Haryono No. 169 Malang e-mail: cocooo15@student.ub.ac.id Abstrak Penelitian ini bertujuan untuk mengetahui efektivitas Pasal 27 Ayat (2) Peraturan Pemerintah Nomor 11 Tahun 2021 Tentang Badan Usaha Milik Desa terkait tugas pelaksana operasional BUM Desa, dimana dalam praktiknya Pelaksana Operasional sebagai direksi mengabaikan tanggung jawab dalam mengelola BUM Desa. Berangkat dari permsalahan tersebut, penelitian ini mengkaji: (1) efektivitas Pasal 27 ayat (2) Peraturan Pemerintah Republik Indonesia Nomor 11 Tahun 2021 Tentang Badan Usaha Milik Desa terhadap tugas Pelaksana Operasional Badan Usaha Milik Desa di BUM Desa KM Desa S, (2) kendala - kendala terhadap tugas Pelaksana Operasional di BUM Desa KM Desa S berdasarkan Pasal 27 ayat (2) Peraturan Pemerintah Republik Indonesia Nomor 11 Tahun 2021 Tentang Badan Usaha Milik Desa, (3) upaya BUM Desa KM dalam mengatasi kendala-kendala terhadap tugas Pelaksana Operasional Badan Usaha Milik Desa di BUM Desa KM Desa S dalam penerapan Pasal 27 ayat (2) Peraturan Pemerintah Republik Indonesia Nomor 11 Tahun 2021 Tentang Badan Usaha Milik Desa. Data primer dan data sekunder dengan menggunakan teknik analisa deskriptif kualitatis, karena di sini penulis mengumpulkan data, mereduksi data, menganalisis data, serta memverifikasi untuk menarik kesimpulan dari penelitian yang telah dilakukan. Hasil Penelitian menunjukan bahwa Pasal 27 Ayat (2) Peraturan Pemerintah Nomor 11 Tahun 2021 Tentang Badan Usaha Milik Desa belum berjalan secara efektiv dikarenakan tidak berjalannya substansi hukum, struktur hukum, dan budaya masyarakat berdasarkan teori Efektivitas Hukum Lawrence M. Friedman. Namun, penulis telah menyampaikan beberapa Upaya yang dapat dilakukan BUM Desa dalam mengatasi kendala tersebut. Kata Kunci: badan usaha milik desa, pelaksana operasional, tugas pelaksana operasional Abstract This research aims to study the effectiveness of Article 27 Paragraph (2) of Government Regulation Number 11 of 2021 concerning Village-Owned Enterprises in the case of neglecting the responsibility to operate the enterprises. Departing from this issue, this research aims to investigate: (1) the effectiveness of Article 27 paragraph (2) of the Government Regulation of the Republic of Indonesia Number 11 of 2021 concerning Village-Owned Enterprises regarding the operation of the enterprises of KM in village S, (2) the impeding factors of the operation of the enterprises in village S according to Article 27 paragraph (2) of the Government Regulation Number 11 of 2021 concerning Village-Owned Enterprises, and (3) the measures taken by the enterprises in the village to deal with the obstacles of the operation of the enterprises according to the Government Regulation Number 11 of 2021. Primary and secondary data were analyzed using qualitative-descriptive methods by garnering, reducing, analyzing, and verifying data to draw a conclusion. The research results show that Article 27 Paragraph (2) of Government Regulation Number 11 of 2021 has not been effectively implemented due to improper implementation of the legal substance, structure, and culture of the people related to the theory of legal effectiveness introduced by Lawrence M. Friedman. Some measures are also recommended for the village-owned enterprises to consider to tackle the issues. Keywords: operation, operational implementing tasks, village-owned enterprises]]>
