Abstract

Penelitian ini dilatarbelakangi dengan adanya temuan di desa Kayulompa Kecamatan Basidondo yaitu adanya praktik pernikahan yang memakai adat kembar mayang dan pecah telor. Tujuan menggunakan adat kembar mayang dan pecah telor tersebut sebagai bentuk ketaatan suami terhadap istri. Praktik adat Jawa kembar mayang dan pecah telor ialah salah satu adat istiadat jawa yang mana setiap pengantin harus melaksanakannya, agar menghindari hal-hal yang tidak terduga seperti merusak harga diri. Termasuk dalam melaksanakan praktik pernikahan adat Jawa, keyakinan yang diturunankan dari nenek moyang tanpa mereka sadari telah menjadi suatu keyakinan, yang mana mereka juga mewarisi dan mempertahankan adat mereka. Peneliti mengkategorikan kembar mayang dan pecah telor termasuk ‘urf fasidah karena para ulama sepakat, bahwa ‘urf fasidah tidak menjadi landasan hukum, dan kebiasaan tersebut batal demi hukum. Praktik kembar mayang juga adalah adat Jawa yang di dalamnya termasuk ‘urf fasidah (tidak benar), yaitu suatu adat kebiasaan yang sampai menghalalkan yang diharamkan Allah kebalikan dari ‘urf shahihah.

Abstract

Pre-marital guidance has become a regulation of the Ministry of Religion. With the aim of providing an understanding of domestic life in realizing a sakinah mawaddah wa rahmah family, and can minimize the occurrence of disputes, violence and even divorce. Bride and groom in East Balikpapan sub-district participated in a pre-wedding guidance program for initial debriefing for prospective brides at KUA provided by BP4 (Marriage Advisory, Guidance, and Preservation Agency). Through this program, the prospective bride and groom will be required to attend pre-wedding classes or guidance for approximately 16 hours of meetings to obtain a certificate which will later be used as a requirement when carrying out a marriage at the KUA. The KUA employee of East Balikpapan District agrees with the existence of pre-marital guidance. That way the bride and groom get education for their readiness, regardless of the assumption that people who are getting married do not need to take part in these activities. However, the optimality of pre-wedding guidance carried out at the KUA of East Balikpapan District is only like a supplement, sufficient but not optimal, in the implementation of pre-wedding debriefing there are still many shortcomings, such as short time and the material provided is also lacking in depth.

Abstract

Khuluk is a divorce lawsuit that comes from the wife by requiring that the plaintiff must declare the lawsuit in a conscious condition. The husband as the defendant cannot approve the lawsuit if the wife does not meet the requirements for submitting khuluk, but not in one family in the RT. 038 where the wife who proposes khuluk is under the influence of a jinn. The research method used is qualitative research. The type of research used is a case study. Khuluk that happened in RT. 038 took place in a condition where the wife was influenced by the jinn, where at that time her husband did not immediately agree to the khuluk lawsuit so that the legal review of this case was divided into two parts. The first part is that the condition of the wife who does not meet the requirements of the plaintiff of khuluk is considered invalid, while the second part is the reason why the husband agreed to the lawsuit which was analyzed through several fiqh rules and sadd aż-żarāi' was considered legal.

Abstract

This study examines the phenomenon of giving monetary envelopes at weddings within Indonesian Muslim society, a practice that often occupies a gray area between voluntary giving (tabarru’) and economic exchange (mu’āwaḍah). The research employs a qualitative method that compares legal theory with empirical realities in the field. The data was collected from several relevant research articles that discuss wedding traditions in various regions. The data analysis was conducted by selecting relevant information, organizing it systematically, and drawing logical conclusions to address the existing legal issues. Through a comparative approach between Islamic Family Law and Islamic Economic Law, this article aims to map the legal status and socio-economic functions of this tradition. The findings indicate that, from the perspective of Islamic Family Law, wedding envelopes are regarded as gifts or grants that serve to strengthen social bonds (silaturahmi). However, from the perspective of Islamic Economic Law, this practice may shift into a form of debt (qardh) when accompanied by record-keeping and expectations of equivalent repayment. This study proposes a classification of wedding envelopes into three categories: pure gifts, social debts, and social investments. In conclusion, the permissibility of this tradition largely depends on the clarity of intention and sincerity, ensuring that such assistance does not become a burdensome obligation in the future.
