Abstract

Haryono No. 169 Malang e-mail: ghinakhansa@student.ub.ac.id Abstrak Keberadaan Otoritas Jasa Keuangan (OJK) sebagai lembaga pengawas sektor keuangan di Indonesia perlu untuk diperhatikan salah satunya di bidang asuransi. Sebagai upaya memberikan perlindungan bagi konsumen sektor jasa keuangan, OJK mengesahkan Peraturan Otoritas Jasa Keuangan Nomor 6/POJK.07/2022 tentang Perlindungan Konsumen dan Masyarakat di Sektor Jasa Keuangan. Pada bagian kesepuluh tentang penilaian sendiri, bahwa PUJK wajib melakukan penilaian sendiri terhadap pemenuhan ketentuan Perlindungan Konsumen dan Masyarakat. Namun, tidak ada pengaturan dalam POJK tersebut yang mengatur sanksi atas tindakan Fraud terhadap laporan penilaian sendiri. Berdasarkan hal tersebut mengangkat rumusan masalah: (1) Bagaimana akibat hukum atas Fraud terhadap laporan penilaian sendiri (self assessment) oleh perusahaan perasuransian berdasarkan POJK No.6 Tahun 2022 Tentang Perlindungan Konsumen Dan Masyarakat Di Sektor Jasa Keuangan? (2) Apakah urgensi pengaturan sanksi atas Fraud terhadap laporan penilaian sendiri (self assessment) oleh perusahaan perasuransian berdasarkan POJK No.6 Tahun 2022 Tentang Perlindungan Konsumen Dan Masyarakat Di Sektor Jasa Keuangan. Penulis menggunakan jenis penelitian yuridis normatif dengan metode pendekatan perundang-undangan dan pendekatan konseptual. Dari analisis tersebut, tidak ada pengaturan terkait sanksi atas Fraud terhadap Laporan Penilaian Sendiri yang diwajibkan oleh OJK bagi perusahaan perasuransian. Tindakan fraud termasuk Perbuatan Melawan Hukum berdasarkan Pasal 1365 KUHPerdata karena tidak terpenuhinya hak konsumen untuk mendapatkan informasi yang benar. Perusahaan perasuransian wajib memberikan kompensasi, ganti rugi dan penggantian kepada Pemegang Polis selaku konsumen apabila dapat dibuktikan terjadi kerugian yang diakibatkan oleh fraud atas Laporan Penilaian Sendiri tersebut. Perlu adanya pengaturan lebih lanjut untuk mengatasi kekosongan hukum atas tindakan fraud terhadap Laporan Penilaian Sendiri untuk memberikan perlindungan terhadap konsumen. Kata Kunci: Fraud, Penilaian Sendiri, Perusahaan Asuransi Abstract The existence of the Financial Services Authority (henceforth referred to as OJK) as a supervisory agency in the financial sector in Indonesia is essential, particularly in insurance. To protect consumers in financial services, the OJK passed the Regulation of OJK Number 6/POJK.07/2022 concerning the Protection of Consumers and the Public in the Financial Services Sector. Point 10 concerning Self-Assessment implies that PUJK must perform self-assessment in the fulfilment of the provision of consumer and public needs. However, there is no regulatory provision in POJK governing sanctions in the case of fraud in self-assessment. Departing from this issue, this research aims to investigate: (1) the legal consequence of fraud in self-assessment by an insurance company according to POJK Number 6 of 2022 concerning Consumer and Public Protection in the Financial Services Sector and (2) the urgency of the regulation concerning the sanctions in the case of fraud in self-assessment by an insurance company according to POJK Number 6 of 2022. This research employed a normative-juridical method and statutory and conceptual approaches. The analysis reveals that there is no regulation concerning sanctions in the case of fraud in self-assessment reports as required by the OJK for insurance companies. Fraud is considered a tort according to Article 1365 of the Civil Code since consumers’ rights to get proper information are not fulfilled. When this is the case, an insurance company has to provide compensation or redress to policyholders as consumers only when loss due to fraud in self-assessment reports can be proven. Further regulations are necessary to fill the legal loopholes regarding fraud in self-assessment reports for the sake of consumer protection. Keywords: Fraud, Insurance Company, Self-Assessment

Abstract

This research focuses on analyzing specifically whether the regulation of different religions after the issuance of SEMA Number 2 of 2023 has fulfilled legal certainty. Marriage is not only an agreement between two individuals, but also a form of worship recognized by society and the state. Therefore, the rules for the implementation of marriage have been regulated by the state in Law Number 1 of 1974 concerning Marriage. However, it will cause problems if the marriage recorded in the civil registry is actually categorized as an invalid marriage, one of which is a marriage of different religions. In contrast to the explanation in Article 35 of the Civil Registration Law that the registration of valid marriages, including marriages between people of different religions that have been determined by the Court, is an obligation. With the disharmony between the two laws, it can affect judges in adjudicating cases of applications for registration of marriages between people of different religions and beliefs. To answer the existing problems, the author uses normative juridical research with a statutory approach method (statue approach), conceptual approach (conceptual approach). Primary, secondary, and tertiary legal materials and using grammatical and systematic interpretation. The issuance of SEMA Number 2 Year 2023 is a legal instrument issued by the Supreme Court. This SEMA is expected to create a more structured and reliable judicial system. It is important to evaluate the consistency and harmony in the application of laws related to interfaith marriage after the issuance of the SEMA.
