Abstract

Penelitian ini membahas peran strategis Komisi Kode Etik Polri (KKEP) dalam menegakkan kode etik profesi kepolisian untuk menjaga integritas dan kedisiplinan anggota Polri. Berdasarkan Peraturan Kepolisian Negara Republik Indonesia Nomor 7 Tahun 2022, KKEP memiliki kewenangan untuk menangani pelanggaran kode etik di berbagai tingkat kesatuan melalui mekanisme yang transparan dan adil, baik dalam sidang pemeriksaan cepat maupun biasa. Penelitian ini menggunakan metode kepustakaan dengan pendekatan normatif, memanfaatkan data sekunder berupa dokumen resmi, regulasi, literatur hukum, dan putusan terkait pelanggaran kode etik. Hasil analisis kualitatif menunjukkan bahwa meskipun KKEP telah menjalankan perannya sesuai prosedur, terdapat sejumlah kendala dalam pelaksanaan, termasuk keterbatasan sumber daya, inkonsistensi penerapan aturan, dan kurangnya pengawasan di tingkat kesatuan. Untuk mengatasi kendala ini, penelitian merekomendasikan penguatan regulasi, peningkatan kapasitas sumber daya manusia, dan optimalisasi peran PROPAM dalam pengawasan. Penelitian ini menyimpulkan bahwa keberadaan KKEP sangat penting dalam memastikan penegakan kode etik di Polri berjalan sesuai prinsip transparansi dan keadilan, sehingga mampu menjaga profesionalitas institusi kepolisian.

Abstract

The development of genetic technology, especially DNA testing, presents new opportunities in proving civil law, especially related to the status of children non-marital. In the context of Indonesian law, the regulation of non-marital children still gives rise to various interpretations, especially in terms of determining civil relations with the biological father. The Constitutional Court through Decision No. 46/PUU-VIII/2010 and the latest Decision No. 69/PUU-XIII/2015 has opened up the space for recognition of children non-marital, but has not fully regulated the mechanism of proof comprehensively, especially in cases involving alleged adultery. This study aims to analyse the status of children non-marital after the Constitutional Court's decision and the extent to which DNA tests can be used as evidence to determine the child's civil rights, whether as main evidence or only in supporting nature. The research method used is normative juridical with a legislative approach and a study of court decisions. The results show that DNA tests have high scientific validity, but are still legally positioned as supporting evidence, not a single stand-alone evidence. This is in line with Article 1865 of the Civil Code and Article 164 of the Civil Code which places evidence in a certain hierarchy. In conclusion, although DNA tests have the potential to strengthen the civil claims of non-marital children against their biological fathers, there is still a need for voluntary recognition or through a court order that comprehensively assesses the entire set of evidence. Therefore, further regulation is urgently needed to ensure legal certainty and protection of the rights of children non-marital in Indonesia.

Abstract

Cyberbullying on social media is a serious problem that can negatively impact the mental health and well-being of victims. Lack of supervision in the family, school, community, and individual environments causes cyberbullying. Article 433 paragraph (1), and paragraph (2) of Law No. 1 of 2023 concerning the Criminal Code (KUHP) provides a new legal basis regarding defamation through social media and will be enforced in 2026. Artificial intelligence (AI) can be an innovative solution in addressing this problem. The purpose of the study is to analyze the legal protection of victims of cyber bullying on social media according to Law No. 1 of 2023 and explore the potential integration of AI in its handling. The research method used is normative juridical, using a legislative approach and an analytical approach. The results of the study show that although Law No. 1 of 2023 provides a clear legal framework, its implementation is still hampered by a lack of resources and understanding in the community. On the other hand, AI integration has proven to be effective in detecting and analyzing bullying behavior on social media, providing support to victims, and speeding up the investigation process by authorities. This study concludes that legal protection for victims of cyber bullying can be improved through the integration of artificial intelligence. Therefore, collaboration between the government, social media platform providers, and technology experts is needed to create more effective and responsive solutions to the problem of cyber bullying in society
