<![CDATA[Humans are social creatures who in society will sometimes experience conflict. To resolve the conflict, one of the ways is through the court. In order for the judicial process to run well, the court must follow the applicable procedural law. One of the principles in the applicable procedural law in Indonesia is the principle of Nebis in Idem. Therefore, the author wants to see the application of the principle of nebis in Idem in Indonesian courts through a study of a dispute involving the heirs of Mr. Felix Michael Murep against the heirs of Mr. Gunawan Tjandra. Through Civil Case Decision No. 22/Pdt.G/2022/Pn Ptk. Based on the research question, which is "How is the Judge's Legal Consideration in the Application of the Nebis in idem Principle in Civil Case Decision Number 22/Pdt.G/2022/Pn Ptk?". then the purpose of this study is to analyze the legal considerations used by the judge and what legal consequences are caused by the judge's decision. And to get sufficiently accurate data, the author uses normative juridical research methods by looking at the legal theories of experts and the laws related to this case. The research results obtained are that the principle of nebis in idem is very useful in the trial process because this will make the performance of the panel of judges more efficient. In addition, the decision to make a case nebis in idem is very qualified with the value of legal justice, legal certainty, and legal benefits. And with the judge's legal decision will strengthen all legal actions that have been carried out in this case is a letter of agreement. Keywords : legal Theory, Nebis in idem, judge's decision Abstrak Manusia adalah makhluk sosial yang dalam bermasyarakat terkadang akan mengalami konflik. Untuk menyelesaikan konflik itu salah satu jalannya adalah melalui pengadilan. Agar proses peradilan itu berjalan dengan baik maka dari itu pegadilan harus mengikuti hukum acara yang berlaku. Salah satu asas yang ada didalam hukum acara yang berlaku di Indonesia adalah asas Nebis in Idem. Maka dari itu penulis ingin melihat penerapan asas nebis in Idem dalam pengadilan Indonesia melalui kajian Sengketa yang melibatkan ahli waris bapak Felix Michael Murep Melawan ahli waris Bapak Gunawan Tjandra. Melalui Putusan Perkara Perdata No 22/Pdt.G/2022/Pn Ptk. Berdasarkan rumusan masalah yakni :"Bagaimana Pertimbangan Hukum Hakim Penerapan Hukum Hakim Dalam Penerapan Asas Nebis in idem Dalam Putusan Perkara Perdata Nomor 22/Pdt.G/2022/Pn Ptk ?". maka tujuan dari penelitian ini adalah untuk menganalisis pertimbangan hukum yang digunakan hakim serta apa akibat hukum yang ditimbulkan akibat putusan hakim tersebut. Dan untuk mendapatkan data yang cukup akurat penulis menggunakan metode penelitian yuridis normatif dengan melihat teori hukum para ahli dan hukum-hukum yang terkait dengan kasus ini. Adapun hasil penelitian yang didapatkan ialah bahwa asas nebis in idem sangatlah berguna di dalam proses persidangan karena ini akan membuat kinerja majelis hakim menjadi lebih efisien. Selain itu keputusan untuk membuat suatu perkara menjadi nebis in idem sangat syarat dengan nilai keadilan hukum, kepastian hukum, serta kemanfaat hukum.
