Abstract

Child marriage remains a persistent legal and social challenge in Indonesia, despite legal reforms that have raised the minimum age for marriage. The Office of Religious Affairs (KUA) plays a strategic role in preventing child marriage through the provision of pre-marital counselling, particularly through the Marriage Counselling (Bimwin) and School-Age Youth Counselling (BRUS) programmes. This study aims to critically analyse legal protection for children through the model of pre-marital counselling service management in the context of child marriage, as well as the extent to which pre-marital counselling functions as a legal protection tool for children when evaluated through the framework of Islamic family law. The research method employed was descriptive qualitative analysis based on a socio-legal approach, with data selected from the KUA offices in Ajung, Pakusari, and Sumbersari in Jember Regency through observation, in-depth interviews, and documentary analysis. The research findings indicate that the model of pre-marital course practices at the KUA in cases of child marriage is not yet optimal in helping to fulfil children’s rights, as the substance of the material and the service management model remain general in nature and are insufficient in integrating issues of children’s rights and the protection of offspring into programmes for school-age youth guidance and marriage counselling. From the perspective of Islamic family law, this situation indicates that the realisation of the objectives of maqāṣid al-syarī‘ah, particularly ḥifẓ al-nafs and ḥifẓ al-nasl, has not been optimal. This article emphasises the need to reformulate the management of pre-marital courses so that they are preventive, contextual, and in line with the principles of child protection in Islamic family law. Keywords: child marriage, Office of Religious Affairs (KUA), pre-marital counselling, maqāṣid al-Syarī‘ah, islamic family law.

Abstract

The enactment of the 2026 Indonesian Criminal Code marks a significant transformation in the national legal system, including the introduction of criminal sanctions for unlawful polygamous marriages. This article examines the construction of state criminal law in the criminalization of unlawful polygamy within Indonesia's contemporary criminal policy through the lens of maqāṣid al-Sharīʿah. Employing normative legal research that combines doctrinal legal analysis with a maqāṣid-based approach, the study argues that the criminalization of unlawful polygamy constitutes a form of state-led ijtihād grounded in the objectives of Islamic law and embedded within modern criminal justice policy. Rather than prohibiting polygamy as a lawful institution under Islamic law, the legislation targets unauthorized and fraudulent polygamous marriages that undermine legal certainty, gender equality, and family protection. This approach reflects a shift from formal textual legality toward a substantive legal paradigm centered on the protection of human dignity and social justice. From the perspective of maqāṣid al-Sharīʿah, the criminalization of unlawful polygamy aligns with the objectives of safeguarding lineage (ḥifẓ al-nasl), human dignity (ḥifẓ al-ʿirḍ), and public welfare (maṣlaḥah). The findings demonstrate that maqāṣid provides a dynamic framework for contemporary ijtihād, enabling the harmonization of Islamic law and national law while legitimizing modern criminal law as an instrument for realizing the higher objectives of the Sharīʿah. Although debates surrounding the criminalization of polygamy often stem from a reductionist understanding of Sharīʿah as a fixed body of permissive norms, this article contends that criminal sanctions against unlawful polygamous marriages are not inherently inconsistent with Islamic law. Their legitimacy depends on adherence to the principles of proportionality, due process, and judicial discretion in criminal law enforcement. By moving beyond the conventional dichotomy between permissibility and prohibition, this study contributes to contemporary Islamic legal scholarship by offering a maqāṣid-oriented reconceptualization of the relationship between state authority, criminal legislation, and Islamic normativity.

Abstract

The social environment plays a strategic role in character formation through indirect educational mechanisms-often referred to as the "hidden curriculum." From an Islamic educational perspective, the presence of religious symbols and messages in public spaces serves as a medium for internalizing Islamic values outside of formal educational institutions. This study aims to examine the function of the social environment as a hidden curriculum for Islamic education by analyzing religious symbols and written messages found in various public spaces across Cairo. Adopting a qualitative approach utilizing phenomenology, the study gathered data through observation, in-depth interviews, and documentation at various public locations. The data were analyzed using Clark Moustakas’s phenomenological approach, supported by triangulation, member checking, and peer debriefing to ensure credibility. The findings reveal that religious symbols-such as calligraphy, Quranic verses, supplications do'a, and invocations dzikr displayed on public transport, private vehicles, and in commercial spaces-serve not merely as markers of religious identity but also as educational media that continuously instill Islamic values. Through processes of interaction, interpretation, and habituation, these symbols foster religious consciousness and encourage the strengthening of faith aqidah, acts of worship, spiritual experiences, Islamic understanding, and behavior aligned with Islamic teachings.
