Abstract

Tujuan dari penelitian ini adalah untuk mengetahui penerapan sanksi adat terhadap pelaku terkait pelanggaran adat pencabutan penjor di Desa Adat Taro, Tegallalang, dan mengetahui upaya Desa Adat Taro dalam hal pencegahan pelanggaran adat pencabutan penjor. Metode yang digunakan dalam penyusunan penelitian ini adalah pendekatan yang bersifat yuridis-normatif yang didukung dengan jenis penelitian Empiris yaitu suatu penelitian yang berfokus atau mengkaji mengenai penerapan norma-norma hukum atau kaidah-kaidah dalam hukum positif. Hasil dari penelitian ini adalah Tujuh Prajuru Desa Adat Taro Kelod, Kecamatan Tegallalang, Gianyar yang menjadi terdakwa kasus pencabutan penjor Galungan tidak dikenakan sanksi adat dikarenakan korban sedang dalam masa dikenakan sanksi adat Kasepekang oleh Desa Adat Taro. Namun para tersangka tetap divonis 8 bulan penjara hukum nasional dikarenakan perbuatan pencabutan penjor merupakan tindak pidana penistaan agama. Dalam putusan majelis hakim menyatakan para terdakwa terbukti secara sah dan meyakinkan melanggar pasal 156a Jo Pasal 55 ayat (1) ke-1 KUHP. Pencegahan tindak pelanggaran adat pencabutan penjor dilakukan upaya Preventif dengan cara memaksimalkan jajaran penegak hukum yang terdiri dari bendesa adat, prajuru desa, beserta wali desa untuk meningkatkan pengawasan dan koordinasi. Desa Adat berupaya untuk melengkapi awig-awig dengan pararem tertulis yang mengatur secara khusus mengenai pelanggaran adat pencabutan penjor maupun sarana Upacara Agama lainnya, dengan selalu mengupayakan korelasi antara hukum adat dan hukum nasional, serta kesadaran hukum dan pengetahuan masyarakat perlu ditingkatkan. Upaya Refresif dilakukan dengan Penajaman Sanksi, berupaya untuk memberikan sanksi terhadap tindak pidana serupa. Peningkatan atau penajaman sanksi ini berupa mengkaji kembali awig-awig Desa Adat Desa Taro melalui paruman adat. Segi Penindakan, prajuru Desa Adat Taro Kelod agar lebih berhati-hati kembali sebelum melakukan sebuah tindakan pelanggaran dengan menimbang banyak hal antara lain tentang hukum adat dan nasional, dan bila ada pelanggaran serupa dapat diadili secara adat melalui paruman The purpose of this study is to determine the application of customary sanctions towards perpetrators related to customary violations of the penjor handling over in Desa Adat Taro, Tegallalang, Gianyar, and to know the effort in terms of prevention of customary violations of Penjor Handling over. The method used in the preparation of this research is a juridical-normative approach supported by the type of empirical research, which is a research that focuses or examines the application of legal norms or rules in positive law. The results of this study are Seven of Prajuru Adat Desa Adat Taro who is a defendant in the case is not subject to customary sanctions because the victim is in the period of being subject to customary sanctions Kasepekang by Desa Adat Taro. However, the suspects were still sentenced to 8 months in prison under national law because the act of handling over of penjor is a criminal offense of blasphemy. In the ruling, the panel of judges stated that the defendants were legally and convincingly proven to have violated the article 156a Jo Pasal 55 ayat (1) ke-1 KUHP. Prevention of customary violations of penjor revocation is carried out preventive efforts by maximizing the ranks of law enforcement consisting of bendesa adat, prajuru desa, anda wali desa to improve supervision and coordination. Desa Adat Strive to complement awig-awig with written pararems that specifically regulate violations of customary revocation of penjor and other means of religious ceremonies, by always striving for a correlation between customary law and national law, as well as legal awareness and public knowledge need to be improved. Repressive efforts are carried out with Sanctions Sharpening, seeking to sanction similar criminal acts. This increase or sharpening of sanctions is in the form of reviewing awig-awig Desa Taro by paruman Adat. In terms of enforcement, Taro Kelod Customary Village stewards should be more careful before committing an act of violation by considering many things, including customary and national law, and if there is a similar violation, it can be tried customarily through paruman.

Abstract

The purpose of this research is to determine the process of challenges and prospects for implementing E-government in improving the quality of public services, as well as the inhibiting factors in implementing E-government in improving the quality of public services in the Legal Digital Era. The method used in preparing this research is a normative approach which is supported by empirical where this research approach uses a statutory approach and a Legal Concept Analysis approach. Where the nature of the research uses exploratory (exploratory) research. The results of this research are the elements of successful implementation of e-government through pro applications, which are assessed as good, namely the Capacity Element (resources) in Denpasar City Dukcapil, with the availability of human resources, namely operators who have been equipped with knowledge and skills from training conducted by the Department. Denpasar City Population and Civil Registration. Elements that have not been implemented well by the Denpasar City Dukcapil are; a. Support element, because seen from the willingness of the people of Denpasar City who still lack awareness of the importance of electronic-based service systems as evidenced by the lack of people accessing the Pro application, many people even stated that they were not aware of the existence of the Pro application; b. Value element (benefits) because some people have not felt the benefits of the Pro Application because after they have provided services using the Pro application in processing documents but are still told to come back to the office to complete the data. Inhibiting factors in implementing e-government through the pro application at the Denpasar City Dukcapil are; a. unstable network; b. People do not understand technology; c. Server error/full; d. People's mindset.

Abstract

The forms and characteristics of labor disputes occurring in the hotel industry show unique dynamics, in line with the nature of the industry which is labor-intensive, service-based, and highly dependent on customer satisfaction. In general, the dominant forms of disputes include; 1) rights disputes, such as late salary payments, underpayment of overtime, wage deductions without legal basis and neglect of normative rights such as leave and social security, 2) interest disputes, such as disputes regarding the service charge distribution system, changes in working hour policies without workers' consent or demands for increased welfare, 3) layoff disputes, which often occur unilaterally by hotel management for reasons of efficiency or disciplinary violations that are not based on proper legal procedures. The characteristics of labor disputes in the hotel industry include; recurring and structural in nature, especially in terms of wages and working hours, involving unequal power relations between management and workers, which makes internal resolution difficult, often not well documented, because some workers are non-permanent or casual, have a direct impact on the reputation and sustainability of the hotel business, considering the nature of the industry that prioritizes image and service. Thus, it can be said that the resolution of labor disputes in the hotel industry requires a comprehensive approach, not only based on positive law but also considering the sociological conditions of the employment relationship, as well as supporting a resolution mechanism that is fast, fair and maintains the stability of industrial relations. The mechanism for resolving labor disputes through mediation and arbitration in the hotel industry has great potential in preventing the escalation of conflict that can be detrimental to both parties and damage the image of the hotel business. However, its effectiveness is highly dependent on an understanding of the law, a commitment to social dialogue, and the commitment of the parties to resolve the problem peacefully outside the litigation channel.
