Abstract

Kajian ini menyelidiki konstruksi hukum harta bersama dalam perkawinan menurut hadits Bukhari Muslim dan Kompilasi Hukum Islam (KHI) Pasal 85-97. Dengan mengadopsi pendekatan analisis kualitatif terhadap review jurnal terdahulu, penelitian ini mengeksplorasi konsep, regulasi, dan implementasi hukum harta bersama dalam konteks Islam, serta implikasi praktis dan tantangan yang dihadapi dalam kehidupan masyarakat Muslim. Dalam diskusi ini, ditemukan bahwa harmonisasi antara hukum positif dan ajaran agama penting untuk memastikan keadilan dan keseimbangan dalam hubungan perkawinan. Implikasi praktis dari hukum harta bersama mencakup perlunya edukasi dan kesadaran hukum, peran lembaga penegak hukum, perluasan penelitian dan kajian, pemberdayaan peran perempuan, serta perlindungan terhadap hak anak. Kesimpulannya, upaya bersama dari berbagai pemangku kepentingan diperlukan untuk mencapai pemahaman yang komprehensif dan solusi yang berkelanjutan terkait dengan harta bersama dalam perkawinan menurut Islam.

Abstract

The right to a good and healthy environment has been universally recognized as an integral part of human rights (HAM), as affirmed in the Stockholm Declaration 1972, Rio Declaration 1992, and Article 28H paragraph (1) of the 1945 Constitution of Indonesia. This study analyzes the constitutional recognition of this right in Indonesia, the challenges in its implementation amid environmental degradation due to industrialization and urbanization, and its legal implications for human rights enforcement. Employing a normative juridical approach with analysis of international and national legal documents and a case study on the Citarum River pollution, the findings indicate that while normatively robust, this right remains weak in enforcement due to ineffective sanctions and poor inter-agency coordination. Reforms in human rights-based legislation and strengthening of environmental courts are recommended to realize a healthy environment as a substantive human right.

Abstract

This study aims to analyze the urgency of intellectual property rights protection in the context of the digital economy and to formulate effective legal strategies for protecting business ideas. The background of this study stems from the increasing vulnerability of business ideas to imitation and infringement due to advances in digital technology, which have accelerated the distribution and reproduction of intellectual works. The method used is non-empirical legal research employing a normative, doctrinal, and conceptual approach through an analysis of relevant legislation, legal doctrines, and academic literature. The research findings indicate that although Indonesia’s legal system possesses a comprehensive regulatory framework, there remain normative gaps and inconsistencies in accommodating the protection of business ideas in the digital era. The analysis also highlights the need for an integrative legal strategy through a combination of intellectual property registration, trade secret protection, strengthening of business contracts, and the utilization of digital technology. The study’s conclusion emphasizes that effective protection requires a multidimensional approach that is adaptive to technological developments and supported by responsive legal policies.
