Abstract

Penelitian ini bertujuan untuk mengetahui Tumpang Tindih Kewenangan Provesi Advokat Dan Paralegal Dalam Penyelesaian Perkara hubungan Industrial. Metode penelitian ini menggunakan penelitian hukum empiris yaitu dengan melakukan studi wawancara dan dokumentasi terhadap peraturan perundang-undangan, buku, jurnal ilmia, website dan mengumpulkan dari berbagai literatur. Dalam penyelesainnya tersebut memainkan peran sentral dalam menjaga keseimbangan antara pekerja dan pengusaha di tempat kerja. Dalam konteks ini, advokat dan paralegal memiliki peran yang krusial. Namun, tumpang tindih kewenangan sering terjadi di antara kedua profesi ini, memunculkan pertanyaan tentang batasan yang jelas. Artikel ini melakukan analisis yuridis terhadap masalah tersebut, mengeksplorasi kewenangan masing-masing profesi, peran mereka dalam penyelesaian perkara, dan pentingnya koordinasi untuk menghindari tumpang tindih. Dengan koordinasi yang baik, penyelesaian perkara dapat berjalan efisien dan sesuai dengan ketentuan hukum yang berlaku.

Abstract

The decline in the morality of the Indonesian nation regarding sex can be seen in several cases where sex was carried out by celebrities, teachers, civil servants, politicians and students and students without shame. This study aims to find out how much influence porn videos have on children as perpetrators of decency crimes and find out the relevant forms of countermeasures in minimizing the influence of porn videos on children's behavior. This research was conducted at Makassar Polrestabes Class I LAPAS Makassar, and BAPAS Makassar, data collection was carried out by means of interviews and literature study, data were analyzed descriptively. The results of the study show that pornographic videos are a factor that has a stronger influence compared to other factors in decency crimes committed by children. Views in the form of pornographic images will provide sexual stimulation to children. The presence of sexual urges coupled with great curiosity in children has an impact on the occurrence of criminal acts of decency. Efforts to minimize the influence of porn videos in decency crimes committed by children can be carried out in a pre-emitive, preventive and repressive way.

Abstract

Victims of criminal acts only get inner satisfaction from the punishment imposed on the perpetrators but do not get anything that has a direct impact on them. The codified concept of Indonesian punishment in the Criminal Code (KUHP) regulates more aspects related to perpetrators of criminal acts and sentencing. Not much regulates the rights of victims of criminal acts. This paradigm shift began to occur after the enactment of Law Number 13 of 2006 concerning the Protection of Witnesses and Victims, where in this Law the rights of Witnesses and Victims began to be considered. Victims are individuals who are harmed materially or immaterially for the occurrence of criminal acts that they receive. In cases of sexual violence against children, it results in losses suffered by child victims in the short and long term which require recovery of the child's condition. Law Number 13 of 2006 juncto Law Number 31 of 2014 concerning Protection of Witnesses and Victims has accommodated restitution.In Law Number 31 of 2014 concerning Protection of Witnesses and Victims, the victims of criminal acts have the right to obtain restitution rights in the form of compensation for loss of property or income, compensation for losses caused by suffering directly related to the crime, and/or reimbursement for medical and/or psychological treatment costs. However, at present the implementation of restitution for victims of crimes against children is considered not optimal, especially regarding the implementation of restitution that can be given to victims.

Abstract

Obstruction of Justice is an act classified as a criminal offense because it obstructs or hinders the legal process in a case. Lawyers in carrying out their professional duties are often associated with allegations of obstructing the legal process in cases involving their clients. The purpose of this writing is to understand the legal regulations regarding obstruction of justice in Indonesia and the characteristics of lawyer's conduct that can be classified as obstructing the legal process or obstruction of justice. The method used in this article is juridical normative. The research findings indicate that obstruction of justice is generally regulated in Article 221 of the Indonesian Criminal Code (KUHP) and specific legislation. A lawyer can lose their immunity and be considered to have committed obstruction of justice if such conduct is not based on good faith and unrelated to their professional duties.

