Abstract

Penyalahgunaan narkotika merupakan masalah global yang kompleks, mempengaruhi individu dan masyarakat secara luas. Di Indonesia, isu ini diatur oleh Undang-Undang Nomor 35 Tahun 2009 tentang Narkotika, yang mengadopsi pendekatan hukuman ganda melalui sanksi pidana dan rehabilitasi. Penelitian ini membahas pentingnya memahami dampak penyalahgunaan narkotika dari perspektif viktimologi, yang mengakui korban penyalahgunaan narkotika tidak hanya sebagai pelaku tetapi juga sebagai individu yang memerlukan dukungan untuk pemulihan. Pendekatan ini menantang pandangan tradisional bahwa penyalahgunaan narkotika merupakan "kejahatan tanpa korban", menekankan perlunya pendekatan yang lebih komprehensif dan empatik dalam sistem hukum. Penelitian ini menggunakan metode yuridis empiris, mengkombinasikan analisis dokumen perundang-undangan dengan data sekunder dari literatur yang relevan. Pendekatan deskriptif analitis diadopsi untuk memberikan gambaran mendalam tentang bagaimana undang-undang dan kebijakan saat ini melindungi korban penyalahgunaan narkotika, serta untuk mengevaluasi efektivitas sistem rehabilitasi yang ada. Kesimpulan penelitian menunjukkan bahwa, meskipun undang-undang Narkotika Indonesia telah mengadopsi pendekatan yang relatif progresif dengan memasukkan sanksi rehabilitasi, masih terdapat tantangan signifikan dalam implementasinya. Terutama, akses terhadap rehabilitasi yang efektif terbatas, dan masih terdapat stigma sosial yang kuat terhadap pecandu narkotika.

Abstract

Education plays an important role in building the civilization of a nation and the development of society. The Indonesian Constitution has guaranteed the implementation of education as stipulated in Article 28 C paragraph (1) of the 1945 Constitution. The government is also obliged to play an active role in the implementation of the national education system in order to improve faith, piety, and noble character in order to educate the nation's life, as the goal of the Indonesian state. It is not easy for a Teacher to provide education to students, on the one hand the Teacher needs to provide an understanding of knowledge and on the other hand the Teacher must provide an understanding of attitude and discipline. One of the cases that occurred was in 2012, when a Teacher took disciplinary action against 4 of his long-haired students by shaving the student's head, but one of the students did not accept the action and reported the teacher actions to his father and then reported the teacher to the Police. Although there are legal rules governing the protection of teachers, there are still legal cases experienced by teachers. Therefore, it is necessary to conduct an assessment with regard to (1) What are the obstacles to legal protection for educators? (2) How does progressive law view legal protections for educators to avoid criminalization? and (3) How is the resolution of conflicts between the Teacher and the student handled when carrying out disciplinary duties.

Abstract

This research discusses customary criminal law in Article 2 of Indonesia's new Criminal Code (KUHP), which reflects the country's social and cultural diversity. Customary criminal law, with its unique characteristics rooted in the values and social norms of indigenous communities, offers a different approach to conflict resolution compared to formal criminal law. It enriches the criminal justice system with aspects of restorative justice and creates space for the recognition of living law within society. However, this integration poses challenges, particularly regarding legal certainty and the principle of legality, considering that customary criminal law is often unwritten and variable. The method used is normative, involving legal research conducted through the study of literature or secondary data. The research is descriptive-analytical, focusing on the existence of customary law within national criminal law. Using a qualitative juridical approach, the analysis is based on legal principles and norms, studying legislation, literature, and scholarly writings. This study shows that the recognition of customary criminal law in Article 2 of the new Criminal Code presents challenges and opportunities for Indonesia's criminal justice system. This integration supports restorative justice and reflects the country's cultural diversity, but it also requires careful handling of legal certainty and the principle of legality. The need for clear conflict resolution mechanisms and additional regulations is crucial to maintaining a balance between customary legal traditions and the requirements of modern criminal law.
