Abstract

Abstract: The provision of food and beverages to examiners during undergraduate thesis defenses is a common practice in academic settings, often regarded as a gesture of appreciation or respect by students. However, this practice raises ethical and legal concerns, particularly regarding its potential classification as gratification that could influence the objectivity of academic assessment. This study aims to examine the legal status of such practices from the perspectives of positive law and Islamic law, and to assess the extent to which this tradition is normatively and ethically acceptable. The research employs a normative legal method, incorporating statutory, comparative, and conceptual approaches. Data sources include statutory regulations, religious fatwas, and scholarly literature. The findings indicate that, under positive law, the provision of food may constitute gratification if intended to influence academic decisions; however, it does not necessarily violate the law if done sincerely and within reasonable limits. From the perspective of Islamic law, such acts are permissible as long as they do not involve elements of risywah (bribery) or raise suspicion. Therefore, it is essential for higher education institutions to establish clear ethical guidelines to uphold academic integrity amidst evolving traditions of reciprocal social gestures.

Abstract

This reseach is aim to know the validity and impact of teleconference-based marriage probelms in Indonesia. This research used descriptive qualitative research method and the kind of research is library research. The result of the research showed that online marriage contract has a risk and it is being a debate especially about ittihâd al-majlis, but with taukil bil kitabah as the procedure from Religious Affairs Office (KUA) which is the state official agency in marriage problem can be a solution of it. Because of the marriage through teleconference case in 1989 that became a pioneer of this marriage can be held and developed until now. Which is one of the KUA in Jakarta Selatan refuses the long distance marriage to be registered. So that the researchers felt the need to research about the validity of long distance marriage from Islamic and positive law sides. Also, so it could educate people about the risk of daring or teleconference marriage, if it occurs, it is feared that there would be a technology-based fraud such as deepfake and so forth

Abstract

Terrorism problem in Indonesia is one of the main problems that caught a serious attention from government. Series of a terror incidents so far show that there is a serious problem that has not solved yet to be fixed. Indonesia in the report of Global Terrorism Index (GTI) 2023 is ranked 24th from 163 countries that get most affected by terrorism with the total 638 incidents since 2000 until 2020. The terrorism action can endanger the security of nation and state. The consequence of that action are lost a life, a suspicion towards a particular race or religion, break up the nation's unity, damage physically and mentally, and raises fear in the society because the feel of threatened by the presence of terrorists. To deal with terrorism and radicalism, the government implements a program which known as deradicalization under National Counter Terrorism Agency (BNPT). With the deradicalization as the coaching program which aimed to change the terrorism convicts' radical character creates the expectation from public to the government in eradicating terrorism crime.
