Abstract

Injustice is felt by women in Indonesia in various fields of life including the family institution. Based on data from the Ministry of Empowerment and Child Protection that by the end of 2022 there were 18 thousand more cases of domestic violence. And from these data almost 80% of victims are women. With these conditions and facts, it can be concluded that women do not understand their position as wives in the family, so they are very vulnerable to domestic violence. The type of research that the writer uses is a juridical-normative type of research. In this study, the collection of legal materials was carried out through Library Research, in the form of documents and laws and regulations related to this research. From these discussions, it can be concluded that the existence of family law rules in Indonesia, if specifically reviewed, still contains points that contain gender bias. However, in general review, the materials contained in KHI seem to have shown an equal position between men and women. The binding rules between men and women can be considered fair in the context of Indonesian society which has its own cultural pattern with a society structure that tends to be pluralistic.
