Abstract

The existence of traditional markets has had a positive impact on the welfare of the community. However, its development has an impact on the need for adequate and safe parking facilities for all market users. This study aims to determine how law enforcement is carried out on the management of traditional markets without parking lots. In today's era, the role of markets is very central to the national economy. This normative empirical study concludes that the management of parking lots in traditional markets at the research location still requires more intensive law enforcement so that it can reduce friction between market parking users, including road users. This requires consideration of the fulfillment of 5 law enforcement factors so that its management is in accordance with the law and fulfills a sense of justice for all parties.

Abstract

This research was conducted to determine the authority of local governments in determining and utilizing abandoned land in the field based on Government Regulation Number 20 of 2021 (PKTL 2021). This sociological legal research, using a legislative approach, a conceptual approach, and a case approach, collected data through interviews and direct observation. The issuance of Government Regulation Number 18 of 2021 concerning registration in order to obtain land certificates as a replacement for Government Regulation Number 24 of 1997 concerning land registration, which regulates the transfer of land rights. The problem that arises is that land that has been abandoned and unused for a long time, and has been determined and utilized by the local government, turns out to have an owner. Therefore, community members who hold land rights but do not yet have a certificate should apply for a land certificate as legal ownership and have the power of proof as stipulated in the provisions of the law, regarding land certificates.
