Abstract

Penelitian ini memiliki tujuan untuk mengetahui pengaruh kompensasi dan turnover intention terhadap kinerja karyawan PT Jombang Intermedia Pers. Jenis penelitian ini adalah explanatory research yang menjelaskan atau membuktikan hubungan atau pengaruh antar variabel independen dan dependen. Penelitian ini menggunakan sampel sebanyak 17 responden dimana penyebaran kuesioner dilaksanakan pada karyawan PT Jombang Intermedia Pers. Pengambilan sampel menggunakan teknik sampel jenuh karena jumlah sampel kurang dari 30 responden. Analisis data menggunakan analisis regresi linier berganda dengan menggunakan SPSS versi 24. Hasil analisis dalam uji T diperoleh kesimpulan bahwa kompensasi tidak berpengaruh secara signifikan terhadap kinerja karyawan PT Jombang Intermedia Pers dan Turnover Intention berpengaruh secara signifikan terhadap kinerja karyawan PT Jombang Intermedia Pers. Sedangkan berdasarkan hasil uji F diperoleh hasil bahwa signifikan lebih kecil dari 0,05, sehingga kompensasi dan Turnover Intention bersama-sama berpengaruh secara signifikan terhadap kinerja karyawan PT Jombang Intermedia Pers. Hasil tabel model Summary perhitungan yang diperoleh, angka R atau koefisien determinasi sebesar 0,835 menunjukan bahwa korelasi atau hubungan antara kinerja karyawan dengan dua variabel bebas dalam kategori kuat.

Abstract

Background. The legal status of nikāh sirri (secret or unregistered marriage) is controversial because it is not announced and not officially recorded. The views of scholars on secret marriage and the factors causing it, as well as the legal regulations in force in Indonesia, need to be studied. Aim. Examines nikāh sirri from the perspective of maqāṣid asy-syari’ah, which includes five essential goals of Islamic law: the maintaining religion (hifẓ ad-dīn), soul (hifẓ an-nafs), descendants (hifẓ an-nasl), property (hifẓ al-māl), and reason (hifẓ al-’aql). Method. This research utilizes a literature review with a descriptive-analytical approach to Islamic jurisprudence and relevant regulations. Result. Nikāh sirri causes more harm (mafsadat) than benefit (maslahat), particularly concerning the rights of wives and children in inheritance, financial support, and legal protection. Based on maqāṣid asy-syari’ah, nikāh sirri is considered impermissible (haram) due to its adverse effects on mental well-being, economic instability, and threats to legitimate lineage. The formal registration of marriage is crucial for ensuring the protection of family rights.

Abstract

Corporate social responsibility is a program dedicated to the interests of humanity and the environment and is intended to promote human beings, especially those around Environmental sustainability, especially where the company is operated. Corporate Social Responsibility is a concept relevant to the economic values of Islam in the point of view of the Mainstream sect. Researchers divide it into 3 principles, as follows: 1) Corporate Social Responsibility is faced with the principle of compound ownership (Multitype ownership) is relevant to the value of ownership (ownership) and the value of balance (equilibrium). Ownership values include private property and collective ownership. The balance value in terms of balance between right and obligation should be in care. Both of these values are derived from the value of Unity of God. 2) Corporate Social Responsibility if connected with the principle of freedom of action/endeavor (freedom to act) is to the company with the community that belongs to the concept of Khalifat That implies unity and brotherhood. Such freedom is in the context of economic freedom that corresponds to Sharia. 3) Corporate Social Responsibility Judging by the social Justice principles (social Justice) is demonstrated through its identity as part of the company's business ethics in which it applies the principle of fairness. Because in its implications, CSR emphasizes the concept of 3 P (profit, people, and planet) interrelated.

Abstract

Background. This research is intended to provide an analysis of Ikhiyariyah wills in the perspective of the maqashid Syariah Imam Al Syathibi (a case study in Gondangmanis Village, Bandarkedungmulyo District, Jombang Regency). The main problems are 1). What is meant by a khiyariyah will according to the scholars? 2). What is the khiyariyah will according to maqashib Imam Al Syathibi? Aim. After conducting an in-depth analysis, it was found that in terms of the obligatory testament, the maqashid perspective of Imam Al Syathibi and the opinions of the clergy and practice in Gondangmanis Village are in line. The opinion of the scholars stated that giving a mandatory will to adopted children or adoptive parents and not to the heirs. In Imam Al Syathibi's thought, the general rule of the first maqasid formulation is that the Shari'a is made to safeguard the benefit of the servant, both the benefit in this world and the benefit in the hereafter. The benefit of this servant includes benefit at the primary (dharuriyyat), secondary (hajiyat) and tertiary (tahsiniyyat) levels. Once the khiyariyah will that occurred in Gondangmanis Village was carried out for the benefit. Methods. In discussing this problem the research method used is qualitative research and this type of research is field research using a phenomenological approach to qualitative research which does not require in-depth knowledge of the literature used and certain abilities on the part of the researcher. Results. In terms of determining the number of levels of khiyariyah wills that will be obtained for those who are entitled to receive them, the ulama and the realization in Gondangmanis Village tend to be the same, namely a maximum of one third (1/3). According to maqashid Imam Al Syathibi, this is appropriate for the benefit of making Islamic law. This is done so that disharmony does not occur in the family and still maintain social relations between them.

Abstract

Background. The issue of gender equality that arises essentially lies in human rights (al-kulliyyât al-Khaimah), by placing more equality before the law as the core of equality of opportunity, spreading in the aspect of women's testimony before the law. For this reason, it is important to underline that the main problem of testimony is inseparable from gender. Aim. This research focuses on women's testimony to Islamic law and the Civil Code. Methods. Using comparative techniques with descriptive analysis, the following research results were obtained: the status and position of women as witnesses in religious courts from the point of view of Islamic law, the status of the testimony of one man is the same as that of two women. Results. The point of the difference is not to doubt the ability of women, it's just because in the business world that is done during the day until night men should do the signing and testimony of all kinds of business. Suppose there is a woman who is a witness. In that case, she must have an additional woman who serves to strengthen the testimony they do, because it could be that at any time one of the two is unable to attend to give testimony or has forgotten the object he witnessed in the past. The equal value of male and female testimony in the Law of Civil Procedure in Religious Courts is because the witness is positioned as one of the evidence, the task of witnesses in civil procedural law is to prove the existence or absence of something legal action. In short, if the witness is positioned as a pillar, it must follow as specified in the Qur'an.
