Abstract

Technological developments have a significant impact on social life, creating new opportunities and challenges. One of the negative impacts is cybercrime which increases risks and vulnerabilities. Effective law enforcement is necessary to protect individual rights and ensure digital security. The research method used in this study involves a juridical-normative approach to analyze the implementation of laws related to the use of artist photos for the promotion of unlicensed online gambling in Indonesia. Implementation of the ITE Law and PDP Law is important in dealing with cybercrime. Law enforcement through the ITE Law and the PDP Law is a crucial instrument in tackling this kind of cybercrime, but there are still challenges in the effectiveness and relevance of the two laws. Continuous efforts are needed to strengthen law enforcement, increase public awareness, and pay greater attention to victim recovery as part of Indonesia's commitment to ensuring the protection of human rights in the digital era. Synergy between law enforcement officials, the private sector and the community is needed for prevention, law enforcement and recovery of victims. Protection of individual rights, including artists who are victims of photo misuse, must be a priority with a holistic and collaborative approach. Indonesia can maintain and strengthen human rights principles in the digital era, while ensuring that perpetrators of cybercrimes that violate the law can be dealt with firmly and fairly.

Abstract

The presence of political buzzers on social media has a significant impact on the political map in Indonesia, especially in terms of spreading hoaxes and misleading information that can damage the reputation of certain individuals or groups. This phenomenon has the potential to cause unrest in the community, especially in the context of elections and democratic stability. This research aims to analyze the application of law against political buzzers in Indonesia, as well as identify the elements of political buzzer actions that can cause public unrest. The research method used is normative-empirical legal research, by collecting secondary data in the form of primary, secondary, and tertiary legal materials, which are then reinforced by interviews with relevant sources. The results showed that although there are laws and regulations, such as Law Number 1 of 2024 concerning Electronic Information and Transactions, the application of law against political buzzers has not been effective. This is due to the ineffective application of the offense of complaint which depends on the initiative of the aggrieved party, as well as the complexity of political dynamics. This research also found that political buzzers can be categorized based on the rewards received and the purpose of disseminating controversial and damaging information. Bahasa Indonesia Abstrak: Kehadiran buzzer politik di media sosial memberikan dampak yang cukup signifikan terhadap peta politik di Indonesia, terutama dalam hal penyebaran hoaks dan informasi yang menyesatkan yang dapat merusak reputasi individu atau kelompok tertentu. Fenomena ini berpotensi menimbulkan keresahan di masyarakat, terutama dalam konteks pemilu dan stabilitas demokrasi. Penelitian ini bertujuan untuk menganalisis penerapan hukum terhadap buzzer politik di Indonesia, serta mengidentifikasi unsur-unsur perbuatan buzzer politik yang dapat menimbulkan keresahan masyarakat. Metode penelitian yang digunakan adalah penelitian hukum normatif-empiris, dengan mengumpulkan data sekunder berupa bahan hukum primer, sekunder, dan tersier, yang kemudian diperkuat dengan wawancara dengan narasumber terkait. Hasil penelitian menunjukkan bahwa meskipun telah ada peraturan perundang-undangan, seperti Undang-Undang Nomor 1 Tahun 2024 tentang Informasi dan Transaksi Elektronik, namun penerapan hukum terhadap buzzer politik belum efektif. Hal ini disebabkan oleh belum efektifnya penerapan delik aduan yang bergantung pada inisiatif dari pihak yang dirugikan, serta kompleksitas dinamika politik. Penelitian ini juga menemukan bahwa buzzer politik dapat dikategorikan berdasarkan imbalan yang diterima dan tujuan penyebaran informasi yang bersifat kontroversial dan merusak.
