Abstract

Abstrak Mahkamah Agung melakukan suatu upaya untuk mengatasi hambatan penyelesaian perkara di Pengadilan dengan membuat suatu mekanisme baru yang disebut dengan gugatan sederhana. Prosedur tentang gugatan sederhana diterbitkan dalam PERMA Nomor 2 Tahun 2015 sebagaimana diubah dengan PERMA Nomor 4 Tahun 2019 tentang Tata Cara Gugatan Sederhana. Gugatan sederhana hanya diperuntukan khusus bagi perkara yang memenuhi syarat-syarat yang ditentukan dalam PERMA tersebut. Salah satu perkara yang menggunakan prosedur gugatan sederhana dalam proses beracara terdapat dalam kasus dengan Nomor Putusan 1/Pdt.G.S/2020/PA.Cms yang pada intinya Tergugat melakukan wanprestasi kepada penggugat PT. Bank BRI Syariah Cabang Ciamis. Penelitian ini bertujuan untuk mengetahui bagaimana prosedur sengketa gugatan sederhana pada akad murabahah serta untuk mengetahui bagaimana pertimbangan hakim dalam memberikan putusan di Pengadilan Agama Ciamis. Metode yang digunakan dalam penelitian ini adalah penelitian normatif, kemudian dilanjutkan dengan menganalisis bahan hukum dengan analisis kualitatif yang menghasilkan data deskriptif-kualitatif. Hasil dari penelitian ini menyimpulkan bahwa penerapan PERMA dalam putusan di Pengadilan Ciamis belum sesuai dengan ketentuan jangka waktu yang telah diberikan. Namun, pertimbangan hukum hakim sudah tepat dalam memutus perkara. Pertimbangan hukum hakim mengacu pada pembuktian secara tertulis yang diberikan oleh Penggugat sehingga Penggugat dapat memenangkan perkara ini dengan mendapatkan hak untuk menjual jaminan yang telah diajukan oleh Tergugat. Kata kunci: gugatan sederhana; putusan; pembuktian Abstract The Supreme Court made an effort to overcome obstacles to resolving cases in court by creating a new mechanism called a small claims court. Procedures regarding small claims courts issued in PERMA Number 2 of 2015 as amended by PERMA Number 4 of 2019 on Procedures for Small claims courts. Small claims courts are only specifically intended for cases that meet the requirements specified in the PERMA. One of the cases that uses the small claims court procedure in the proceedings is in case with Decision Number 1/Pdt.G.S/2020/PA.Cms where in essence the Defendant committed a breach of contract against the plaintiff PT. Bank BRI Syariah Ciamis Branch. This research aims to find out the procedure for settling small claims courts in murabahah contracts and to find out how judges consider when making decisions at the Ciamis Religious Court. The method used in this research is normative research, then continued by analyzing legal materials with qualitative analysis which produces descriptive-qualitative data. The results of this research conclude that the application of PERMA in the Ciamis Court decision is not in accordance with the provisions of the time period that has been given. However, the judge's legal considerations were correct in deciding the case. The judge's legal considerations refer to the written evidence provided by the Plaintiff so that the Plaintiff can win this case by getting the right to sell the collateral that has been submitted by the Defendant. Abstract

The rapid expansion of e-commerce has significantly altered the global trade landscape, presenting legal challenges and opportunities, particularly in cross-border transactions. Arbitration has emerged as an effective mechanism for resolving e-commerce disputes, due to its enforceability and flexibility. The intersection between arbitration and e-commerce necessitates immediate attention as electronic signatures, digital contracts, and remote proceedings become more common. This study employed a normative legal approach to evaluate the arbitration frameworks of Indonesia and Taiwan in the context of e-commerce disputes. While Law No. 19 of 2016 on Electronic Information and Transactions (ITE Law) supports Indonesia's legal system, it lacks specific provisions on arbitration for digital commerce, particularly in international contexts. In contrast, Taiwan exhibits a more comprehensive system integrating its Electronic Signatures Act with arbitration practices, enabling a more significant adaptation to technological advancements. While Taiwan's Arbitration Act does not explicitly regulate remote hearings, the Code of Civil Procedure and Judicial Yuan's pertinent regulations permit remote hearings, video conferencing, and electronic evidence submission, thereby guaranteeing continuity and efficiency, particularly during the COVID-19 pandemic. According to this investigation, Taiwan's institutional and procedural preparedness for digital dispute resolution is more advanced. To augment its e-commerce arbitration skills, Indonesia must integrate digital technologies and address regulatory gaps within its arbitration system. The comparative research provides a distinct viewpoint on how both nations might mutually benefit from enhancing legal clarity, effectiveness, and cross-border enforceability within the digital economy.

Abstract

The growth of Islamic financial assets in Indonesia reached IDR 2,450.55 trillion in June 2023, with a market share of 10.94% of the total national finance. Islamic banking institutions, particularly those offering financing based on sale and purchase agreements like murabahah, are crucial in expanding financial inclusion and providing Sharia-compliant financial solutions. ‘Aisyiyah, as part of the Muhammadiyah women's movement, plays a significant role in community empowerment, including enhancing knowledge of Islamic financing. This study aims to strengthen the understanding of murabahah financing among the ‘Aisyiyah Banguntapan 4 community, particularly in addressing misconceptions and reducing reliance on usurious transactions. The implementation method in this community service activity consisted of three stages: preparation, implementation, and evaluation. The implementation stage included educational sessions in the form of material presentation, discussions, and legal analysis of murabahah financing, conducted at the partner location with 50 participants. Evaluation was carried out to assess the effectiveness and impact of the program on participants’ knowledge. Data collection methods were through interviews, surveys, and direct engagement with community members. The results indicate a notable improvement in participants' comprehension of Law No. 21 of 2008 on Sharia Banking (45.5%), MUI Fatwa on Usury (51%), DSN MUI Fatwa on Murabahah (50.5%), sharia-based economic transactions (50%), and the concept and implementation of murabahah financing (50.5%). These findings highlight the effectiveness of educational efforts in enhancing public awareness of Islamic financial principles, thereby fostering financial literacy and reducing dependence on non-sharia-compliant transactions.

Abstract

Sharia insurance (at-Takāful) is founded on the principle of mutual assistance (at-Takāful al-Ijtimā ‘ī), yet existing models often fail to ensure equitable outcomes. Most contemporary Sharia insurance practices rely on hybrid contracts (multi-ʿaqd), combining ʿAqd Tabarru‘ (charitable contribution) and ʿAqd Muḍārabah (profit-sharing). However, these approaches have limitations in achieving social justice. This study examines the integration of Waqf and Mushārakah models as alternative solutions to enhance fairness in Islamic insurance. While Indonesia’s Takāful system predominantly uses traditional hybrid contracts, Malaysia employs a more advanced Takāful framework, incorporating Waqf and Mushārakah to strengthen social justice and economic sustainability. Using a normative legal research approach, this study employs a doctrinal approach and compares Indonesian and Malaysian Takāful structures, analyzing the legal and economic implications of adopting Waqf and Mushārakah in Sharia insurance. The findings suggest that the Waqf model aligns with Islamic economic objectives such as poverty alleviation (raf‘ al-faqr) and wealth distribution (taqwīm al-tharwah), while Mushārakah fosters cooperative principles and equitable profit-sharing (al-ta‘āwun wa al-‘adālah al-māliyah). The study concludes that integrating Waqf and Mushārakah into Indonesia’s Sharia insurance system can enhance Takāful Ijtimā‘ī principles and promote greater financial justice in accordance with the Maqāṣid al-Sharī‘ah.
