Abstract

Tindak pidana transnasional terorganisasi adalah salah satu jenis kejahatan yang paling kompleks karena melibatkan aktor lintas batas negara melalui mekanisme yang terstruktur. Jenis kejahatan ini termasuk perdagangan narkoba, senjata ilegal, pencucian uang, perdagangan orang, perdagangan barang curian atau bajakan, serta barang-barang lain yang tidak boleh diperdagangkan seperti hewan langka yang dilindungi. Untuk melindungi kepentingan dan kedaulatan negaranya, pemerintah Indonesia secara konsisten meningkatkan kerja sama internasional dalam penanggulangan kejahatan transnasional. Dengan waktu, pemerintah memperhatikan kejahatan transnasional yang baru dan berfokus pada penanggulangan penyalahgunaan narkoba. Penelitian ini berfokus pada faktor-faktor yang memengaruhi perkembangan kejahatan terorganisasi transnasional atas penyalahgunaan narkoba dan fungsi pemerintah dalam memerangi penyalahgunaan narkoba terhadap kejahatan terorganisasi transnasional. Penelitian hukum normatif dan penelitian socio-legal digunakan. Hasil penelitian menunjukkan bahwa, pertama, ada tiga (tiga) faktor yang mendorong perkembangan penyalahgunaan narkoba terorganisasi transnasional: (1) globalisasi, (2) keterbukaan ekonomi, dan (3) masalah perbatasan. Kedua, bagaimana pemerintah menangani penyalahgunaan narkoba terorganisasi transnasional meliputi empat (empat) hal: (1) penyediaan sarana dan prasarana, (2) penegakan hukum, dan (3) pengawasan terhadap penyalahgunaan narkoba.Kata Kunci : Kejahatan Terorganisasi Transnasional; Peran Pemerintah; Penyalahgunaan Narkoba. Organized transnational crime is one of the most complex types of crime because it involves actors across national borders through structured mechanisms. These types of crimes include drug trafficking, illicit weapons, money laundering, human traffic, theft or piracy, as well as other non-tradeable goods such as protected rare animals and bands In order to protect the interests and sovereignty of its country, the Indonesian government is consistently enhancing international cooperation in combating transnational crime. Over time, the government has been paying attention to new transnational crime and focused on combating drug abuse. The research focuses on the factors that influence the development of transnational organized crime over drug abuse and the role of the government in combating drugs abuse over transnationally organised crime. Normative law research and socio-legal research are used. The results show that, firstly, there are three (three) factors driving the development of transnational organized drug abuse: (1) globalization, (2) economic openness, and (3) border issues. Secondly, how governments deal with transnationally organized drugs abuse covers four (four) things: (1) provision of facilities and supplies, (2) law enforcement and (3) monitoring of drug abuses.Keywords: Transnational Organized Crime; Government Role; Drug Abuse.

Abstract

Indonesia is a democracy because its people are involved in policy-making. As a state of law, both rulers and citizens, as well as the nation itself are subject to the law. All attitudes, actions taken must be in accordance or based on the laws and regulations that apply in the Unitary State of the Republic of Indonesia. The emergence of laws and regulations is the result of the translation of public policy in the midst of the survival of a democratic society into a normative language order. Legal products are regulatory measures that need to be integrated into the regional autonomy system. High quality local legal products mean that these legal products include the preparation of material and technical regulations to solve problems and meet community needs. The formation of local legal products pays attention to the views, awareness, and legal ideals of life, including the spiritual atmosphere and the Indonesian state philosophy of Pancasila and the 1945 Constitution of the Republic of Indonesia. Regional legal products must be based on considerations and reasons that show that the direction of regional regulation is more democratic towards the formation of regional legal products that are really needed by the community. The normative legal research method is based on the idea of describing the research.
