Abstract

The purpose of this study is to determine how the implementation of the work agreement between the Employee Union and Management and what obstacles are in the PKB and what efforts are made to overcome obstacles to implementation. The research method used in this study is the normative legal research method and it can be concluded that: 1. The implementation of the Collective Labor Agreement (PKB) between Workers and Company Management starting from the first PKB to the last PKB to be valid, there are not many violations in terms of the quantity of problems. However, violations of the PKB also result in obstacles to the working relationship between employees. 2. Implementation, how to make a joint agreement, the role and function of the Collective Labor Agreement (PKB) must still be considered in determining policies or decisions concerning the existence of the workforce. Because with Sekar's involvement from the start in determining policies concerning employees through Sekar's role and function, it can prevent industrial relations disputes.

Abstract

Land is a necessity for many people, it needs to be arranged in its use, this is regulated in the Basic Agrarian Law No. 5 of 1960, which covers, earth, water, and space with customary law as the main basis then how is the legal protection for land rights holders whose land area is affected by development for the public interest and the compensation process in land acquisition for the public interest. This study aims to (1) To find out and analyze the legal protection for land rights holders whose land is affected by development for the public interest (2) To find out and analyze the compensation process in land acquisition for the public interest. The type of research used in this study is empirical legal research while the data collection technique is the Statute Approach, Sociological Approach, Types of legal materials used, including primary legal materials and secondary legal materials. Data analysis is Analytical Descriptive Analysis. The results of the study show that (1) General description of the area including the location of the area, natural conditions and areas consisting of: Topography, Hydrology, Area of Land Use, Climate Conditions. ( 2 ) Legal Protection for Land Rights Holders Whose Land Area is Impacted by Development for Public Interest (3 ) The compensation process in land acquisition for public interest includes: Inventory and Identification, Compensation assessment, Deliberation on compensation determination, Provision of compensation, Form and amount of compensation.

Abstract

In a cooperation agreement between a developer and a landowner for real estate housing development, the written contract resulted in a breach of contract (default) that caused losses to the landowner. The focus of this study is to examine the breach of contract and the factors causing it in the housing development cooperation agreement between the landowner and the developer, as well as the consequences of the breach and the legal protection available to the landowner. The research method used is descriptive, with data collected through interviews, documentation, and data analysis. Based on the data analysis, it was found that the landowner suffered several losses due to the developer’s failure to comply with the agreed terms in the real estate housing development cooperation agreement. In the implementation of the agreement, the developer did not fulfill its responsibility to construct all the houses as stipulated in the contract. As a result, the landowner did not receive their entitled rights under the agreement and was unable to reuse the land due to the stalled construction caused by the developer’s cessation of the housing development project. Compensation may be resolved through deliberation or by entering into a new agreement outside the main contract as a form of accountability for the consequences. The implementation of the real estate housing development cooperation agreement between the developer and the landowner does not contradict the principles of contract execution.
