Abstract

This study aims to build a healthy political and legal life and democratization based on the elements and sources of truth of the epistemological values of Pancasila. This study needs to be studied because the development of political and legal life in Indonesia today is increasingly unstable in political dynamics. The law which is considered as the commander of the state, is now weakened in order to perpetuate or smooth the power of individuals or groups of people in politics, there is a lot of corruption, collusion, and nepotism (KKN). The increasingly complex political and legal dynamics are increasingly moving away from the values of Pancasila. The research method used is a qualitative descriptive method with a historical and philosophical approach. The results of the study show that the dynamics of politics and law in Indonesia are not running healthily and democratically because they are not built on the values of Pancasila as the basis of the State. Politics and law are now built on the ambition of group and individual power so there is a lot of corruption, collusion, and nepotism (KKN). The conclusion of this study is to try to uncover the ideas, sources, origins, and essence of knowledge from the values of Pancasila as the nation's ideology and apply them to the dynamics of political and legal life in Indonesia. These values are divinity, humanity, unity, democracy, human rights, justice, certainty, and the benefits of law. Penelitian ini bertujuan untuk membangun kehidupan politik dan hukum yang sehat dan demokratisasi yang berdasarkan pada unsur dan sumber kebenaran dari nilai-nilai epistemology Pancasila. Penelitian ini perlu dikaji karena perkembangan kehidupan politik dan hukum di Indonesia dewasa ini semakin labil dalam dinamika politik. Hukum yang dianggap sebagai panglima negara, kini dilemahkan demi melanggengkan atau memuluskan kekuasaan individu atau sekelompok orang dalam berpolitik, banyak terjadi korupsi, kolusi dan nepotisme (KKN). Dinamika politik dan hukum yang semakin kompleks ini semakin menjauh dari nilai-nilai Pancasila. Metode penelitian yang digunakan adalah metode deksriptif kualitatif dengan pendekatan historis dan filosofis. Hasil penelitian menunjukan bahwa dinamika politik dan hukum di Indonesia tidak berjalan dengan sehat dan demokratis karena tidak dibagun berdasarkan nilai-nilai Pancasila sebagai dasar Negara. Politik dan hukum sekarang dibagun atas ambisi kekuasaan kelompok dan Individu, sehingga banyak terjadi korupsi, kolusi dan nepotisme (KKN). Kesimpulan penelitian ini adalah berusaha membongkar ide-ide, sumber, asal, dan esensi pengetahuan dari nilai-nilai Pancasila sebagai ideologi hidup bangsa dan diaplikasikan ke dalam dinamika kehidupan politik dan hukum di Indonesia. Nilai-nilai tersebut adalah ke-Tuhanan, kemanusian, persatuan, demokrasi, hak asasi manusia, keadilan, kepastian dan kemanfaatan hukum.

Abstract

This study aims to analyze the function of the House of Regional Representatives of the Republic of Indonesia (DPD RI) in the legislative process and the checks and balances mechanism within Indonesia's constitutional system. The background of this research stems from the limited authority of DPD RI in the legislative process, especially when compared to the House of Representatives (DPR RI), despite its vital role as a regional representation body advocating for regional interests in law-making. The urgency of this writing lies in addressing the imbalance of power between the executive and the legislature, as well as between the central government and the regions. Using a normative legal research method, this article examines the role of DPD RI in the discussion of bills, its interactions with DPR RI, and its contributions to maintaining the checks and balances system. The findings indicate that the DPD RI faces significant challenges in influencing the legislative process, although opportunities exist for strengthening its role. The study concludes that legislative reforms and capacity building for DPD RI are crucial to enhance the effectiveness of the checks and balances mechanism, thereby strengthening Indonesia's democratic system. The novelty of this research lies in its emphasis on practical strategies for empowering DPD RI within the national legislative framework.
