Abstract

Pengembangan sistem pakar dalam sistem peradilan elektronik berdampak disrupsi teknologi di pengadilan, ada perubahan fundamental penggunaan teknologi dalam memberikan input bagi pengambilan putusan hakim. Penelitian ini bertujuan untuk menjawab fokus penelitian tentang mungkinkan pembangunan sistem pakar dengan batasan-batasan tertentu dan diintegrasikan dengan sistem peradilan elektronik. Metode yang digunakan dalam penelitian ini adalah metode yuridis normatif, dengan metode analisa deskriptif. Hasil penelitian menunjukkan, pengoptimalan peradilan elektronik dilakukan terhadap teknis pengembangan berupa; peningkatan fleksibilitas guna mengakomodasi proses persidangan yang tidak terduga, peningkatan tampilan dan performa, serta peningkatan dan penambahan fitur agar e-court mengakomodasi seluruh proses peradilan, termasuk proses pembuatan advisblaad walau fitur tersebut bersifat rahasia dengan tingkat keamanan yang tinggi. Sedangkan pembangunan sistem pakar yang dapat membantu memberikan input pada putusan hakim. Input tersebut sesuai kaidah penalaran, lebih cepat dan konsisten

Abstract

What is the projection for optimization of information technology systems, especially electronic justice based on the 2010-2035 judicial reform blueprint? and, Does an expert system have the potential to be built and integrated with electronic justice so that it can provide input for judge's judgments? the two aforementioned questions are fundamental questions which in discussion are able to provide an explanation for the public regarding the achievements of the Supreme Court in the development of electronic judicial today and provide input on how electronic justice will be developed in the future so as to be able to improve the quality of judgments. The discussion of this paper is based on the 2010-2035 blueprint and contemporary achievements in the development of electronic judicial. The results of the research indicated that i) MA is developing electronic justice according to the 2010-2035 blueprint and developing the potential E-RIS to become a knowledge database ii) Development of a knowledge database is a major potential in the development of an expert system that may assist to provide input to judge judgments. The input is in accordance with the rules of reasoning, faster and more consistent.

Abstract

The Right to be Forgotten has been recognized in the Information and Electronic Transactions Law (ITE) and the Personal Data Protection Law (PDP), but has not been regulated in detail. The ITE Law and the PDP Law do include provisions on the right to be forgotten, but there is no specific explanation of the conditions that must be met to establish what rights can be removed as part of the Right to Be Forgotten. In addition, there is no special assessment body tasked with determining and assessing these conditions. This ambiguity causes the implementation of the Right to be Forgotten to be hampered in Indonesia. This journal aims to provide recommendations for policymakers to improve related regulations so that the implementation of the Right to be Forgotten can run effectively in Indonesia so that it has benefits for law enforcement in Indonesia. The method used in this journal is normative juridical research with a statute approach. The results of the study show that in order for the implementation of The Right to be Forgotten to be more effective, it is necessary to prepare clearer determination requirements and the establishment of an independent assessment body that can handle applications fairly and transparently.
