Abstract

Indonesia is a constitutional state, in line with the wording of Article 1(3) of the 1945 Constitution of the Republic of Indonesia. Therefore, all aspects of social life are protected by the state constitution. The rule of law includes the constitutional rights of citizens, one of which is the right to freedom of association, assembly and expression of opinion, as set forth in Article 28e(3) of the 1945 Constitution. One of the basic rights enshrined in the Constitution is the right to freedom of expression in public. In giving public comments, you can use electronic media regulated in Law Number 19 of 2016 concerning Information and Electronic Transactions. The law covers criminal acts in the fields of technology and electronic transactions, and regulates the delivery of opinions in electronic media. As a result, the expression of opinions through electronic media is subject to legal restrictions.

Abstract

In criminal law, an act is a fundamental element in determining a criminal offense. Often described as strafbaar feit or a punishable act, criminal behavior can be committed by any individual. Although people with special conditions, such as intellectual disabilities, have a lower incidence of committing crimes, this does not negate the possibility of their involvement in criminal acts. Individuals with intellectual disabilities are recognized as human beings with both rights and obligations. However, under criminal law, certain individuals with disabilities may receive special consideration through the protection of Article 44 of the Indonesian Criminal Code (KUHP). This has led to a debate regarding the legal status of persons with disabilities: should they be held responsible for their actions as perpetrators of crimes, or should they be protected as individuals with special needs whose rights must be safeguarded? Psychiatric Forensic Evaluation (Visum et Repertum Psikiatri or VeR Psikiatri) plays a critical role in legal decisions concerning the mental condition of individuals with intellectual disabilities who have committed criminal offenses. This research, focusing on a case study from the Wonosobo District Court (Case No. 16/Pid.Sus/2019/PN.Wsb), employs a qualitative research approach, analyzed juridically and normatively. The research is based on a review of legal literature and interviews with relevant authorities.

Abstract

Perkembangan teknologi digital telah mengubah pola konsumsi masyarakat, termasuk dalam sektor pemesanan makanan secara daring melalui layanan seperti Shopee Food. Namun, muncul persoalan mengenai kepastian hukum terhadap jaminan produk makanan halal yang dipasarkan melalui platform tersebut. Penelitian ini bertujuan untuk menganalisis bentuk perlindungan konsumen terhadap jaminan kehalalan produk makanan pada layanan Shopee Food berdasarkan Undang-Undang Nomor 8 Tahun 1999 tentang Perlindungan Konsumen serta relevansinya dengan Undang-Undang Nomor 33 Tahun 2014 tentang Jaminan Produk Halal. Metode penelitian yang digunakan adalah yuridis normatif, dengan pendekatan perundang-undangan dan konseptual. Data diperoleh melalui studi kepustakaan terhadap peraturan perundang-undangan, literatur hukum, serta putusan yang relevan. Hasil penelitian menunjukkan bahwa perlindungan hukum terhadap konsumen dalam konteks jaminan produk makanan halal di Shopee Food masih belum optimal, karena belum adanya kewajiban bagi platform digital untuk melakukan verifikasi kehalalan terhadap setiap produk yang ditawarkan oleh mitra penjual. Shopee Food sebagai penyelenggara layanan berkewajiban memberikan informasi yang benar, jelas, dan jujur sebagaimana diatur dalam Pasal 4 dan Pasal 7 UU Perlindungan Konsumen. Kesimpulannya, perlindungan konsumen terhadap produk makanan halal di layanan Shopee Food masih bersifat preventif dan belum sepenuhnya represif karena pengawasan dan sanksi belum efektif. Oleh karena itu, diperlukan penguatan regulasi dan koordinasi antara BPJPH, Kementerian Perdagangan, dan penyedia platform digital untuk menjamin hak konsumen atas produk halal sesuai prinsip perlindungan hukum yang berkeadilan.
