Abstract

A corporation is a business entity whether as a legal entity or not a legal entity, but within it there is an organizational management structure and runs its business through its management.This research focuses on three problems, namely how corporations are defined, what the subject of criminal law is like in Indonesia, and what the position of corporations are as subjects of criminal law and their responsibilities in criminal law in Indonesia. This research uses normative research methods which refer to research and literature related to the problems studied. This research concludes that the position of corporations in criminal justice also varies. These positions include the following: (1) as the author of a criminal act, (2) as a tool for committing a criminal act, (3) as the object of a criminal act. The concept of criminal law regarding corporate responsibility is experiencing development. Models of corporate responsibility as time goes by, namely: (1), legal fiction theory, (2) ultra virez doctrine, (3) identification theory, (4) strict liability, (5) vicorious liability, (6) successful liability, (7) delegation theory.

Abstract

Traditionally, criminal law only recognizes humans as subjects of criminal law or perpetrators of criminal acts. However, considering that many companies carry out various business activities that harm society in ways that violate the law, society and criminal law experts have begun to question: should companies whose business activities are very detrimental to society not have to bear the burden of criminal responsibility? Are only their managers able and must be punished? This question has led to the acceptance of the concept of corporate criminal responsibility. Criminal acts for which criminal responsibility can be imposed on corporations are called corporate crimes. The concept of corporate criminalization is a concept of criminal law that has not been accepted by criminal law for long. Although this concept first appeared in England in the 19th century, in other countries this concept was only accepted in the 20th century. For example, France only recognized the concept of corporations as perpetrators of criminal acts in 1994, Luxembourg and Spain in 2010, and Italy in 2011. The increasing number of criminal cases against corporations in the US and Canada also only occurred in the 21st century. The US and Europe in recent times have been faced with various criminal cases involving corporations, such as environmental pollution, unfair business competition, food and drug products that are harmful to health, fraud involving company accounting records, worker accidents, bribery, and financial crimes. The role of corporations is very large in human life on this earth. With human dependence on corporations that is very large, it is possible for corporations to do whatever they want, the most important thing for them is to get big profits. So it is not surprising if corporations violate the applicable regulations. In relation to this, can corporations be held accountable for these violations under Indonesian criminal law.

Abstract

Kebakaran hutan merupakan masalah global yang mempengaruhi ekosistem dan masyarakat secara luas. Dalam konteks ini, peran korporasi sebagai aktor utama dalam aktivitas yang berpotensi menyebabkan atau memperburuk kebakaran hutan menjadi subjek perdebatan yang penting. Artikel ini bertujuan untuk menyelidiki pertanggungjawaban hukum korporasi dalam kasus pembakaran hutan, dengan fokus pada aspek hukum internasional dan nasional yang relevan. Pertanyaan utama yang dibahas meliputi bagaimana prinsip-prinsip hukum internasional mengatur tanggung jawab korporasi terkait kebakaran hutan, kendala-kendala dalam penerapan pertanggungjawaban hukum, kerangka hukum nasional di Indonesia, upaya-upaya hukum untuk meningkatkan akuntabilitas korporasi, dan peran lembaga internasional dalam mengawasi praktek-praktek korporasi. Dengan menganalisis berbagai studi kasus dan literatur hukum yang relevan, artikel ini menawarkan wawasan tentang bagaimana sistem hukum dapat diperkuat untuk menghadapi tantangan lingkungan yang semakin kompleks ini. Selain itu, artikel ini juga menyoroti pentingnya kolaborasi antara pemerintah, korporasi, dan masyarakat sipil dalam memastikan keberlanjutan lingkungan hidup di masa depan.
