<![CDATA[ABSTRAKPenelitian tentang "Analisis Efektivitas Penerapan Konsep Mediasi Dalam Penyelesaian Sengketa Perbankan Di Kalimantan Barat", bertujuan Untuk mengetahui dan menganalisis efektivitas penerapan konsep mediasi dalam penyelesaian sengketa perbankan di Kalimantan Barat. Untuk mengetahui dan menganalisis faktor yang mempengaruhi keberhasilan mediasi dalam penyelesaian sengketa perbankan di Kalimantan Barat.Penelitian ini dilakukan dengan menggunakan metode sosiologi hukum (Socio-legal research), sehingga dapat dideskripsikan atau digambarkan mengenai analisis penerapan konsep mediasi penyelesaian sengketa perbankan di Kalimantan Barat, sehingga dapat dipelajari dan diteliti sebagai suatu studi tentang hukum yang senyatanya hidup di masyarakat sebagai studi yang non- doktrinal dan bersifat empirisBerdasarkan hasil penelitian dan pembahasan diperoleh hasil sebagai berikut : Bahwa efisiensi sebagai manfaat utama mediasi, menilai kecepatan dan kesederhanaan proses sebagai alasan utama pemilihan metode ini. Meskipun hanya 20% yang menilai pengurangan biaya dan waktu serta peningkatan kepuasan sebagai manfaat utama, faktor-faktor ini tetap signifikan. Oleh karena itu, dalam merancang dan mempromosikan mediasi, penting untuk menonjolkan efisiensi sambil mempertimbangkan pengurangan biaya, waktu, dan peningkatan kepuasan. Dengan demikian, mediasi dapat dioptimalkan untuk memberikan solusi yang lebih baik dalam penyelesaian sengketa. Bahwa keberhasilan mediasi dipengaruhi oleh beberapa faktor kunci. Kesiapan dan keterbukaan para pihak untuk berkompromi serta niat baik sangat penting untuk efektivitas mediasi. Mediator yang berpengalaman dan memahami aspek hukum serta bisnis dapat memfasilitasi proses dengan lebih baik. Kepatuhan terhadap prosedur mediasi, komunikasi yang efektif, serta keberimbangan posisi antara pihak-pihak yang bersengketa juga berperan besar. Selain itu, pengelolaan faktor psikologis dan komitmen para pihak untuk melaksanakan hasil mediasi serta lingkungan yang kondusif turut mempengaruhi keberhasilan mediasi. The readiness and openness of the parties to compromise and good intentions are very important for the effectiveness of mediation. Experienced mediators who understand the legal and business aspects can facilitate the process better. Compliance with mediation procedures, effective communication, and a balance of positions between the disputing parties also play a major role. In addition, the management of psychological factors and the commitment of the parties to implement the results of mediation and a conducive environment also influence the success of mediation.
