Abstract

Putusan majelis hakim dari beberapa perkara yang pokok permasalahannya sama tetapi di putus secara berbeda menimbulkan suatu spekulasi bahwa pemikiran hakim di indonesia cenderung majemuk, padahal putusan majelis hakim dapat di jadikan suatu Yurisprudensi / pedoman oleh hakim lainnya dalam memutus suatu perkara dimana perkara tersebut tidak di atur oleh undang undang, akan tetapi yang menjadi permasalahan pokok adalah ketika Yurisprudensi yang di anut oleh majelis hakim bertentangan dengan aturan hukum yang berlaku, terkadang dengan menggunakan konsep “ demi kemaslahatan “ majelis hakim di indonesia dapat mengingkari aturan hukum yang ada. Hal tersebut nampak pada label perempuan Nusyuz pada pasal 152 Kompilasi Hukum Islam, jika di liat dari analisa hukum agama dan Kompilasi Hukum Islam maka perempuan yang Nusyuz tidak berhak mendapatkan Iddah dan Mut’ah, akan tetapi dalam pandangan teori gender wanita nusyuz sekalipun berhak mendapatkan nafkah iddah dan Mut’ah, hakim yang memberikan nafkah iddah kepada wanita yang nusyuz ini dengan memandang kemaslahatan, sehingga penting sekali menggunakan metode pendekatan Roscoe Pound di harapkan mengetahui faktor faktor ( baik faktor hubunngan antar individu, faktor sosial maupun ekonomi ) yang membuat hakim membuat putusan dengan dasar kemaslahatan dimana hal tersebut yang tidak sejalan dengan aturan yang ada

Abstract

The approach of Maqosith Syariah Alal Al-Fashi towards sex by maturation done by married couples through Video Call because long-distance relationships are allowed because in terms of benefits, the law in maturation is still being debated so that ijtihad is needed in determining the law, maximizing reason as an effort of ijtihad is very important to know and weigh the benefits and harms of maturation done by married couples caused by long-distance relationships, so that by combining the theory of Maqosith Alal Al-Fashi, the theory of Islamic Progressive Law and by using the method of sociological empirical research will be obtained a result that Sex by maturation using Video Call due to long-distance relationships is allowed and has more benefits than harms, and the most important thing from this study shows that sex with maturation through Video call husband and wife will create harmony in the family.

Abstract

Deconstruction of Nur Holis Madjid's Thoughts "Islam Yes, Islamic Party No": Efforts to Answer the Reality of the Indonesian Islamic Party in the 2024 Election is an analysis of a Slogan of the Thoughts of the Muslim scholar Nur Holis Madjid which was coined in the 1970s at the Ismail Marzuki mini park in Jakarta its content classifies and criticizes Islam and Islamic Parties. This slogan has shocked the Indonesian world because of the pros and cons of this thought slogan, along with contemporary developments by looking at the existing reality that Islamic parties are now increasingly unable to compete with nationalist parties, so with this approach Concept will be able to analyze Nur Holis Majid's thoughts with the current situation regarding Islamic parties, so that with the Concept approach to Nur Holis Majid's thoughts we can answer why Islamic parties are increasingly lagging behind and by using a conceptual approach we can analyze the relevance of Nur Holis Majid's thoughts on the situation of political parties Contemporary Islam is increasingly not gaining the trust of the Islamic community itself.
