Abstract

Law No. 13 of 2012 on the Special Status of Yogyakarta grants special authority to the Special Region of Yogyakarta (DIY), including in land management by the Sultanate of Ngayogyakarta Hadiningrat and the Kadipaten Puro Pakualaman. The history of land ownership by the Sultanate and the Kadipaten, recognized since the colonial era through the Rijksblad of the Sultanate No. 16 of 1918 and the Rijksblad of Pakualaman No. 18 of 1918, demonstrates a clash between national agrarian law and DIY’s traditional laws. This legal dualism creates conflicts and legal uncertainties related to land ownership in Yogyakarta.This paper explores the legal dialectic in the management of Sultan Ground in Yogyakarta, analyzing the legal pluralism resulting from the layered authority system between the central and regional governments, as well as the politics of traditionalism post-reformation. The ongoing political and agrarian law changes reflect efforts to balance local and national interests in land management, particularly in special regions like Yogyakarta

Abstract

This article aims to analyze the government's legal intervention in the management of cassava as an agricultural commodity in East Lampung Regency through a normative juridical approach. The background of this study stems from the weak bargaining position of farmers in the cassava value chain and the lack of effective legal protection at the regional level. This research applies normative legal methods by examining statutory regulations, legal doctrines, and relevant academic literature. The findings indicate that although the legal basis for state intervention is sufficiently established at the national level, its implementation remains ineffective due to the absence of clear operational norms, disharmony between central and regional regulations, and the lack of legal enforcement mechanisms to control exploitative market practices. The implications highlight the urgent need for a regional regulation that specifically governs cassava trade systems, including price floor policies, legal empowerment of farmer cooperatives, and strengthened legal oversight through administrative law instruments. A law-based government intervention is necessary to ensure economic justice distribution and meaningful protection for vulnerable groups in the agricultural sector.

Abstract

International trade is a cross-border buying and selling transaction, which involves two parties and crosses state boundaries. Dumping is a system of selling goods on foreign markets in large quantities at very low prices with the aim that domestic purchase prices are not lowered so that they can eventually dominate foreign markets and regain control of prices. From the above background, the problem in this research is the role of the WTO (World Trade Organization) to limit dumping practices. Answering these problems the researchers used a normative juridical approach. Normative juridical approach is an approach that is based on the main legal material by examining theories, concepts, legal principles and laws and regulations related to this research. The results of the study show that in GATT it is clear that the position of dumping is an act of unfair trade (unfair trade practice) because it violates the principles of MFN. This is why he considers dumping as Unfair Trade Practice in GATT. Then the anti-dumping regulation in Article VI of the GATT is intended as a policy to overcome dumping. The WTO in this position is as a forum for dispute resolution and provides a conciliation mechanism to resolve trade disputes that arise. So that the position of the WTO is as a facilitator in preventing dumping disputes.

Abstract

Perlindungan terhadap anak pada suatu masyarakat bangsa merupakan tolak ukur peradaban bangsa tersebut, karenanya wajib diusahakan sesuai dengan kemampuan nusa dan bangsa. Kegiatan perlindungan anak merupakan suatu tindakan hukum yang berakibat perlu adanya penjaminan hukum bagi anak. Kepastian hukum perlu diusahakan demi kegiatan kelangsungan perlindungan anak dan mencegah penyelewengan yang membawa akibat negatif yang tidak diinginkan dalam pelaksanaan kegiatan perlindungan anak. Kegiatan perlindungan anak setidaknya memiliki dua aspek, yang pertama berkaitan dengan kebijakan dan peraturan perundang-undangan yang mengatur mengenai perlindungan hak-hak anak dan aspek kedua menyangkut pelaksanaan kebijakan dan peraturan-peraturan tersebut. Penelitian ini menggunakan pendekatan yuridis empiris. Pendekatan yuridis empiris adalah dengan melakukan penelitian di lapangan yaitu dengan melihat fakta-fakta yang ada dalam Implementasi PP No 65 Tahun 2016 tentang Pedoman pelaksanaan Diversi dan Penanganan Anak Yang belum Berumur 12 Tahun. Namun demikian penulis juga tetap menggunakan pendekatan yuridis normatif yaitu pendekatan yang didasarkan pada peraturan perundangundangan, teori-teori dan konsep-konsep yang berhubungan dengan penelitian ini. Penanganan perkara pidana terhadap anak tentunya beda dengan penanganan perkara terhadap usia dewasa, penanganan terhadap anak tersebut bersifat khusus karena itu diatur pula dalam peraturan tersendiri. Pemahaman terhadap proses penanganan perkara anak tentunya mungkin masih ada sebahagian kalangan masyarakat yang belum mengerti atau paham, sehingga kadang-kadang memunculkan penilaian bermacammacam, malah yang lebih fatal bilamana terjadi salah penilaian bahwa penanganan terhadap anak khususnya anak yang berkonflik hukum mendapatkan perlakuan istimewa dan ada juga yang menganggap anak tidak bisa dihukum padahal tidak sejauh itu, hanya saja proses penanganannya diatur secara khusus. Bahwa dengan lahirnya Peraturan Pemerintah No. 65 Tahun 2015 tentang Pedoman Pelaksanaan Diversi dan Penanganan Anak Yang Belum Berumur 12 Tahundapat menjadi komitmen semua aparat penegak Fakultas Hukum Universitas Gresik 122 hukum dan masyarakat dalam meningkatkan kualitas dan jaminan masa depan Anak Indonesia. Peraturan ini mempunyai semangat menanamkan tanggung jawab anak, nilainilai perdamaian kepada anak sejak dini, mengajak masyakat untuk ikut bertanggung jawab bila terjadi kekerasan kepada anak dilingkungannya, menghindarkan anak dari perampasan kemerdekaan dan mengajak semua pihak bisa menyelesaikan perkara anak di luar peradilan.
