Abstract

Many children are now involved in criminal acts, including theft, so the solution needs to be done through diversion. The aim of the research is to understand and analyze the application of diversion to children as perpetrators of criminal acts in the jurisdiction of the Jambi City Resort Police and the obstacles in criminal law in the application of diversion to children as perpetrators of criminal acts in the jurisdiction of the Jambi City Resort Police. For this reason, this research uses a legal sociology approach with an activity design for 6 months whose scope or object in this research focuses on the application of diversion to children who are perpetrators of criminal acts of theft in the Jambi New City Sector Police. The main materials and tools used in this research are primary legal materials that come from the field and secondary legal materials that come from the library, then the place used in this research is the Jambi New City police sector so that the data collection technique is in the form of direct interviews with respondents. which produces an analysis technique, namely qualitative analysis. The results of this research are that diversion has not been applied to children as perpetrators of criminal acts by the Jambi City Resort Police, but there are still several obstacles so that diversion is often failed in achieving this and obstacles in implementing diversion against children as perpetrators of criminal acts of theft in the jurisdiction of the Sector Police. Kota Baru Jambi is where the victim does not want to carry out diversion because they still prioritize the deterrent effect on the perpetrator.

Abstract

The phenomenon of black magic is still a topic of discussion in Indonesia and is believed to still exist, even though it is regulated in Article 252 of Law No. 1 of 2023 concerning the Criminal Code. However, there are no specific procedural legal regulations governing the crime of black magic, making it difficult to reveal it based on the old Criminal Procedure Code. The research method applied in this study is the legislative approach, with an activity plan that lasts for six months. The scope or object of study in this study is the criminal law policy related to the regulation of black magic practices in Criminal Law in Indonesia. The main legal sources used include primary legal materials such as Law Number 1 of 2023 concerning the Criminal Code, secondary legal materials consisting of books and articles by legal experts and tertiary legal materials used include encyclopedias and other publications relevant to this research. The location of this research is Indonesia so that the data collection technique used is document study, while the analysis technique applied is qualitative analysis. The results of this study are that the current legal policy for regulating black magic practices is that the regulation regarding this matter has been regulated in material law, namely Article 252 of Law Number 1 of 2023 concerning the Criminal Code. Furthermore, the legal policy regarding the regulation of black magic practices in the future requires formal law or procedural law that regulates investigation and inquiry procedures. Thus, this black magic case can be enforced and the perpetrators can be subject to appropriate criminal sanctions.

Abstract

The rise in cases of violence against children in Jambi City is a concerning issue, deeply rooted in family dysfunction, economic pressure, and poor parenting. This phenomenon demands serious attention and comprehensive efforts involving firm law enforcement, strengthening family resilience through various support programs, increasing public awareness through ongoing education, and implementing effective early intervention. This study seeks to delve deeper into the root causes of this violence, identify the most relevant countermeasures, and analyze the various obstacles that hinder response efforts. By utilizing primary and secondary data, and applying in-depth qualitative analysis methods at the Jambi City Women and Children Protection Office, this study is expected to provide constructive recommendations to protect children from all forms of violence. The results indicate that the increase in violence against children in Jambi City is caused by economic, environmental, cultural, and educational factors. Preventive efforts include vitamin programs, outreach, and law enforcement, but obstacles such as family shame and a lack of resources remain.

Abstract

The occurrence of criminal acts of prostitution and immoral acts in the city of Jambi is currently widespread. This can also be proven by the existence of cases of prostitution at OYO accommodation located in the city of Jambi. Even though there is Jambi City Regional Regulation Number 2 of 2014 on the Eradication of Prostitution and Immoral Acts, in reality there is still prostitution in the city of Jambi even though the local area has been closed. The aim of this research is to understand and analyze the factors that influence people to commit prostitution and immoral acts in Jambi City, obstacles in implementing the effectiveness of Jambi City Regional Regulation Number 2 of 2014 in Eradicating Prostitution and Immoral Acts in the Jambi City area and efforts to overcome obstacles in reducing the number of prostitution and immoral acts in the Jambi city area. The research method is an empirical juridical research type with a legal sociology approach and uses data sources, namely primary legal materials and secondary legal materials. The sampling technique was purposeful sampling and data collection techniques were carried out using interviews and document studies and data analysis was carried out using qualitative analysis. The results of his research are that the factors that influence people to commit prostitution and immoral acts in Jambi City are economic and lifestyle factors, a profitable prostitution business, teenagers having broken home family backgrounds and joining the wrong social groups, the existence of hotels and nightclubs or club. The obstacle in carrying out the effectiveness of Jambi City Regional Regulation Number 2 of 2014 in Eradicating Prostitution and Immoral Acts in the Jambi city area is that criminal sanctions are categorized as light and not as a coercive tool to ensnare perpetrators of prostitution, there is no special authority for the police to carry out criminal sanctions in the Regional Regulation. , there was a leak of information during the raid, the condition of the Youth and Women's Social Home in Talang Bakung was still worrying as it could become a rehabilitation place for prostitutes, there was resistance from the community around the prostitution localization to close the prostitution localization, there was foreign culture coming in such as promiscuity. An effort to overcome obstacles in reducing the number of prostitution and immoral acts in the Jambi city area is that the Jambi City Government closes down the localization of prostitution in the city of Jambi, then carries out socialization of Regional Regulation Number 2 of 2014 to the people of Jambi city, the Jambi city government and the Jambi City Civil Service Police Unit. coordinating with the TNI and Polri in carrying out raids as well as the role of the community or parents in supervising their children when using cellphones.

Abstract

Prisons are a place to develop prisoners so that when they leave the prison the prisoner will no longer commit a crime. However, in reality, in prisons there have also been criminal acts committed by the prisoners themselves, namely criminal acts of abuse between prisoners. The research method used in this research is using a legal sociology approach with an activity plan for 6 months and the scope of this research is criminal acts committed by prisoners in prison. The materials used in this research are primary legal materials and secondary legal materials. The place used in this research is the Class II B Jambi Correctional Institution. The data collection technique is in the form of interviews and the analysis technique is qualitative analysis. The results of the discussion of this research are that severe disciplinary penalties have not been strictly enforced against inmates who commit criminal acts of abuse and the obstacles are the small number of prison security officers, the lack of interest of prisoners in participating in coaching programs and the facilities and infrastructure which are still limited.
