<![CDATA[AbstractThe method used in this study is an empirical method by collecting primary data in the form of interviews, with a Descriptive approach, namely by describing and analyzing based on existing facts or data collected as they were at the time this research was conducted. The formulation of the problem in this study is "What are the Legal Consequences of Not Implementing the Handover of the Independent Partnership Plantation by PT. Poliplant Sejahtera to the Kudangan Manis Cooperative in Harapan Baru Village, Air Upas District, Ketapang Regency?" This partnership is intended to guarantee the availability of basic materials in plantation, However, when the agreement was running, there was a default at the time of the handover of the plantation land by the company. The results of the study are Between the Kudangan Manis Cooperative and PT. Poliplant Sejahtera entered into a partnership agreement in which PT. Putra Indotropical is obliged to hand over the oil palm plantation to the Kudangan Cooperative. It turned out that after 4 (four) years, PT. Poliplant Sejahtera did not transfer the oil palm plantation to the Kudangan Manis Cooperative..Keywords: Legal Consequences, Handover, Partnership PlantationAbstrakMetode yang digunakan dalam penelitian ini adalah metode empiris dengan mengumpulkan data-data primer berupa wawancara, dengan pendekatan Deskriptif, yaitu dengan menggambarkan dan menganalisa berdasarkan fakta atau data yang ada yang terkumpul sebagaimana adanya pada saat penelitian ini dilakukan. Adapun rumusan masalah dalam penelitian ini adalah "Bagaimana Akibat Hukum Tidak Dilaksanakannya Penyerahan Kebun Kemitraan Mandiri Oleh PT. Poliplant Sejahtera Kepada Koperasi Kudangan Manis Di Desa Harapan baru Kecamatan Air Upas Kabupaten Ketapang?". Kemitraan pada perkebunan merupakan kewajiban. Namun, pada saat perjanjian berjalan terjadi wanprestasi pada saat penyerahan lahan kebun oleh perusahaan. Hasil dari penelitian tersebut adalah Antara Koperasi Kudangan Manis dengan PT. Poliplant Sejahtera melakukan perjanjian kemitraan yang mana dalam kerjasama tersebut terdapat kewajiban dari PT. Poliplant Sejahtera untuk menyerahkan kebun sawit kepada Koperasi Kudangan.
