Abstract

Abstract The National Development Planning System (SPPN) is currently being discussed by the People's Consultative Assembly (MPR) not to be continued and to be replaced with the Principles of State Policy (PPHN). Currently, the mechanism to be used in PPHN is still being debated, one of which is the idea of using the Directive Principle State and Social Policy (DPSP) method which is being implemented in Brazil. This research uses normative juridical methods with legislative, comparative and historical approaches. The results of this research provide two conclusions. First, development planning using mechanisms such as GBHN or SPPN cannot be used as a mechanism in PPHN. Second, the Brazilian model of DPSP is very suitable to be applied in Indonesia because of 2 (two) things, firstly the 1945 Constitution of the Republic of Indonesia which adopts socialism and constitutionalism; second, the adoption of a 3 (three) chamber parliamentary model (tricameral system).   Abstrak Sistem Perencanaan Pembangunan Nasional (SPPN) saat ini tengah diwacanakan Majelis Permusyawaratan Rakyat (MPR) untuk tidak dilanjutkan dan akan digantikan dengan Pokok-pokok Haluan Negara (PPHN). Saat ini, mekanisme yang akan dipakai dalam PPHN masih menjadi perdebatan, salah satunya adalah gagasan untuk menggunakan metode Directive Principle State and Social Policy (DPSP) yang diimplementasikan di Brasil. Penelitian ini menggunakan metode yuridis normative dengan pendekatan peraturan perundang-undangan, komparatif, dan historis. Hasil dari penelitian ini memberikan dua kesimpulan. Pertama, perencanaan pembangunan dengan mekanisme seperti GBHN maupun SPPN tidak dapat dijadikan sebagai mekanisme dalam PPHN. Kedua, DPSP model Brasil sangatlah cocok diterpakan di Indonesia dikarenakan 2 (dua) hal, pertama konstitusi UUD NRI 1945 yang mengadopsi paham sosialisme dan konstitusionalisme; kedua, dianutnya model parleme 3 (tiga) kamar (sistem tricameral).

Abstract

Climate change has emerged as a serious threat to both humanity and the global ecosystem, necessitating a coordinated global response. The Paris Agreement embodies these efforts by emphasizing the principle of Common but Differentiated Responsibilities and Respective Capabilities (CBDR-RC), which underscores the awareness of shared responsibility with varying capacities among nations. This principle is reflected in the Nationally Determined Contributions (NDCs), serving as tangible manifestations of each country's commitment. This research addresses two main issues: Firstly, why is the CBDR-RC principle the foundation for implementing NDCs in Indonesia? Secondly, to what extent does the implementation of NDCs in Indonesia align with the CBDR-RC principle and Indonesia's commitments in the Paris Agreement to achieve sustainable development and address climate change? This study the study utilizes legislative, comparative, conceptual, and historical methodologies. Findings reveal that the CBDR-RC principle forms the basis of NDC implementation in Indonesia, grounded in Indonesia's membership status in the Paris Agreement. However, practical execution falls short, revealing a disparity between idealism and reality in realizing commitments and ambitions to address climate change.
