Abstract

Sanitasi lingkungan menjadi salah satu hal esensial dalam tatanan kesehatan masyarakat. Kualitas sanitasi lingkungan ini sejatinya merupakan manifestasi kesadaran masyarakat, kondisi kesadaran masyarakat yang tidak merata, mendudukan posisi kebijakan pemerintah menjadi aspek fundamental dalam mendukung hal tersebut. Hal ini selaras dengan pilar-pilar kesehatan masyarakat yang mendudukan kebijakan pemerintah menjadi salah satu pilarnya. Kebijakan pemerintah juga menekan peranan penting dalam menekan terjadinya kondisi-kondisi kesehatan yang tidak wajar, salah satunya stunting. Angka stunting yang fluktuatif dan variatif di berbagai daerah mendorong pemerintah untuk merumuskan kebijakan agar tercapai nirstunting secara merata. Penelitian ini akan berfokus pada pemetaan kebijakan pemerintah untuk menyelesaikan permasalahan stunting di Indonesia, dengan menggunakan penelitian yuridis normatif dilengkapi dengan pendekatan kebijakan, penelitian ini ditunjukkan untuk dapat mengevaluasi kebijakan mencegah stunting di Indonesia saat ini. Hipotesis dari penelitian ini menunjukan bahwa kebijakan pencegahan stunting belum bersifat inklusif dan terintegrasi antar kebijakan, sehingga revitalisasi dan rejuvenasi diperlukan segera untuk mengakselerasi tercapainya net zero stunting di Indonesia.

Abstract

Paris Agreement became a insiator of accelerating climate change in Indonesia, Indonesia have a policy named Green Growth Program that is program to accelerate economic recovery that can reduce poverty, social inclusion, environmental sustainability, and resource efficiency. Crucial issues regarding environmental sustainability and resource efficiency are green investment to energy transition. Criticism of programs that seek to solve the problem of green investment and energy transition is a policy that has environmental, social, and economic dimensions simultaneously, one of which is the carbon tax policy. Carbon tax which has a futuristic mission to accelerate the energy transition, especially coal energy, is an important part of the existence of the Indonesia Green Growth Program, The methods used in this article are normative juridical methods as well as statutory approaches, comparative approaches, and conceptual approaches. The discussion in this article will include: First, Energy Transition is gradual and sustainable with economic instruments. Second, discussion of procedural mechanisms, legal rules, and objectives to be achieved from the energy transition. The last is the correlation between Energy Transformation through Carbon Tax and the realization of the Indonesia Green Growth Program Based on the presentation that has been done, the conclusion of this article is in the form of a conceptual idea that the carbon tax mechanism is a correlated policy and has quite realistic prospects in the implementation of the Indonesia Green Growth Program in the environmental sector to achieveecological justice. Abstrak Paris Agreement menjadi sebuah insiator aksi perubahan iklim di Indonesia yang kemudian diaktualisasikan melalui Indonesia Green Growth Program Kebijakan tersebut merupakan sebuah program untuk melakukan percepatan pemulihan ekonomi yang dapat mengurangi kemiskinan, inklusi sosial, kelestarian lingkungan, serta efisiensi sumber daya. Permasalahan krusial mengenai kelestarian lingkungan dan efisiensi sumber daya adalah investasi hijau dan transisi energi. Konkritisasi terhadap program yang berusaha menyelesaikan permasalahan investasi hijau dan transisi energi adalah sebuah kebijakan yang berdimensi lingkungan, sosial, dan ekonomi secara bersamaan, salah satunya adalah kebijakan pajak karbon. Pajak karbon yang memiliki misi futuristik akselerasi transisi energi khususnya energi batu bara menjadi sebuah bagian penting dari keberadaan Indonesia Green Growth Program, Metode yang digunakan dalam artikel ini adalah metode yuridis normatif serta pendekatan perundang-undangan, pendekatan komparasi dan pendekatan konseptual. Pembahasan dalam artikel ini akan meliputi: Pertama, Transisi Energi secara bertahap dan berkelanjutan dengan alat ukur instrument ekonomi. Kedua, pembahasan terhadap mekanisme prosedural, aturan  hukum, serta tujuan yang akan dicapai dari transisi energi tersebut. Serta yang terakhir adalah korelasi antara Tranisisi Energi melalui Pajak Karbon dengan realisasi Indonesia Green Growth Program Berdasarkan pemaparan yang telah dilakukan, kesimpulan dari artikel  ini berupa sebuah gagasan konseptual bahwa mekanisme pajak karbon merupakan sebuah kebijakan yang korelat serta memiliki prospek yang cukup realistis dalam implementasi Indonesia Green Growth Program dalam bidang lingkungan demi tercapai keadilan ekologis.

Abstract

Natural resources are one of the crucial objects in the dynamics of the life of the nation and the state, the management of this abundant natural resource is a very large responsibility of the state, the limitation of the state's ability is inversely proportional to the needs and potentials possessed by these natural resources so that the state makes natural resources as its business commodity in the utilization and management of natural resources. Business actors engaged in the utilization and management of natural resources need to compete with each other in order to obtain permits from the government and ease of investment, so that they can maximize the potential profits they have. This situation creates conditions for political lobbies so that the governing law can be adjusted to provide convenience for investors, one of which is the Mineral and Coal Law. This research will focus on examining the dynamics that occur to all stakeholders in the revision of the Mineral and Coal Law, by using a normative juridical research method using a legal and regulatory approach, so this research tries to map political strategies, political actors, and influencing factors. This research navigates to the hypothesis that the Mineral and Coal Law is a law oriented to business interests, so that environmental management and protection as a result of exploitation of natural resources is not optimal and futuristic.

Abstract

The potential of coastal areas through coastal and marine ecosystems is very important to minimize the increase in carbon emissions by becoming a means of carbon absorption through the blue carbon mechanism. Blue carbon has the potential because of its role in carbon sequestration to minimize the impact of the climate crisis. Unfortunately, the potential of blue carbon through coastal areas is not in line with policies that do not manifest optimal environmental optimization. To maximize the potential of blue carbon and protect coastal ecosystems, it is necessary to reorient derivative policies and revoke policies that have the potential to threaten coastal ecosystem areas. The method used in this study is normative juridical, with a policy approach and a conceptual approach. This research is based on the hypothesis that the central government demonstrates insufficient resolve about determining and implementing efforts to optimize coastal areas, with an economic orientation that emphasizes coastal ecosystems leading to policy directions towards exploitation rather than conservation. Thus, the direction of the blue carbon policy is expected to be synchronous and optimal to explore the potential of Indonesia’s coastal areas and contribute to significantly reducing the impact of the climate crisis.
