Abstract

Abstract: As a country with a Muslim majority population, Indonesia needs a guarantee of the halal products they will consume. This is because halal products are a necessity for every Muslim. In Law Number 33 of 2014 concerning Guarantees for Halal Products, Indonesian Muslim consumers have received guarantees for the halal products they consume. This is because the JPH Law contains rules related to halal certification, halal labels, and non-halal information. One of those responsible for halal products, of course, is the business actor as a producer. So this research is intended to determine the level of legal awareness of these business actors, namely to certify the products they distribute. This research is normative legal research; because the primary legal material is secondary data. Data collection and analysis techniques were carried out using a technical literature review. The study results show that the level of legal awareness of business actors regarding the obligation of halal-certified products is shallow. This is because business actors need to meet these four indicators, from legal knowledge, understanding, and attitudes to patterns of legal behavior.Keywords: Legal Awareness; Businessmen; Halal Product Guarantee Abstrak Sebagai negara dengan penduduk mayoritas muslim, tentunya Indonesia membutuhkan jaminan kehalalan produk yang akan mereka konsumsi. Hal ini dikarenakan produk halal merupakan kebutuhan bagi setiap muslim. Dalam Undang-Undang Nomor 33 Tahun 2014 tentang Jaminan Produk Halal, konsumen muslim Indonesia telah mendapatkan jaminan kehalalan produk yang dikonsumsinya. Sebab, UU JPH memuat aturan terkait sertifikasi halal, label halal, dan informasi nonhalal. Salah satu yang bertanggungjawab atas produk halal, tentunya adalah para pelaku usaha sebagai produsen. Sehingga penelitian ini dimaksudkan untuk mengetahui tingkat kesadaran hukum pelaku usaha tersebut, yakni untuk mensertifikasi produk yang mereka edarkan. Penelitian ini adalah penelitian hukum normatif; karena bahan hukum primernya adalah data sekunder. Teknik pengumpulan dan analisis data dilakukan dengan teknis literature review. Hasil penelitian menunjukkan, bahwa tingkat kesadaran hukum para pelaku usaha terhadap kewajiban produk bersertifikat halal sangat rendah. Pasalnya, mulai dari aspek pengetahuan hukum, pemahaman hukum, sikap hukum, sampai pola prilaku hukum, para pelaku usaha tidak memenuhi keempat indikator tersebut.Kata Kunci: Kesadaran Hukum; Pelaku Usaha; Jaminan Produk Halal

Abstract

Divorce has a significant impact on children, particularly concerning the fulfillment of their custody, financial support, and psychosocial well-being. This study analyzes legal policies on the protection of children's rights after divorce in indonesia, malaysia, and singapore through a comparative law approach. Using normative and empirical juridical methods, this research examines existing legal regulations and the effectiveness of their implementation based on court case data, divorce statistics, and interviewxs with legal experts. The findings indicate that while all three countries have regulations ensuring children's rights post-divorce, gaps remain in their implementation. In indonesia, weak enforcement mechanisms for child support lead to many children losing their financial entitlements. Malaysia’s dual legal system (sharia and civil) sometimes delays the execution of child support rights. Meanwhile, singapore has developed an integrated system with a therapeutic justice approach, including mandatory mediation and more effective enforcement mechanisms. This study recommends establishing a child support enforcement unit in indonesia, harmonizing legal procedures in malaysia, and enhancing psychosocial support programs in singapore. Legal reforms incorporating best practices from these three countries are expected to improve the protection of children's rights after divorce.

Abstract

Legal provisions regarding leasing as regulated in article 1548 of the Civil Code which reads "An agreement, by which one party binds himself to provide the enjoyment of an item to another party for a certain time, with the payment of a price that the latter party can afford" , by which one party binds himself to give the other party the enjoyment of an item, for a certain time and payment of a price, which the latter party has agreed to pay. Therefore, a legal relationship arises, namely a vehicle rental agreement. It was then explained that the length of the lease depends on the agreement by both parties as outlined in the contents of the agreement as regulated in Article 1338 paragraph (1) B.W., which reads: "All agreements made legally apply as law for those who make them". Debtor default disputes in car rental rental agreements are examined by the legal relationship between the parties involved. This research uses an empirical juridical legal research approach in analyzing problems that have been formulated by combining both primary and secondary legal materials. The results of this research are to find out further processes in resolving Debtor default disputes in car rental rentals. The designation of the parties in a car rental lease is usually for the renting party to be called the debtor and the renting party as the creditor. If there is a dispute over non-compliance with the rental car rental, this will be done through deliberation/peace (non-litigation) by the creditor and debtor.
