Abstract

AbstractThe employment relationship between workers/laborers and the company is marked by a work agreement signed by both parties. The work agreement contains rights and obligations that must be fulfilled by both parties. In order to protect workers' rights, Indonesian law specifically regulates employment in the Omnibus Law, and compliance with Termination of Employment Relations in Law Number 6 of 2023 concerning Job Creation. This research aims to find out whether the judge's legal considerations were correct in deciding cases of unilateral termination of employment relations against workers and the legal consequences of unilateral termination of employment relations by employers against their workers in Decision Number 5/Pdt. Sus-PHI/2023PN.PTKThis research was carried out using a normative juridical approach, namely research carried out using an approach through literature study and legal sources. The research technique was carried out using a literature study of the judge's decision, applicable law, and related library materials, then the research results were described in detail in sentence form in Decision Number 5/Pdt.Sus-PHI/2023PN.PTK.Dispute resolution is resolved through bipartite institutions, mediation, conciliation or arbitration. With their status as contract workers, in the event of termination of their employment relationship they must still refer to the applicable statutory provisions in the case of the Job Creation Law on Employment. Government Regulation No. 35 of 2021 Because the termination of employment was carried out in deviation from applicable legal procedures and in other parts the termination of employment was not due to violations or mistakes committed by the Plaintiff as per legal considerations. The Panel of Judges sentenced the Defendant to pay compensation for Termination of Employment to The plaintiff took the form of severance pay, paid compensation for leave rights, cash compensation. The results of this research explain the need for a legal reasoning judge's basis for legal certainty regarding the legal status and legality of employment relations between workers or laborers on behalf of Yanuar Irsan Sumara and. The legal implications that arise as a result of the judge's decision are the process of layoffs and layoff compensation, where the layoff compensation given to workers is appropriate and in accordance with the law.Keywords: Court decision, company, employment relationship, termination of employment relationship (PHK).  AbstrakHubungan kerja anatara pekerja/buruh dengan perusahaan di tandai dengan ditandatangani perjanjian kerja yang ditandatangani oleh kedua belah pihak,perjanjian   kerja berisi hak dan kewajiban yang harus dipenuhi oleh kedua belah pihak. Demi melindungi hak-hak pekerja, hukum di Indonesia mengatur secara khusus mengenai ketenagakerjaan di dalam Omnibus Law, dan pemenuhan terkait Pemutus Hubungan Kerja dalam Undang-Undang Nomor 6 Tahun 2023 tentang Cipta Kerja. Penelitian ini bertujuan untuk mengetahui sudah tepatkah pertimbangan hukum hakim dalam memutuskan kasus pemutusan hubungan kerja sepihak terhadap pekerjanya dan akibat hukum pemutusan hubungan kerja secara sepihak oleh pengusaha terhadap pekerjanya pada Putusan Nomor 5/Pdt. Sus-PHI/2023PN.PTKPenelitian ini dilakukan dengan pendekatan yuridis normatif, yaitu penelitian yang dilakukan dengan pendekatan melalui studi kepustakaan dan sumber hukum. Teknik penelitian yang dilakukan dengan studi kepustakaan atas putusan hakim, hukum yang berlaku, dan bahan pustaka terkait selanjutnya hasil penelitian secara rinci dideskripsikan dalam bentuk kalimat pada Putusan Nomor 5/Pdt.Sus- PHI/2023PN.PTK.Penyelesaian perselisihan diselesaikan melalui lembaga bipartit, mediasi, konsiliasi atau arbitrase, Dengan statusnya sebagai pekerja kontrak maka dalam hal terjadi pemutusan hubungan kerja haruslah tetap mengacu pada ketentuan perundang undangan yang berlaku in casu Undang-Undang cipta kerja tentang Ketenagakerjaan. Peraturan Pemerintah No 35 Tahun 2021 Oleh karena pemutusan hubungan kerja dilakukan menyimpang dari prosedur hukum yang berlaku dan pada bagian lain pemutusan hubungan kerja tersebut bukan atas pelanggaran atau kesalahan yang dilakukan oleh Penggugat sebagaimana pertimbangan hukum.Majelis Hakim menghukum Tergugat untuk membayar kompensasi Pemutusan Hubungan Kerja kepada Penggugat berupa uang pesangon, membayar uang penggantian hak cuti,ganti rugi secara tunai. Hasil penelitian ini menjelaskan perlu adanya dasar pertimbangan hakim legal reasoning terhadap kepastian hukum atas status hukum dan legalitas hubungan kerja antara pekerja atau buruh atas nama Yanuar Irsan Sumara dengan. Implikasi hukum yang timbul akibat putusan hakim yaitu proses PHK dan kompensasi PHK, dimana kompensasi PHK yang diberikan kepada pekerja buruh telah tepat dan sesuai dengan undang-undang.KATA KUNCI: Putusan Pengadilan, Perusahaan, Hubungan Kerja, Pemutusan Hubungan Kerja (PHK)
