Abstract

Abstract  The company as the employer is responsible for workplace accidents or the company to address the loss of income due to the risk of death or disability. Workers' accident insurance for victims of workplace accidents is crucial because it is at that moment that workers need assistance that they may not be able to afford. Workers who experience workplace accidents can demand accountability from the company where they work. However, if the company neglects this responsibility, workers can file a lawsuit in the Industrial Relations Court at the District Court. This was seen in Decision Number 23/Pdt.Sus-PHI/2020/PN.Bjm filed with the Industrial Relations Court at the Banjarmasin District Court. Regarding Rina Ariana, S.H. as the Plaintiff filed a lawsuit against PT. Habco Primatama as the Defendant to pay Death Compensation and other rights.The problem statement of this research is "How do Judges Consider Compensation for Workers Due to Workplace Accidents based on Decision Number 23/Pdt.Sus-PHI/2020/PN.Bjm?" The purpose of this study is to analyze the legal considerations of the judge in the Industrial Relations Court decision number 23/Pdt.Sus-PHI/2020/PN.Bjm regarding compensation for workplace accidents and the legal consequences of that judge's decision. Based on the problem statement and research objectives, the author used the normative legal research method, so the research is based on a perspective of legal principles.The result of the legal analysis of the judge's considerations in Decision Number 23/Pdt.Sus-PHI/2020/PN.Bjm is that the judge ordered PT Habco Primatama to provide compensation to its workers who experienced a workplace accident in the form of Death Compensation amounting to Rp. 150,000,000,- in accordance with Government Regulation Number 7 of 2000 concerning Shipping. This is based on a death resulting from a workplace accident.  Keywords: Compensation for Workplace Accidents, Death Compensation, Workplace Accident, Judge's Legal Considerations, Judge's Decision      Abstrak  Perusahaan sebagai pemberi kerja bertanggungjawab atas kecelakaan di tempat kerja atau perusahaan untuk mengatasi hilangnya pendapatan yang karena resiko meninggal atau cacat. Jaminan kecelakaan kerja bagi penderita kecelakaan kerja sangatlah penting karena pada saat itulah pekerja membutuhkan pertolongan yang pembiayaan mungkin tidak akan terjangkau oleh yang bersangkutan. Pekerja yang mengalami kecelakaan kerja dapat meminta pertanggung jawaban perusahaan tempat bekerja. Namun jika perusahaan mengabaikan tanggung jawab tersebut, maka pekerja dapat mengajukan gugatan ke Pengadilan Hubungan Industrial pada Pengadilan Negeri. Seperti pada Putusan Nomor 23/Pdt.Sus-PHI/2020/PN.Bjm yang diajukan ke Pengadilan Hubunan Industrial pada Pengadila Negeri Banjarmasin. Perihal Rina Ariana, S.H. selaku Penggugat mengajukan gugatan terhadap PT. Habco Primatama selaku Tergugat untuk membayar Uang Santunan Kematian dan hak-hak lainya. Rumusan masalah dari penelitian ini adalah "Bagaimana Pertimbangan Hakim dalam Pemberian Ganti Rugi Kepada Pekerja Akibat Kecelakaan Kerja berdasarkan Putusan Nomor 23/Pdt.Sus-PHI/2020/PN.Bjm ?". Tujuan   dilakukannya ini untuk menganalisis pertimbangan hukum hakim pada putusan Pengadilan Hubungan Industrial nomor 23/Pdt.Sus-PHI/2020/PN.Bjm tentang pemberian ganti rugi terhadap kecelakaan kerja serta akibat hukum dari putusan hakim tersebut. Berdasarkan rumusan masalah dan tujuan penelitian, maka penulis menggunakan metode penelitian Hukum Normatif sehingga penelitian bersifat deskriftif analisis terhadap asas-asas hukum. Hasil dari penelitian analisis pertimbangan hukum hakim pada Putusan Nomor 23/Pdt.Sus-PHI/2020/PN.Bjm  adalah Hakim meminta PT Habco Primata memberikan ganti rugi kepada pekerjanya yang mengalami kecelakaan kerja berupa Santunan Kematian sebesar Rp. 150.000.000,- sesuai dengan Peraturan Pemerintah Nomor 7 Tahun 2000 Tentang Kepelautan. Hal ini didasari atas kematian yang terjadi diakibat kecelakaan kerja.Kata Kunci : Ganti Rugi Kecelakaan Kerja, Santunan Kematian, Kecelakaan Kerjaa, Pertimbangan Hukum Hakim, Putusan Hakim
