Abstract

Abstrak: Indonesia menghadapi masalah dalam hal pengelolaan sampah. Tumpukan sampah yang makin tidak terkendali tanpa diikuti dengan pengolahan sampah yang efektif menjadi permasalahan utamanya. Sudah banyak peraturan yang dibuat, tetapi implementasinya tidak berjalan sesuai yang diharapkan, struktur hukum yang belum dapat menjalankan penegakan hukum, hingga minimnya kesadaran warga dalam memilah sampah. Penelitian ini menggunakan metode penelitian yuridis normatif dengan teknik pengumpulan data melalui studi pustaka (library research) yang berkaitan dengan kajian teoritis dan beberapa referensi dari literatur–literatur ilmiah. Kemudian, teknik analisis data diolah secara deskriptif kualitatif yang menggambarkan dan menjelaskan fenomena sosial atau perilaku dalam situasi yang nyata menggunakan pendekatan perundang-undangan (statute approach) dan pendekatan kasus (case approach). Terdapat potensi yang besar di tempat pembuangan sampah terpadu (TPST) Bantargebang, Bekasi untuk dimanfaatkan menjadi energi listrik melalui sistem waste-to-energy (WtE) di Indonesia seperti Negara Swedia. Namun, Indonesia menghadapi kekurangan lahan, biaya yang besar, dan pemilahan sampah yang lama. Potensi pada gunungan sampah di TPST Bantargebang, Bekasi belum dimanfaatkan dengan optimal menjadi energi listrik melalui sistem waste-to-energy (WtE) merujuk pada kesuksesan Swedia. Berbagai aturan yang ada tidak direalisasikan, struktur hukum belum optimal, dan budaya masyarakat tidak peduli akan pentingnya pemilahan sampah sehingga Indonesia sudah sepatutnya memaksimalkan ketiga unsur sistem hukum tersebut supaya permasalahan dapat dituntaskan secara efektif dan berkeadilan. Kata Kunci: Sampah, Waste-To-Energy, Energi Listrik, Sistem Hukum Abstract: Indonesia is facing a problem when it comes to waste management. The uncontrolled piling up of waste without being followed by effective waste management is the main problem. Many regulations have been made, but their implementation has not gone as expected, legal structures that have not been able to carry out law enforcement, to the lack of awareness of citizens in sorting waste.This research uses normative juridical research methods with data collection techniques through library research related to theoretical studies and several references from scientific literature. The data analysis technique is then processed descriptively qualitatively which describes and explains social phenomena or behaviour in real situations using a statute approach and case approach. There is great potential at the Bantargebang integrated waste disposal site (TPST) in Bekasi to be harnessed into electrical energy through waste-to-energy (WtE) systems in Indonesia like Sweden. However, Indonesia faces land shortages, high costs, and lengthy waste segregation. The potential in the mountains of waste at TPST Bantargebang, Bekasi has not been optimally utilised into electrical energy through a waste-to-energy (WtE) system referring to Sweden's success. Various existing regulations are not realised, the legal structure is not optimal, and the culture of the community does not care about the importance of waste segregation so that Indonesia should maximise the three elements of the legal system so that problems can be resolved effectively and fairly. Abstract

The Daya Anagata Nusantara Investment Management Agency (BPI Danantara) was established to manage state investments and assets based on Government Regulation No. 10 of 2025 on the Organization and Governance of the Daya Anagata Nusantara Investment Management Agency, aiming to maximize government investment and encourage national economic growth. This research highlights the importance of transparency, oversight and accountability in managing the risk of state financial investment losses. BPI Danantara is required to prepare an annual performance report audited by an independent auditor and report periodically to the Supervisory Board, including agencies, such as KPK, BPK, and OJK. Despite the regulations, there are still concerns about the effectiveness of supervision and potential conflicts of interest within the Supervisory Board. Responsibility for investment losses falls entirely on BPI Danantara, not the state, leaving a gap in the moral accountability of investment managers. The purpose of this writing is to analyze the Supervisory Transparency Mechanism in the Daya Anagata Nusantara Investment Management Agency on the Implementation of State Financial Investments and the Legal Liability of the Daya Anagata Nusantara Investment Management Agency for the Risk of State Financial Investment Losses. This research uses a juridical-normative approach to analyze relevant regulations and emphasizes the importance of transparency and accountability mechanisms in state financial management. It is expected that BPI Danantara can become a better model of financial management and contribute to national economic growth in accordance with further provisions in Government Regulation Number 10 of 2025 concerning Organization and Governance of the Daya Anagata Nusantara Investment Management Agency.
