Abstract

This research reviews the impact of the removal of articles in the Minister of Agriculture Regulation No. 98/2013 on the regulation and dynamics of business competition in the palm oil plantation industry, as well as monopolistic practices. The removal of several articles potentially damages business relationships and leads to unhealthy business competition. This research aims to provide an understanding of the impact of regulatory changes on the palm oil plantation industry. Using a qualitative approach, it focuses on analyzing the potential monopolistic practices occurring in the palm oil industry as a direct result of the removal of Articles 13, 14, and 49. By analyzing secondary data and related literature, this research identifies new patterns in business competition dynamics and how these changes affect various stakeholders. The results of the study are expected to provide insights into the changes resulting from the removal of these articles. Recommendations provided include strengthening regulations and exploring alternatives to maintain healthy business competition.

Abstract

Praktik pinjam nama atau kita kenal dengan praktik nomineetelah dilaksankaan oleh beberapa investor asing yang melakukan investasi di Indoneisa, dengan bertujuan memperoleh hak kepemilikan tanah atas wilayah Tanah Air, urgensi adanya praktik ini adalah lebih kepada para WNA yang ingin membangun PT PMA karena WNA tahu dengan jelas bahwa kepemilikan tanah di Indonesia untuk membangun usaha dilarang, maka dari itu dilakukan cara lain agar dapat mencapai keinginan kepemilikan hak atas tanah. Disisilain praktik ini masih dilarang di Indonesia, tetapi banyak WNI yang tetap ingin melaksanakan praktik ini, karena menguntungkan baginya dan bagi pihak WNA, tentunya juga Pemerintah Indonesia yang hanya melihat bahwa banyaknya investor asing yang melakukan investasi langsung tanpa tahu terdapat perjanjian kausa yang tidak halal sesuai dengan Pasal1320 KUH Perdata.Dari perjanjian praktik pinjam nama ini, juga menimbulkan banyaknya risiko bagi WNI. Maka dari itu urgensi adanya praktik pinjam nama ini merupakan keegoisan dari piahk WNA yang ingin melakukan kerjasama dan mendapatkan keuntungan sendiri, tanpa memikirkan kedudukan hukum yang berlaku terhadap peraturan perundang-undangan yang ada di Indonesia, serta risiko yang ditimbulkan terkait dengan pelaksanaan praktik pinjam nama (nominee arrangement).
