Abstract

The Constitutional Court is an institution of judicial power based on the constitution and has a judicial function to uphold law and justice. Based on the 1945 Constitution of the Republic of Indonesia, state power is divided into three parts, namely legislative, executive and judicial. The authority of the Constitutional Court is regulated in Article 24C of the 1945 Constitution, namely that the Constitutional Court functions to adjudicate at the first and last level and its decisions are final. Constitutional Court decisions in reviewing laws relate to formal and material aspects, so consideration is required by the judge as a basis for a decision. This article was written to review the authority of the Constitutional Court in judicial review and regarding the inconsistency of the Constitutional Court in decision Number 90/PUU-XXI/2023 concerning the age requirements for presidential and vice-presidential candidates.

Abstract

Abstract

Abstrak Cryptocurrency merupakan mata uang digital yang berbasis blockchain dan sistem jaringanya berupa peer to peer (P2P). Di Indonesia aset kripto termasuk dalam perdagangan berjangka komoditi yang dikeluarkan oleh Badan Pengawas Perdagangan Berjangka Komoditi (Bappebti) Kementerian Perdagangan dan telah legal di Indonesia sebagai aset komoditas. Tujuan dari penelitian ini adalah untuk mengetahui cryptocurrency sebagai objek jaminan fidusia dan untuk mengetahui perlindungan hukum yang akan didapatkan oleh para pengguna cryptocurrency. Penelitian ini menggunakan penelitian pendekatan yuridis normatif dan menggunakan bahan hukum primer. Dalam penelitian ini, penulis mendapatkan hasil bahwa cryptocurrency dapat dijadikan sebagai objek jaminan fidusia berdasarkan peraturan Bappebti Nomor 5 Tahun 2019 dan Surat Edaran Bappebti Nomor 11 Tahun 2022. Serta para pengguna cryptocurrency dapat dilindungi berdasarkan Undang-Undang Perlindungan Konsumen dan Undang-Undang Informasi dan Teknologi. Kata Kunci: Cryptocurrency, Objek Jaminan Fidusia Abstract Cryptocurrency is a blockchain-based digital currency and its network system is peer to peer (P2P). In Indonesia, crypto assets are included in commodity futures trading issued by the Commodity Futures Trading Supervisory Agency (Bappebti) of the Ministry of Trade and are legal in Indonesia as commodity assets. The purpose of this research is to find out cryptocurrency as an object of fiduciary security and to find out the legal protection that cryptocurrency users will get. This research uses a normative juridical research approach and uses primary legal materials. In this research, the author obtained the results that cryptocurrency can be used as an object of fiduciary security based on CoFTRA Regulation Number 5 of 2019 and CoFTRA Circular Letter Number 11 of 2022. And cryptocurrency users can be protected based on the Consumer Protection Law and the Information and Technology Law. Keywords: Cryptocurrency, Fiduciary Security Object
