<![CDATA[Abstrac This research was conducted at the Land Office of Melawi Regency and in Tanjung Niaga Village, Nanga Pinoh District. This study aims to obtain information whether the people of Tanjung Niaga Village can implement the provisions that apply during the implementation of the Registration of Land Ownership Rights at the Land Office of Melawi Regency. This thesis discusses the existence of holders of land ownership rights in Tanjung Niaga Village who experience obstacles and difficulties when participating in the implementation of the registration of land ownership rights at the Land Office of Melawi Regency. The causes of the impediments to the implementation of the registration of land ownership rights include the lack of information regarding the normative and administrative requirements that must be completed when carrying out the registration of land ownership rights, as well as the existence of other additional costs beyond the provisions that have been recorded. The purpose of this study is to reveal the rights and obligations of each person applying for the issuance of a land certificate, the legal consequences for the land that has been registered, As for this research, it can be concluded based on the data obtained during the research that the Tanjung Niaga Village Community, Nanga District, can carry out the applicable provisions regarding the implementation of registration of land ownership rights at the ATR/BPN office, Melawi Regency, despite experiencing difficulties and obstacles. The obstacles to the implementation of the registration of land ownership rights by the people of Tanjung Niaga Village, Nanga Pinoh District, are due to convoluted administrative requirements, extortion, and late payment of the initial registration tax. As for the legal consequences of the community whose land has been registered, the community will receive the highest and absolute legal protection for the land they control. It was also revealed that the efforts made by the ATR/BPN Office of Melawi Regency in dealing with people who were hampered during the implementation of the registration of land ownership rights were conducting independent socialization again to the applicants. Abstrak Penelitian ini dilakukan di Kantor Pertanahan Kabupaten Melawi dan di Desa Tanjung Niaga Kecamatan Nanga Pinoh. Penelitian ini bertujuan Untuk mendapatkan informasi apakah masyarakat Desa Tanjung Niaga dapat melaksanakan ketentuan yang berlaku pada saat pelaksanaan Pendaftaran Hak Milik Atas Tanah di Kantor Pertanahan Kabupaten Melawi. Skripsi ini membahas tentang adanya pemegang hak milik atas tanah di Desa Tanjung Niaga yang mengalami hambatan serta kesulitan pada saat mengikuti pelaksanaan pendaftaran hak milik atas tanah di Kantor Pertanahan Kabupaten Melawi. Penyebab Penghambatnya pelaksanaan pendaftaran hak milik atas tanah antara lain adalah kurangnya informasi terkait syarat-syarat normatif maupun administratif yang harus dilengkapi pada saat melaksanakan pendaftaran hak milik atas tanah, serta adanya biaya tambahan lain di luar ketentuan yang telah dibukukan. Tujuan penelitian ini adalah untuk mengungkapkan hak dan kewajiban setiap orang yang mengajukan penerbitan sertifikat tanah, akibat hukum terhadap tanah yang telah terdaftar, dan mengungkapkan upaya apa saja yang dilakukan oleh kantor ATR/BPN dalam mengatasi kendala yang terjadi pada saat pelaksanaan pendaftaran hak milik atas tanah dengan menggunakan metode penelitian deskriptif yaitu suatu prosedur untuk memecahkan masalah dengan menggambarkan keadaan berdasarkan fakta yang ada sewaktu penelitian. Hasil penelitian yang dicapai pada saat penelitian bahwa Masyarakat Desa Tanjung Niaga Kecamatan Nanga dapat melaksanakan ketentuan yang berlaku terkait pelaksanaan pendaftaran hak milik atas tanah di kantor ATR/BPN Kabupaten Melawi meskipun mengalami kesulitan dan hambatan. Adapun Penghambat pelaksanaan pendaftaran hak milik atas tanah yang dilakukan masyarakat Desa Tanjung Niaga Kecamatan Nanga Pinoh adalah dikarenakan Persyaratan administratif yang berbelit-belit, adanya pungli, serta telat membayar pajak awal pendaftaran. Adapun akibat Hukum dari masyarakat yang tanahnya telah terdaftar masyarakat jadi mendapat perlindungan hukum tertinggi dan mutlak terhadap tanah yang mereka kuasai. Terungkap pula upaya yang dilakukan kantor ATR/BPN Kabupaten Melawi dalam menangani masyarakat yang terhambat pada saat pelaksanaan pendaftaran hak milik atas tanah adalah melakukan sosialisasi mandiri kembali kepada para pemohon. Kesimpulan dari penelitian ini adalah baiknya, pada saat melaksanakan pendaftaran hak milik atas tanah para pemegang hak mencermati lebih dalam mengenai persyaratan apa saja yang harus di bawah pada saat pendaftaran tanah, serta lebih teliti lagi dalam mempersiapkan persyaratan normatif yang harus dipenuhi di dalam pendaftaran hak milik atas tanah.Kata Kunci : Sertifikat tanah, Hak Milik Atas tanah, Pendaftaran tanah.]]>
