Abstract

World Trade Organization (WTO) terbentuk pada tahun 1995. WTO adalah organisasi antar pemerintah dengan tujuan untuk membuat perdagangan antar negara semakin terbuka dengan penurunan bahkan peniadaan hambatan tarif maupun non tarif. Indonesia merupakan salah satu anggota WTO. Salah satu produk unggulan Indonesia adalah  Nikel. Saat ini nikel dibutuhkan sebagai salah satu komponen dalam pembuatan Lithium-ion atau baterai listrik, Indonesia adalah salah satu negara terbesar penghasil nikel dunia, Pemerintah melalui amanat Undang-Undang Mineral serta Batubara No 4 Tahun 2009 beserta peraturan pelaksananya melakukan penghentian ekspor bijih nikel, Uni Eropa selaku penerima ekspor tersebut merasa berkeberatan sehingga melakukan gugatan ke WTO. Indonesia mengalami kekalahan pada putusan sidang tersebut. Dengan demikian Indonesia melakukan banding atas kekalahan tersebut. Sehingga Bagaimanakah Ketentuan yang berlaku dalam Hukum Perdagangan Internasional Terhadap Penghentian Ekspor Biji Nikel yang dilakukan secara sepihak oleh Pemerintah Indonesia terhadap Uni Eropa serta bagaimanakah seharusnya Pemerintah Indonesia menghadapi Gugatan terhadap pembatasan ekspor biji nikel terhadap Uni Eropa.

Abstract

The European Union (EU) issued a regulation on deforestation, known as the European Union Deforestation-Free Regulation (EUDR), which has caused upheaval in the global commodity industry. Starting December 31, 2020, the EUDR regulation enforces due diligence on companies placing goods linked to deforestation and forest degradation on the EU market. These goods include beef, chocolate, coffee, palm oil, rubber, soy, and timber. Under the EUDR, these seven commodities and their related products must meet requirements related to deforestation and forest degradation to be sold or exported to the EU market.According to Roscoe Pound, a legal expert from the Sociological Jurisprudence school of thought, law should be viewed as a social institution that functions to meet societal needs. He argued that the task of legal science is to develop a framework that maximizes the fulfillment of social needs so that the law can serve as a means of social change. Therefore, a legal study on the application of the EUDR to Indonesia's trade with the EU should assess whether it aligns with the principles of law formation according to Roscoe Pound's Sociological Jurisprudence perspective.

Abstract

Sexual violence frequently occurs around us, and it is not experienced by women; it can also happen to men, across all professions, and throughout the human lifespan. Sexual violence can significantly impact the mental health of its victims, ultimately leading to a decline in human resource quality in the future. SMK Kesehatan Patriot 3 Bekasi is a vocational school that aims to produce reliable and trained healthcare professionals, with a majority of its students being female. Healthcare is a profession with a high risk of experiencing sexual violence. This is the motivation for us, as law students at STIH IBLAM, to address this issue as the theme of our study this semester. Our goal is to provide education and information on recognizing and identifying sexual violence, preventive measures, assertive behavior, and reporting mechanisms in the event of such incidents. This is all in the effort to contribute to the creation of a Golden Generation in 2045.
