Abstract

The purpose of this paper is to find out the efforts of the Religious Affairs Office (KUA) in maintaining a harmonious family in families with different religions based on the value of religious moderation. Basically, the KUA is an institution under the auspices of the Ministry of Religious Affairs that directly interacts in the scope of the community area. Where when Manik Maraja Village was dubbed as the village of religious moderation, due to the plurality of its citizens, both religion and ethnic culture. This is where the role of the KUA is needed in maintaining a harmonious family in families with different religious backgrounds based on the value of religious moderation. In describing this study in detail, it is formulated How does the value of religious moderation affect maintaining a harmonious family in families of different religions? How are the efforts of the KUA in maintaining harmonious families in families of different religions based on the value of religious moderation? The purpose of this formulation is to know the value of religious moderation influences in maintaining harmonious families in families of different religions, and to know the efforts of the KUA in maintaining harmonious families in families of different religions based on the value of religious moderation. The method used by the author in this research is qualitative with an empirical approach. The conclusion of this research is that the KUA is a very important institution in maintaining harmonious families in families of different religions based on the value of religious moderation as evidenced by the holding of various counseling with constructive material as well as direct interaction by religious and community leaders at events in Manik Maraja Village. This aims to achieve the maintenance of a harmonious family in families with different religious backgrounds.

Abstract

Determining the time limit for a missing heir is a crucial issue in Islamic inheritance law and Indonesian legislation. In Islamic law, there are differing opinions among scholars regarding the waiting period for declaring a missing person deceased, ranging from four years to depending on the judge's ijtihad. Meanwhile, the Civil Code provides a provision of up to five years, while the Compilation of Islamic Law (KHI) does not explicitly regulate this, so judges play a crucial role in determining the status of missing. This research used a qualitative method with a case study approach at the Medan City Religious Court, through interviews with judges and a review of court decisions. The results show that judges determine the status of missing heirs by considering the circumstances of the disappearance, evidence, witnesses, and search efforts made by the heirs. Mafqud inheritances may not be distributed before legal certainty is achieved to protect their rights. In the era of the industrial revolution 4.0, digital technology also influences the process of determining mafqud, particularly through digital footprints, population data, and electronic evidence that can strengthen judges' considerations. However, technological advances also pose new challenges, such as the presence of digital assets in inheritances. Therefore, collaboration between Islamic law, Indonesian positive law, and the use of modern technology is necessary to ensure that the determination of mafqud status is fair, wise, and relevant to current developments.

Abstract

Penelitian ini bertujuan menganalisis tradisi nggalari hutang adat pada perkawinan Suku Karo dari perspektif Maqashid Syariah. Penelitian ini berfokus pada permasalahan di Desa Lausimomo, Kabupaten Karo, di mana muncul anggapan bahwa pernikahan dianggap tidak sah dan pasangan terasingkan jika tidak disertai upacara adat Karo. Sorotan utama adalah anggapan bahwa pernikahan tanpa adat sama dengan belum menikah. Metode yang digunakan adalah penelitian Kualitatif dengan pendekatan studi kasus. Analisis berfokus pada aspek hukum Maqashid Syariah, khususnya prinsip Hifdz al-Nasl (menjaga keturunan) dan Hifdz al-Mal (menjaga harta). Sumber data utama berasal dari informasi dan permasalahan yang ada di Desa Lausimomo mengenai tradisi dan anggapan ketidakabsahan pernikahan tanpa adat. Hasil penelitian menemukan bahwa pada awalnya, nggalari hutang adat sejalan dengan Maqashid Syariah karena mendukung Hifdz al-Nasl dengan tujuan menjaga dan memelihara proses hubungan pernikahan. Tradisi ini mengizinkan pasangan yang tidak mampu mengadakan adat di awal untuk menggantinya di lain waktu. Namun, seiring perkembangan zaman, tradisi ini mengalami pergeseran yang memberatkan. Nilai nominal hutang yang tinggi kini menyebabkan praktik tersebut tidak sejalan dengan Maqashid Syariah. Hal ini karena tidak terpenuhinya kebutuhan al-Hajiyat (sekunder) yang merujuk pada Hifdz al-Mal. Harta yang seharusnya menjadi kebutuhan utama rumah tangga terhalang oleh kewajiban hutang adat yang nominalnya tinggi.   Kata Kunci: Nggalari Hutang Adat, Desa Lausimomo, Maqashid Syariah.
