Abstract

Hadirnya Perppu No. 1 tahun 2020 memberikan legitimasi bagi pemerintah untuk dapat mengambil Langkah kebijakan secara cepat untuk menyelamatkan keuangan negara akibat wabah covid 19, akan tetapi setelah terbitnya Perppu covid, banyak reaksi pro kontra muncul dari pengamat ekonomi, politik, hukum dan berbagai lapisan masyarakat umum. Pihak yang pro mendukung langkah Perppu covid menjadi legitimasi yang kuat bagi pemerintah untuk memulihkan instabilitas ekonomi nasional.  Di sisi lain, Pihak yang kontra mengecam Perppu khususnya pasal 27 yang seolah memberikan imunitas terhadap Komite Stabilitas Sistem Keuangan (KSSK), sehingga DPR menyerukan kritik,  tetapi anehnya DPR justru menyetujui Perppu Covid menjadi Undang undang undang dalam sidang paripurna, hingga akhirnya Perppu Covid di gugat ke Mahkamah Konstitusi.. Penelitian ini bertujuan untuk mengetahui Bagaimana pengaturan terkait hak budgeting DPR selama pandemi Covid-19 sesuai dengan Perppu Covid-19 serta Bagaimana kewenangan yudisial Lembaga yudikatif berhadapan dengan pasal 27 perpu covid dalam mengadili kasus yang berkenaan dengan penyimpangan kerugian negara dari pengeluaran dana covid-19. Penelitian ini merupakan penelitian yuridis normatif dengan studi hukum terhadap data data sekunder. Hasil dari penelitian ini adalah Pasal 28 Perppu No. 1/2020 yang meniadakan keterlibatan DPR dalam pembuatan APBN serta Substansi dari Pasal 27 Perppu No. 1/2020 yang menjadikan sejumlah pengawasan konstitusional yang dilakukan DPR maupun kewenangan lembaga yudisial dalam menyidangkan perkara terkait penyimpangan yang mungkin dilakukan oleh pejabat publik dalam penanggulangan Covid-19 menjadi hilang

Abstract

The rapid development of information technology has significantly transformed criminal procedure law, particularly regarding the recognition and use of electronic evidence. In corruption cases, electronic evidence has become a central instrument in uncovering modus operandi, tracing financial flows, and proving the involvement of perpetrators. This study aims to analyze the juridical status, practical application, and challenges of using electronic evidence in proving corruption cases in Indonesia. The research employs normative legal methods with statutory and case approaches, relying on secondary data such as legislation, legal literature, and relevant court decisions. The findings indicate that electronic evidence has obtained normative legitimacy through the Electronic Information and Transactions Law, the Anti-Corruption Law, and progressive judicial decisions. In practice, electronic evidence plays a decisive role in major corruption cases, although its implementation faces challenges related to authenticity, integrity, limited technical capacity of law enforcement officers, and regulatory disharmony. In conclusion, electronic evidence strengthens the evidentiary system in corruption cases, but legal harmonization, forensic technical standards, and capacity-building for law enforcement are required to ensure effectiveness and legal certainty.

Abstract

The growing trade of second hand smartphones through digital platforms has inadvertently enabled the circulation of stolen goods, particularly from theft. Many buyers unknowingly purchase these items and risk prosecution under Article 480 of the Indonesian Criminal Code on fencing. This creates a legal imbalance, especially in proving the element of intent (mens rea) in buyers acting in good faith. This study examines the effectiveness of applying restorative justice to buyers of stolen phones who lack criminal intent, based on Indonesian Prosecutorial Regulation No. 15 of 2020. Using a normative legal approach, the research analyzes laws, legal theories, and restorative justice principles. Findings indicate that restorative justice can offer a more humane and fair alternative to conventional prosecution, provided certain conditions are met such as the absence of a criminal record, a peaceful agreement between parties, and restitution to the victim. However, its practical application remains limited due to structural challenges and a lack of awareness among law enforcement and the public. Therefore, a more inclusive legal policy is needed to extend restorative justice to third parties who are not directly involved in crimes but are legally affected under the current system.

Abstract

The supremacy of the constitution is a fundamental principle of the rule of law, positioning the constitution as the highest legal norm within the constitutional system. However, in contemporary Indonesian constitutional practice, this principle faces significant challenges due to the dynamics of legal politics. This study aims to critically analyze the erosion of constitutional supremacy in Indonesia as a state governed by law and to examine contemporary legal-political practices that contribute to the weakening of the constitution’s authority. This research employs a normative juridical method with statutory, conceptual, and case approaches. Legal materials were collected through library research, including primary, secondary, and tertiary sources, and analyzed using qualitative descriptive analysis. The findings indicate that the erosion of constitutional supremacy results from the dominance of political interests in law-making processes, weak compliance with Constitutional Court decisions, and the instrumentalization of law within political practices. These conditions undermine the function of the constitution as a limitation on state power and as a safeguard for citizens’ constitutional rights. This study concludes that strengthening constitutional supremacy requires a legal-political orientation grounded in constitutionalism, consistent adherence to Constitutional Court decisions, and the development of a strong constitutional culture among state institutions.

Abstract

Domestic violence remains a critical issue in Indonesia despite comprehensive legal frameworks established through Law Number 23 of 2004 on the Elimination of Domestic Violence. This study examines the legal protection afforded to victims of domestic violence from a victimological perspective, with a focus on Decision Number 661/Pid.Sus/2023/PN Smn. The research employs a normative legal approach, utilizing statutory analysis and case study methodology to evaluate the implementation of victim protection principles in judicial practice. Primary legal materials include relevant legislation and the court decision, analyzed through descriptive qualitative methods within a victimological framework. The findings reveal significant gaps between normative standards and practical implementation. While the legal framework comprehensively regulates victim rights including protection, restitution, and recovery, the examined court decision demonstrates fundamental deficiencies: absence of restitution orders, lack of protection orders to prevent repeat victimization, imposition of a suspended sentence that inadequately deters recidivism, and insufficient consideration of victims' psychological and economic vulnerabilities. The decision prioritizes the perpetrator's interests over victim protection, neglecting structural inequalities and power imbalances inherent in domestic violence cases. This study concludes that judicial practice requires substantial reform to fully integrate victimological principles, ensuring victims receive comprehensive protection, justice, and recovery while preventing secondary victimization.
