AbstracThe research was conducted against the background of the Confiscation of Beny Tjockrosaputro's assets in the case of using ASABRI Funds in 2021, which was sentenced to a criminal sentence, resulting in the confiscation of assets, one ofwhich was land in Sungai Burung village, Segedong district, Mempawah district. Adat which began in 1992, because this research is aimed at seeking legal certainty for communities who have customary land owned by customary owners related to the confiscation of assets by the state, so this research is given the theme "Legal Position of Customary Ownership Rights Holders Given Building Use Rights Above State land (a study in Sungai Burung Village, Segedong District, Mempawah Regency) was studied using normative research methods by looking at aspects of laws and regulations.In the research, the results were obtained, where until now the holders of landrights that were formerly owned by adat had not received legal certainty, where on the land there were building use rights that had expired but were confiscated by thestate. Abstrak Penelitian di lakukan dengan latar belakang Penyitaan Aset Beny Tjockrosaputro dalam Kasus penggunaan Dana ASABRI tahun 2021, yang telah divonis Pidana, mengakibatkan Penyitaan Aset salah satunya Lahan di desa Sungai Burung Keecamatan Segedong Kabupaten Mempawah, Persoalan tersebut sebeleumnya terjadi sengketa dengan masyarakat selaku pemegang Tanah bekas milik Adat yang dimulai tahun 1992, oleh karena penelitian ini ditujukan untuk mencari kepastian Hukum bagi Masyarakat yang mempunyai Tanah Milik Bekas Milik adat terkait dengan penyitaan Aset oleh Negara, sehingga penelitian ini diberikan tema “Kedudukan Hukum Pemegang Hak Milik Adat Yang Diberikan Hak Guna Bangunan Di Aatas Tanah Negara (studi Di Desa Sungai Burung Kecamatan Segedong Kabupaten Mempawah) di penelitian dengan menggunakan metode penelitian Normatif dengan melihat aspek peraturan perundang- undangan.Dalam penelitian didapatkan hasil, dimana sampai saat ini pemegang Hak Atas Tanah bekas milik Adat belum mendapatkan kepastian Hukum, dimana diatas tanah tersebut terdapat Hak Guna bangunan yang telah selesai masa berlakunya akan tetapi dalam penyitaan Negara.
