Abstract

The purpose of this research is to provide justification that the campaign requirements for state officials as stipulated in Article 281 of the Election Law do not conflict with the principle of non-discrimination with the urgency of research that has the potential to produce injustice in the implementation of elections, namely the restriction of campaign participation by state officials so that it can affect the integrity of the electoral process or the political rights of citizens. The first requirement is not to use state facilities except security facilities and the second requirement is to leave outside state dependence.  These requirements only apply to state officials. This seems to show that the political rights possessed by every citizen are different. The nature of the campaign as a form of realization of citizens' political rights in participating in government should be owned by every citizen with the same opportunity. The research method used is a research with a legal approach, conceptual approach, case approach, and comparative approach. The novelty of this research is that it is the first time to review the norms of campaign requirements for state officials that are relevant to the principle of non-discrimination. The results show that the campaign requirements for state officials do not violate the non-discriminatory principle.  Tujuan penelitian ini adalah untuk memberikan justifikasi bahwa persyaratan kampanye bagi pejabat negara sebagaimana diatur dalam Pasal 281 UU Pemilu tidak bertentangan dengan prinsip non-diskriminatif dengan urgensi penelitian yang berpotensi menghasilkan ketidakadilan penyelenggaraan pemilu yaitu adanya pembatasan keikutsertaan kampanye oleh pejabat negara sehingga dapat mempengaruhi integritas proses pemilu atau hak-hak politik warga negara. Syarat pertama adalah tidak menggunakan fasilitas negara kecuali fasilitas pengamanan dan syarat kedua adalah cuti di luar tanggungan negara.  Persyaratan-persyaratan tersebut hanya diberlakukan bagi pejabat negara. Hal ini seolah menunjukkan bahwa hak politik yang dimiliki oleh setiap warga negara berbeda. Hakikat kampanye sebagai salah satu bentuk perwujudan hak politik warga negara dalam berpartisipasi dalam pemerintahan hendaknya dimiliki oleh setiap warga negara dengan kesempatan yang sama. Metode penelitian yang digunakan merupakan penelitian dengan pendekatan undang-undang, pendekatan konseptual, pendekatan kasus, dan pendekatan komparatif. Kebaharuan penelitian ini merupakan penelitian pertama kali yang meninjau norma persyaratan kampanye bagi pejabat negara yang direlevansikan dengan prinsip non-diskriminatif. Hasil penelitian menunjukkan bahwa persyaratan kampanye bagi pejabat negara tidak melanggar prinsip non-diskriminatif.

Abstract

This article proposes some suggestions to the government in renegotiating the Perth Treaty to provide a solution for a definitive maritime boundary between Indonesia and Australia. Renegotiation of the Perth Treaty in terms of maritime delimitation between the two countries needs to be done in relation to the limitation of sovereignty of both countries. This treaty has never been ratified by both countries after the signing in 1998. The fundamental reason of Australia is associated with the independence of Timor-Leste in 1999 so that the rebus sic stantibus principle then applies. This research employed legal method to provide recommendations to the government as a basis for renegotiating the Perth Treaty according to international law. It also used a statutory and case approach. There are underlying reasons for the urgency of renegotiating the Perth Treaty using the median line with an equidistance line approach. The median line in UNCLOS 1982 has proven to provide progressive results regarding the maritime delimitation of countries. However the decisions of the International Court of Justice, resulted in various side effects with the use of the median line as a single effort to resolve maritime delimitation disputes. Therefore, a new solution is proposed, namely the median line with an equidistance line approach as the most effective method to create justice for each party. The equidistance line in international law serves as a legal resolution method, emerging from customary practices. It is recognized as new customary law for resolving maritime delimitation disputes between countries. Harmonisation of the median line concept using the equidistance line approach in resolving maritime delimitation disputes between Indonesia and Australia is a new approach that can be used based on the successful harmonisation of these two concepts in resolving delimitation disputes globally.

Abstract

This research objective is to analyze Voluntary Restraint as a legal concept to limiting the veto used by P5 countries of United Nation Security Council (5 permanent member of UNSC) in settlement of mass atrocity case. This research is a normative juridical research that used conceptual and historical approach. Veto is used by P5 countries only for their benefits and national interest, even in cases that are clearly a serious violation of principles in UN and International community, and because of that the used of veto  must be limited. Voluntary Restraint is a legal concept that essentially limits or prohibits the veto use, especially in mass atrocity cases and this is in line with Jus Cogens principle, which is the peremptory norm that has been agreed by the international community including by the P5 countries. The findings of this research are that Voluntary Restraint is a Law itself and as a manifestation of the Jus Cogens principle. Ideally this concept should be a written norm in the UN charter, but this concept can be implemented or not is back to the commitment about world peace, international security and respect of Human Rights from the P5 countries itself.
