Abstract

Abstract: The purpose of writing this final assignment is to determine the factors that cause customary land disputes in Kabare Village and to determine the role of law in resolving customary land disputes in Kabare Village, North Waigeo District, Southwest Papua Province. The research method used is empirical normative research type, the type and source of data used is primary and secondary data, data collection techniques are through literature study, interviews, observation and documentation and the data analysis technique used is descriptive qualitative. The research results are the factors that cause customary land disputes in Kabare Village, North Waigeo District, namely, land boundaries, renting and buying and selling land and law does play a very important role in resolving disputes but its implementation is not yet optimal, especially for law. national, while customary law itself sometimes lacks awareness and compliance from the community in Kabare Village, North Waigeo District, Raja Ampat Regency.Keywords: Role of Law, Disputes, Customary Land

Abstract

Abstract: the purpose of this research is to determine the legal protection of Indonesian Migrant Workers (TKI) from Modern Slavery reviewed from Law Number 39 of 1999 concerning Human Rights (HAM) and to examine in more depth the factors that cause modern slavery to Indonesian Migrant Workers (TKI). In accordance with the objectives of the research above, it is hoped that this research can enrich the study and appreciation and benefits in providing legal protection for TKI from modern slavery and become input for the government and law enforcement so that they can be better in responding to modern slavery experienced by Indonesian Migrant Workers TKI. The research used is normative juridical research, where this research uses various approaches whose data sources use primary, secondary and tertiary legal material research, because this research was conducted at the Sorong Regency Regional Library, by collecting data to be used in this research in the form of a legislative approach and literature study. The analysis used in this study is a qualitative analysis approach which is carried out by tracing the legal materials that have been processed, such as laws and regulations and literature reviews which are then written descriptively and obtaining results by making conclusions that will be used in this study. The results of the study obtained by the author, in the form of Legal Protection for Indonesian Migrant Workers from modern slavery which is an effort by the government to provide proper protection for every citizen. By guaranteeing safety, security and welfare. So that there needs to be legal protection for Indonesian Migrant Workers so that they are free from discrimination and modern slavery. Cases that are often experienced by Indonesian Migrant Workers are cases of discrimination or modern slavery because Indonesian Migrant Workers are considered weak people who have no power whatsoever while under the auspices of their employers. Therefore, many Indonesian migrant workers are made into modern slaves who are forced to work or forced labor, their basic rights are not respected, they are made into sex slaves, traded (human trafficking), job opportunity fraud (illegal Indonesian migrant workers), weak law enforcement, lack of education and so on. These factors have resulted in modern slavery and have violated the provisions of government regulations and several articles in Law Number 39 of 1999 concerning Human Rights, which explains that human rights must be respected, honored, protected and upheld because they are a gift from God Almighty which is inherent and cannot be separated by anyone.Keywords: Indonesian migrant workers, Protection, From Slavery, Review of Law No. 39 of 1999.

Abstract

This study explores the legal review of the handling of premeditated murder cases accompanied by theft, as well as the considerations made by judges when imposing sentences on perpetrators. This criminal act is a serious offense that not only harms the victim but also has widespread implications for society, undermining public safety and trust in the legal system. Through an analysis of Article 340 of the Criminal Code concerning premeditated murder and Article 365, paragraph 3 regarding theft with violence, it is found that both articles provide a crucial legal foundation for addressing this issue. A firm and consistent law enforcement approach is necessary to create a deterrent effect and prevent the recurrence of similar crimes in the future. In this study, the author also evaluates that the considerations made by the panel of judges in ruling No. 160/PID.B/2023/PN.SON comply with applicable legal standards. This finding is based on testimonies from witnesses and the defendant indicating that the defendant can be held accountable for their actions, although they were intoxicated at the time. The recommendations provided in this study emphasize that the Public Prosecutor should be more meticulous and careful in drafting the indictment, paying attention to the intent or mental state of the defendant in committing the crime. This intent should not only be based on the defendant's admission but also assessed based on the manner in which the perpetrator committed the criminal act.Keywords : Premeditated Murder,Theft,Law Enforcement,Evidence,Sentencing

Abstract

 Abstract: This community service activity aims to instill an understanding of national values through the synergy of the four pillars (Pancasila, UUD 1945, NKRI, and Bhinne ka Tunggal Ika) as the basis for students' character in the global era. The activity was carried out for 3 hours on June 12, 2025 at SMAN 2 Kota Sorong, involving 25 students in grades XI and XII. The methods used were material delivery, questions and answers, and interactive games. The results of the activity show that the Community Service synergy of the Four Pillars of Nationality can be applied effectively in the educational environment to form students with strong, adaptive characters, and are able to compete globally. National values are not an obstacle, but rather an important foundation in facing the global era. Students' understanding of the Four Pillars of Nationality at SMAN 2 Sorong City is quite good conceptually, especially in the aspect of basic introduction such as the contents and functions of Pancasila, the 1945 Constitution, the Republic of Indonesia, and Bhinneka Tunggal Ika. However, this understanding still needs to be improved in terms of implementation and relevance to everyday life and global challenges. In addition, the implementation of the Four Pillars of Nationality has been integrated into various school activities, both through subjects and in extracurricular activities. Keywords: Four Pillars of Nationality, Student Character, Globalization, Community Service, SMAN 2 Sorong.

Abstract

Penyelesaian sengketa melalui arbitrase menjadi salah satu alternatif yang semakin relevan di era modern, khususnya dalam menangani sengketa bisnis dan perdata. Arbitrase menawarkan proses penyelesaian yang lebih cepat, rahasia, dan efisien dibandingkan pengadilan umum. Namun, pemahaman dan penerapan hukum acara arbitrase masih terbatas di banyak wilayah Indonesia, termasuk Papua Barat Daya. Advokat di Kota Sorong, khususnya yang tergabung dalam KAI, memiliki potensi besar untuk berperan aktif dalam penyelesaian sengketa melalui arbitrase. Metode yang digunakan dalam pengabdian ini adalah ceramah dan tanya jawab. Hasilnya menunjukkan bahwa pelatihan semacam ini berperan penting dalam meningkatkan kesadaran dan kompetensi advokat terhadap penyelesaian sengketa alternatif melalui arbitrase. Sehingga, diperlukan intervensi strategis dalam bentuk pelatihan, pengorganisasian, dan kolaborasi untuk meningkatkan pemahaman dan keahlian para advokad khususnya yang tergabung dalam organisasi KAI Provinsi Papua Barat Daya.
