address the issues in the research. The results of this research indicate that, normatively, banking regulations in Indonesia do not specifically govern the operational standards and procedures for resolving failed transactions within digital banking applications. As a result, customers who suffer losses do not receive prompt and adequate services. In the status quo, customers of digital banks in Pontianak City feel that their rights, security, and convenience in using digital banking are not guaranteed. The impediments to realizing legal protection for digital bank customers in Pontianak City include the absence of technical regulations regarding the standard operating procedures for resolving failed banking transactions through digital banks. Additionally, the low level of knowledge and understanding among the public regarding digital financial products/services further contributes to the lack of legal protection for digital bank customers.Keywords: legal protection; digital bank  AbstrakBank digital merupakan sebuah revolusi perbankan yang memberikan layanan perbankan secara digital yang dapat diakses melalui gadget. Bank digital merupakan strategi untuk mewujudkan cashless society dan keuangan inklusi di Indonesia. Selama beberapa tahun beroperasi, banyak kasus mengenai bank digital terkait dengan aplikasi bank digital yang mengalami malfungsi sehingga menimbulkan kerugian bagi nasabah bank digital. Penyelesaian kasus kerugian materiil nasabah bank digital juga tergolong rumit mengingat bank digital menerapkan sistem kantor fisik terbatas. Karenanya, perlu untuk dikaji perlindungan hukum yang melindungi para nasabah bank digital serta apa saja faktor penghambat terwujudnya perlindungan hukum bagi nasabah bank digital. Penelitian ini merupakan penelitian normatif dengan pendekatan perundang-undanganan, konsep, dan kasus yang fokus mengkaji data sekunder yang terdiri dari bahan hukum primer, sekunder dan tersier. Sedangkan, metode pengumpulan data dilakukan dengan studi dokumen dan wawancara, serta analisis bahan hukum secara deskriptif dan kualitatif guna menjawab permasalahan dalam penelitian. Hasil dari penelitian ini, ditemukan bahwa secara normatif peraturan perbankan di Indonesia belum mengatur secara spesifik mengenai standar operasional prosedur penyelesaian transaksi yang gagal dalam aplikasi bank digital, sehingga nasabah yang mengalami kerugian belum mendapatkan layanan yang cepat dan memadai. Kondisi di Kota Pontianak memperlihatkan bahwa nasabah bank digital di Kota Pontianak merasa hak, keamanan, dan kenyamanannya dalam menggunakan bank digital belum terjamin. Sementara faktor penghambat dalam mewujudkan perlindungan hukum terhadap nasabah bank digital di Kota Pontianak, selain belum adanya aturan teknis mengenai SOP penyelesaian transaksi perbankan yang gagal melalui bank digital, masih rendahnya pengetahuan dan pemahaman masyarakat mengenai produk/jasa keuangan digital yang digunakan turut mempengaruhi belum terjaminnya perlindungan hukum bagi nasabah bank digital.
