Abstract

Jurnal ini mengeksplorasi signifikansi karbon biru di Indonesia untuk mencapainetralitas karbon dan mengurangi perubahan iklim. Karbon biru merujuk padakarbon yang disimpan di ekosistem laut dan pesisir seperti hutan bakau, rawaasin, dan padang lamun. Esai membahas pentingnya karbon biru dalam sikluskarbon global dan kebutuhan mendesak untuk pengelolaan dan restorasihabitat karbon biru yang efisien di Indonesia. Ini juga mengeksplorasi sejarahdan status saat ini dari penelitian karbon biru, penyebutan karbon biru dalamkontribusi yang ditentukan secara nasional (NDC) yang diserahkan olehsetiap negara kepada Konvensi Kerangka Kerja Perserikatan Bangsa-Bangsatentang Perubahan Iklim (UNFCCC), dan strategi untuk mencapai netralitaskarbon pada tahun 2050

Abstract

The dispute over ownership of land rights between PT Sentul City Tbk and 6000 residents of the physical rulers of arable land located in Bojong Koneng Village, Babakan Madang District, Bogor Regency due to claims from PT Sentul City Tbk who claimed to be the owner of land rights based on proof of ownership in the form of Building Use Rights Certificates however, PT Sentul City Tbk itself has never carried out activities on land while there are around 6000 residents who occupy and control physically and have never been raised objections or resistance from any party or from PT Sentul Citty Tbk for more than 50 (fivety) years. The purpose of the study was to find out how the legal position of the physical ruler is cultivated against certified third parties. The research method used is normative, the nature of the research used is descriptive-analytical, the type of data used is primary and secondary data, data analysis is carried out descriptively-qualitatively and quantitatively, and conclusion making is carried out with deductive logic. Ownership of land rights can be proven by the fact of physical control of land parcels for 20 (twenty) consecutive years or more, besides that the holder of a certificate of proof of rights in the form of building use rights is obliged to carry out construction and cultivate his land according to designation and is prohibited from abandoning land, if it occurs, the right to use the building will be erased.

Abstract

Citizen Lawsuit is a mechanism for citizen-initiated legal actions that has developed within the common law legal system, which is currently widely adopted by countries with civil law legal systems. Citizen Lawsuit (CLS) has been recognized in the judicial system of Indonesia since the first ruling, Case Number 28/PDT.G/2003/PN.JKT.PST, within the scope of general jurisdiction. The existence of Citizen Lawsuit in environmental law became apparent following the issuance of Chief Justice Decree Number 36/KMA/SK/II/2013 concerning guidelines for handling environmental cases. This research delves into the evolution and implementation of Citizen Lawsuit in Indonesia, along with an analysis of the rulings related to Citizen Lawsuit, specifically the judgments from the District Court of Samarinda, Case Number 55/PDT.G/2013/PN.SMDA, and the District Court of Central Jakarta, Case Number 374/PDT.G/LH/2019/PN JKT. PST. The study aims to explore the constraints related to the competence of the judiciary and fundamental differences in handling CLS environmental cases in Indonesia following the enactment of Supreme Court Regulation Number 1 of 2023 on Guidelines for Adjudicating Environmental Cases. It also seeks to analyse the rulings that have revitalized the existence of CLS. The research method employed in this study is a juridical-normative approach
