Abstract

Penelitian ini bertujuan untuk menganalisis terkait kepastian hukum hak guna Bangunan bagi para petani yang berada di Desa Pasir Datar Indah dan Desa Sukamulya, Kecamatan Caringin, Kabupaten Sukabumi. Selain itu penelitian ini bertujuan juga untuk mengetahui terkait sumber masalah agraria yang terjadi di lokasi tersebut dan meninjau peran daripada pemerintah daerah dan instansi-instansi terkait dalam upaya menyelesaikan sengketa yang berlangsung lama tersebut. Metode penelitian yang digunakan dalam penelitian ini menggunakan metode penelitian kualitatif, peneliti juga menggunakan teknik observasi, wawancara, dokumentasi, studi pustaka dan wawancara kepada Ketua Serikat Petani Indonesia (SPI) Kabupaten Sukabumi untuk mendapatkan data sebagai bentuk observasi lapangan. Selain itu, peneliti melakukan literasi pustaka sebagai data penunjang dalam penelitian ini. Dalam kepastian hukum mengenai hak guna bangunan yang tertuang didalam Peraturan Pemerintah Nomor 18 Tahun 2021, petani yang berada di daerah Pasir Datar Indah dan Desa Sukamulya telah memenuhi persyaratan sebagaimana ketentuan yang berlaku dan diberikan izin mengenai hak guna bangunan agar dapat digunakan sebagaimana mestinya. Dengan adanya penelitian ini diharapkan mampu menjawab akan kebutuhan masyarakat mengenai pemahaman hukum mengenai tata cara memperoleh izin hak guna bangunan yang dapat dikeluarkan oleh pemerintah dan instansi-instansi terkait yang memiliki kapasitas dalam ranah tersebut.

Abstract

In the world of motor vehicle credit financing as stipulated in Pasal 23 ayat 2 of Undang-Undang Nomor 42 Tahun 1999 concerning Fiduciary which explains that a debtor is prohibited from selling transferring and or mortgaging the object of fiduciary guarantee, except with the permission of the creditor, but in reality the practice of transferring (Over Credit) or mortgaging often occurs among the public as in case study Number. 130/PID SUS/2023/PN SKB. This research examines and analyzes related to over credit that occurs without the knowledge of creditors that occurs among the community, therefore researchers raise two problem formulations among them. First, the legal consequences to the creditor arising from the decision in case No. 130/pid sus/2023/pn skb. 130/PID SUS/2023/PN SKB. Second, the legal consequences for debtors who over credit without the knowledge of the creditor. This research uses an analytical descriptive method with a normative juridical approach, in which data and information are analyzed normatively. The results showed that it is important to be careful in determining a person who can be held legally responsible, because those who can be held legally responsible are legal subjects who carry out legal relations in this study are creditors and debtors.

Abstract

The purpose of this study is to determine how the regulation and implementation of legal protection for lenders in cases of default based on the Financial Services Authority Regulation (POJK) No. 77/POJK.01/2016 concerning Information Technology-Based Money Lending Services. This study also examines the form of legal responsibility of the platform organizer, as well as dispute resolution efforts that can be taken by lenders. The research method used is the normative legal method with a statutory regulatory approach and case studies. Data were obtained through literature studies and documentation of applicable legal provisions, as well as relevant documents and reports from PT. Crowde. The analysis was carried out qualitatively-descriptively to assess the suitability between field practices and applicable regulations. The results of the study indicate that POJK No. 77/POJK.01/2016 has not fully provided comprehensive legal protection for lenders in cases of default. Legal responsibility for default is still largely borne by the civil relationship between the borrower and the lender, without any concrete risk recovery mechanism from the organizer. Therefore, it is necessary to strengthen regulations, increase platform transparency, and play an active role for the OJK and the Indonesian Joint Funding Fintech Association (AFPI) in supervising and following up on default cases.

Abstract

This research aims to examine the existence and role of the National Land Agency (BPN) in optimizing the implementation of Electronic Land Rights Certificates and the use of the Touch My Land application in the Outermost, Frontier, and Disadvantaged (3T) areas, especially in Sukabumi Regency, based on the Regulation of the Minister of ATR/BPN Number 3 of 2023 concerning Electronic Certificates. This study uses a normative and descriptive qualitative juridical approach by examining legal documents as well as the results of observations and interviews at the ATR/BPN Office of Sukabumi Regency. The results of the study show that BPN has strategic administrative authority in the land digitization process, but its implementation in the 3T area still faces various obstacles such as limited digital infrastructure, low community legal literacy, and not optimal policy socialization. From the perspective of state administrative law, the principles of rechtmatigheid and doelmatigheid have not been fully fulfilled, resulting in the lack of comprehensive legal certainty. Therefore, it is necessary to strengthen institutional capacity, as well as the integration of inclusive digital services to realize effective, efficient, and equitable land services in the 3T region. This study recommends reformulation of technical policies and acceleration of digitalization with a community participation-based approach.

Abstract

This research examines a land dispute between a private landowner and the local government concerning the construction of a public facility without following lawful land acquisition procedures. The study focuses on Decision No. 52/Pdt.G/2023/PN Cjr issued by the Cianjur District Court, in which the Cianjur Regency Government built and operated the Muka Public Health Center (Puskesmas) on land owned by the plaintiff, without any process of land release, negotiation, or compensation. This study aims to analyze the legal provisions on land acquisition under Law No. 2 of 2012, the legal protection of private land rights, the legality of the Puskesmas construction, and the court’s legal reasoning. A normative legal research method was used, employing statutory and case approaches. The findings show that the development was unlawful, yet the court did not provide any concrete remedy to the landowner. The judgment acknowledged the unlawful act but did not order the demolition of the building or compensation by the government. This reveals a gap between legal recognition and substantive justice.