Abstract

Penelitian ini bertujuan untuk menganalisis kedudukan hukum uang belanja dan kelengkapan uang belanja dalam sistem adat Perkawinan Mandar. Pengaturan mengenai keberadaan dan hak-hak masyarakat hukum adat di Indonesia terdapat di dalam UUD 1945. Dapat dilihat pada Pasal 18B ayat (2), Pasal 281 ayat (3). Sehingga kesepakatan passorong maupun kesepakatan uang belanja serta kelangkapan uang belanja merupakan bagian dari hak-hak tradisional hukum adat yang diakui keberadaannya. Kesepakatan uang belanja merupakan salah satu prasyarat dari suatu perkawinan dalam Suku Mandar yang merupakan suatu prestise yang dituangkan dala bentuk komitmen atau perjanjian antara dua belah pihak yaitu keluarga calon mempelai pria dan calon mempelai wanita. Melihat unsur kesepakatan uang belanja serta kelengkapan uang belanja ini yang dimana melalui suatu pertemuan untuk melakukan kesepakatan bersama dengan melakukan perikatan antara dua belah pihak maka kesepakatan ini melahirkan suatu perjanjian yang berarti terpenuhinya isi Pasal 1320 KUHPerdata tentang syarat sah suatu perjanjian.

Abstract

Most cyber criminals on the internet will be ensnared by Law Number 11 of 2008 concerning Electronic Information and Transactions. The law should offer protection to internet users with good intentions, and provide strict action for cybercrime, especially cyber sabotage actors who disrupt electronic systems and even cause electronic systems to not work properly. Similarly, in Article 5, namely obtaining evidence, there are many obstacles, especially against perpetrators of crimes in Article 33 of Law Number 11 of 2008. Based on the results of the study, it can be concluded that in addition to creating good laws, it also builds the skills of law enforcers to especially find evidence of cybercrime (cybercrime) which is not easy because the crime is in cyberspace by sabotaging the electronic system. In addition, the perpetrators of crimes also hide their identity and the actions they take in cyberspace which is a form of protection.

Abstract

Abstrak Penelitian ini bertujuan untuk Untuk menganalisis dan mendeksripsilkan posisi dan peran whistle blower dan justice collaborator sebagai testiomnium de auditu dalam suatu tindak pidana narkotika serta untuk menganalisis dan mendeskripsikan perlindungan hukum terhadap seorang whistleblower dan justice collaborator sebagai saksi de auditu. Jenis penelitian yang digunakan adalah penelitian hukum doktrinal atau normatif dengan pendekatan undang-undang (legal Aproach) dan menggunakan bahan hukum primer dan sekunder yang dikumpulkan melalui teknik studi kepustakaan. Pada dasarnya semua orang dapat menjadi saksi termasuk Testimonium de Auditu terutama dengan dikeluarkannya Putusan Mahkamah Konstitusi Nomor 64/PUU-VIII/2010 2010 yang memperluas definisi saksi dalam pasal 1 angka 26 KUHAP dan menerima keberadaan saksi Testimonium de Auditu. Dengan pengakuan tersebut maka whistle blower dan justice collaborator yang berstatus sebagai saksi de auditu seharusnya juga mendapat perlindungan dari Undang-Undang Perlindungan Saksi Dan Korban serta SEMA Nomor 4 tahun 2011 yang berkedudukan sama dengan saksi de visu. whistleblower tidak dapat dituntut secara hukum baik pidana maupun perdata atas laporan, kesaksian yang akan, sedang atau yang telah diberikan. Sedangkan, justice collaborator dalam kasus yang sama tidak dapat dibebaskan dari tuntutan apabila terbukti secara sah dan meyakinkan bersalah. Namun, kesaksiannya dapat dijadikan pertimbangan hakim dalam meringankan pidananya. Kata Kunci:  Justice Collaborator; Perlindungan Hukum; Testimonium de Auditu; Whistleblower   Abstract This study aims to analyze and describe the position and role of whistle blowers and justice collaborators as a testimonium the auditu in a narcotics crime and to analyze and describe legal protection for a whistleblower and justice collaborator as a witness de auditu. The type of research used is doctrinal or normative legal research with a legal approac and using primary and secondary legal materials collected through literature study techniques. Basically all person can be witness including Testimonium de auditu especially with the release of Constitutional Court Decision Number 64/PUU-VIII/2010 2010 which expands the definition of witness in Article 1 number 26 Criminal Procedure Code And accept existence witness Testimonium de auditu. With this recognition, whistle blowers and justice collaborators Those who have the status of de auditu witnesses should also receive protection from the Witness and Victim Protection Law and SEMA Number 4 of 2011, which has the same status as de visu witnesses. Whistleblowers cannot be prosecuted either criminally or civilly for reports, testimonies that will, are being or have been given. Meanwhile, justice collaborators in the same case cannot be released from prosecution if proven legally and convincingly guilty.
